      Search Professionals ***** ** *** ** Draper, UT 84020 ###-###-#### Contact of Michael M********* ********************************* Michael M********* signed a legally binding contract via docusign. Michael promised resume and LinkedIn review. He also promised executive recruiting services. Michael wanted $6000 for services. I paid $3000 thus far and started to realize it was a scam. I asked for a $2700 refund less a $300 admin fee per the contract and so far Michael has refused to pay the refund. I paid $3000 USD via Zelle between 8/22/23 and 8/25/23. I asked for a refund on 11/1/23. Per the contract, Michael then had 7 days to issue the refund. He has refused. It is now 11/18/23 and he has still not issued the refund. Michael and I signed legally binding contracts via docusign on about 8/22/23 and 9/20/23. The contract stated either party may cancel the contract at any time for a full refund less a $300 administrative fee. As of 11/18/23, Michael owes me $2,700. According to BBB, the same phone number and contact name were used under other business names also with "F" ratings.       I have been providing service to my client and have verifiable proof of that service and his acknowledgement of such.  Our agreement is for me to assist my client in his job search for a period of six months and if he does not obtain employment of his choice by the end of that time period, then he is eligible for a refund.  I will continue to serve my client as we originally agreed by providing expertise for his job search.  Hopefully he will choose to avail himself of those services until he finds desirable employment or the term runs out, whichever comes first.  Though my client has made some remarks about me which are false, I will seek to continue serving his best interest in his quest for new employment.

      The first contract was signed via Docusign on August 22, 2023.   

      An updated contract was signed via Docusign on September 20 and 26, 2023.   

      Both contracts were provided to BBB.

       

      I have also included well over a dozen emails asking for status updates and the deliverables Search Professionals / Michael MXXXX promised in the contract, most of which were never delivered.  

       

      Search Professionals / Michael MXXXX commonly replied via email with something similar to "see subsequent email".  No subsequent email contained any contractually promised deliverables despite my formal requests.   

       

      The contract states:

      6. Securing new employment shall be defined as the Client working beyond 90 days for the same employer as a result of the consultant and client’s efforts related to this contract.   

      11. If new employment has not already been secured, then, either party may cancel this agreement in writing at any time; all fees will then be refunded to the Client within 7 days minus the $300 administrative fee.   

      12. The first $3000 installment has already been paid to the consultant on about August 22, 2023.

      ...As of November 1, 2023 and still on November 28, 2023 I have not secured new employment, am not in any interview processes, and do not have any job offers.   

      On November 1, 2023 I formally requested my refund of $3000 sans $300 for a net of $2,700 via Zelle due by November 7, 2023.   

       

      Today is November 28, 2023, I have repeatedly asked for this refund to which I received replies and advised no money will be refunded.  This is directly in breach of the legal contract signed via DocuSign.  I still have not received a refund from Search Professionals or Michael MXXXX.   

       

      It appears Michael MXXXX has done this numerous times before under other business names according to BBB complaints and "F" ratings.  All have very similar complaints and have used the identical business phone number of ************.   

       

      I just want my refund and we can move on.

      I entered into an advocate agreement with Michael M********* of Search-Professionals in 2023, whereby the company would provide career assistance and recruiting, which included meetings, marketing advice, and a guarantee of placement within 1 year of the retainer. In the event that you are not placed within one year, a refund would be granted. The company did not perform any of its obligations and did not meet with me one time throughout the duration of the year. It did not result in one single recommendation, one interview, or a single conversation. I am entitled to a full refund. I have written to Mr M********* at least 15 times seeking comments or solutions and get nothing in response. Sadly this has become clear to me that I have been scammed and have had $7500.00 stolen from me. I have investigated his presence and can find no record of his whereabouts either physically nor electronically.

      I entered into an agreement with this organization, and Michael M********* in particular, whereby I paid in advance a sum via Venmo in exchange for a promise of career search expertise and action including, but not limited to: identifying specific companies and/or organizations; writing a resume and LinkedIn profile; making connections to executive recruiters all for the purpose of gaining interviews, introductions and meetings in order to secure employment. None of these activities has taken place in the 6 months since paying the fee. I asked for a refund in full over a month ago and I have still not received this refund.

      Agent Service Agreement dated may 27, 2021 between me and the company. Company agreed to refund my retainer of $7500 if company was unsuccessful in the search within four months. Company agreed to make payments to me and has failed to provide the refund. Mike M********* refuses to answer any correspondence.
