          Government Action: BBB reports on known government actions involving business’ marketplace conduct:

          United States of America v. Christopher O'Hara

          The following describes a government action that has been formally brought by a government agency but has not yet been resolved.  We are providing a summary of the government's allegations, which have not yet been proven.  

          On April 3, 2019 The United States District Court for the Western District of Texas San Antonio Division indicted Christopher O'Hara President of 1st Care MD, Inc. with conspiracy to defraud the United States and to pay and receive health care kickbacks by impairing, impeding, obstructing and defeating through dishonest means, functions of the United States Department of Health and Human Services administration and oversight of Medicare.  It is alleged that Mr. O'Hara and his co-conspirators unlawfully paid and received kickbacks and bribes in exchange for doctors orders for DME (Durable Medical Equipment) for Medicare beneficiaries.  

          It is alleged Mr. O'Hara operated 1stCare MD and ProfitsCentric to defraud customers by selling completed doctors orders for DME in exchange for kickbacks and bribes on claims submitted to federal health care benefit programs.  Mr. O'Hara paid illegal kickbacks and bribes to ProfitsCentric and 1stCare MD through a founder, part-owner and manager which operated international call centers.  In order to conceal illegal kickbacks and bribes O'Hara, and others created sham contracts and documentation that disguised the kickbacks and bribes as payments for "consults," "marketing," "hours," and business process outsourcing, among other services. 

          From 2016 continuing through 2019 Mr. O'Hara through ProfitsCentric and 1stCare MD, caused DME companies to submit, approximately $40 million in claims to Medicare for DME.  Medicare paid DME companies approximately $20 million. 

          The matter is pending.
