Purchased sod install from Clearfork for $1,726.59 (contract signed 4/12/21.Sod installed 4/24/21.Sod that was brought in had disease (take all patch). This is a soil-based disease that can't be removed. Majority of the sod has failed and ground now has disease. I had an expert send soil samples to a lab for testing to confirm the disease.I've spoken on the phone (and texted) with Clearfork on numerous occasions of the last several months. Their perspective is it's not their fault that their supplier provided them with diseased sod. They have been unwilling to re-sod, provide refund.Business response

It would appear that the customer has accurately described the situation except that the disease is treatable. Clearfork Lawn Care has a company policy that is communicated with Evan **** regarding warranty on sod. The matter was discussed with the customer several times regarding how to remedy the situation and how to move forward. The customer declined all services offered. The customer hired another company to help remedy the situation that made it worse for him then he tried to come back to us for us to fix it again.
This customer did the same thing on a previous job that we did for him a few years ago. He didnt properly manage the plants we installed and they died. We told him we wouldnt fix it for him and he threw such a fit that we decided to handle it for him since it was so small. He did not have any luck this time with the same tactic. This man is a scammer and not willing to accept responsibility for actions.

I am rejecting this response because: the business owner caused damage to his customer's residence, has refused to take responsibility, and resorts to name-calling and insults.The allegations made by the business owner about previously "scamming" and throwing "fits" are fabricated. The event he referenced previously was misrepresented. A minority of the plants installed were replaced when they failed shortly after being installed due to being planed in poor locations. This was done at the business's own discretion after only one request for help by the customer.
As for the current issue at hand. The sod the business owner installed at the customer's residence brought a disease not previously present to the lawn. This is evident in the fact that the only parts of the yard impacted are where the sod was installed. All other parts of the yard under the customer's care have remained healthy and disease free.
The business owner has refused to take responsibility for the damages caused to his customer. His only offer was to sell treatments (for additional fees) that his representatives said would not guarantee recovery from the disease.

Alright Mr ************* This is a complaint through a marketing company, not a lawsuit. It is our company policy to not warranty or guarantee any sod as it requires care by the customer after installation, to include fungicide application. The customer, as stated, did not want to pay for the fungicide and therefore didn't get any fungicide. So his grass died. I have no further comment on refunding or offering any further services to this scammer.Customer response
