Transaction date - 6/24/23 Amount paid - $1000.00 Business Commitment - the business was supposed to fix the air conditioner. However, there were concerns from the beginning. It was requested that the owner come out to check over what was done. The owner did come out. However, there still seemed to be problems with the system. The company was contacted and a call back was requested. When we failed to receive return communication, we contacted another company to fix the issue. The other company was able to determine the issue and resolve the problem. The problem was D&D's technician placed the incorrect part on the unit which caused additional problems. We have attempted to contact D&D via email and we sporadically receive responses. They mentioned providing an $85 refund. However, this is unacceptable since we provided them with the documentation of the services provided by the new company and the reason why the parts had to be replaced. Since we are out of close to $2000 due to the negligence of their technician, we should receive a refund. As noted in the invoice, the previous company installed the wrong part.Business response

We received your request for a refund. We carefully reviewed this information.
We did come out to service your equipment (6-26-23) and replaced a contactor, run capacitor and added refrigerant. This was in the amount of $1000. You were in the process of disputing the warranty coverage of the equipment. We were told by the distributor for Trane that your parts would not be covered due to power issues that caused the parts to fail. This is stated on your base warranty, Part 4.“operations of electrical equipment other than the range specified on the Product Name plate”.” Part 6 Act of God”
We were never advised of any issues with the equipment after our service. As far as we know, you were in process of disputing warranty from Trane manufacturing.
You called another company on (7/27/2023) over a month later, by your own volition. You never inform us of any issues. You did not give us the opportunity to fix, correct any problems. If you would have informed us of any issues with in the 30 day period. You would have most likely been covered by our 30 day warranty (shown on our invoice) and you would have most likely not have to pay anything if our parts failed or was incorrect installed.
We show that on(6/26/2023) you were overcharged on an invoice and refunded $85.00 on ***** ***** (7/21/2023). That check to date has not been deposited. This check will have a stop payment issued due to the fact it was lost or stolen. As soon as the stop payment has been issued a replacement check will be issued.
After careful review of all documents, we will not be issuing any other refunds.

I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this proposed action would not resolve my complaint.
You keep saying that we failed to notify you. However, as mentioned in the original post, we attempted to reach you on several occasions prior to moving forward with another company but you never responded to my request for contact. Since we were having issues and the temperature in the home has to be kept at a specific temperature, we contacted another company. Regardless of whether it was covered by the warranty, we paid for your services and the services that we paid for were done incorrectly. Therefore, we paid for the services of another company. They were able to correctly complete the services. I don't understand why you keep bringing up the warranty when that isn't the issue. The issue is your technician placed the incorrect part on the AC unit. For this, we should receive a refund. Also, you keep mentioning you were going to put a stop payment on a check that you supposedly sent but this has been going on for a while now. We are not requesting a full refund. We are requesting a reasonable refund in addition to the overcharge that you keep mentioning.
