      My front window was shattered by an intruder November 11, 2022 at approximately 11:45 pm. A police report was filed and the intruder was from the neighborhood but ran off when confronted. I called property manager ******************************* of the incident and was told I would have to pay for the window. Saturday November 12 I received a text to call ****** from HBC contractors. ****** promised me he would be out either the 12th or 13th to put a temporary cover over the shattered front window. ****** was a no show but I received a call from his office to set up an appointment to have the window repaired. Nothing happened until the 25th of November when ****** came to ***** *********************** and placed a clear garbage bag over the shards of glass. Someone canceled the original work order of the 12th of November. *** told me the owner of the property canceled the order because she believed I broke the window and wanted to see the police report. I dont believe any of it and the result of the game playing is I had to pay two rents, because my wife left because she didnt feel safe in a home with a missing window that the elements could enter and or anyone had easy access to the home. I am 70 and certainly did not provoke a young man to break into my home. What business would let a house sit three weeks with a shattered front window?

      Received by mail on December 27, 2022

      In reference to ********************* complaint, these are the facts.


      On October 27, 2022, ********** submitted to our office a 30-day notice to vacate.  He states on the notice that his reason for moving was that he needs to be closer to work.  He also gives us his new address and includes a letter (attached) how happy he was living on the property.  With owners approval, we began advertising the property for rent on November 11, 2022. 


      ********** text ******** on his cellular on Saturday, November 12, at 11:06 am that an assailant broke his front window on Friday night at 11:30 pm.  ******** immediately responded to his text for him to call the Handyman ****** at **************.  ******** continues to text ********** that he has spoken to owner of the property and has already text ****** about the broken window pane.  HGC Contractors ***************************, was also given Mr. **** phone number so they could arrange a ************* agreeable for both of them.  According to ****** with HGC Contactors, they made multiple attempts to make arrangements with ********** to meet them at the property of ***** ***********************. Due to the fact, that the window has exterior wrought iron bars, along with interior shutters, inside access of the home was needed in order for the window to be boarded up. ********** did not show up to the appointments so no inside access was granted to the contractor until November 25th. The front window pane was delivered and installed on November 30, 2022.


      During the course of these events, the property was being advertised for rent. On November 18th at 2:41pm ********** was notified again by text (attached) that he has been canceling and rescheduling several showings for prospective tenants to see the property. ******** received and forwarded a text from his agent, *******************************, to ********** that ******* was at the property and no one was there for the showing that was scheduled by ********** for ******* to show 3 different families the home. This is proof that ********** disregards all attempts to follow through on appointments made for *********** agents and contractors.


      ********** turned in the keys to the property on November 30,2022 to our office staff.  DKD Associates,Inc. has 30-days to process a security deposit transmittal according to his lease contract. ******************************* did a move-out inspection of the property on December 1, 2022. We have attached pictures of the condition of how ********** left the property on ***** ***********************. The home was left with a large amount of trash and belongings left by **********, the home needed to be cleaned as per the homeowners request, the yard was in disarray, and ********** broke a couple of items in and outside of the home. ********** was not charged for the broken window. A copy of his security deposit transmittal settlement form that will be sent out today to Mr. **** forwarding address is attached.


      To respond to the tenants settlement desires, the homeowner does not agree with giving back Mr. **** November rent since the 30-day notice was given by him and his responsibility is to pay through a 30-day notice. As for his request for his security deposit to be returned to him, the owner herself reached out to ********** about the condition and abundance of trash and debris left behind by them. We have attached pictures of before Mr. **** move-in and after Mr. **** move-out.  Pictures speak louder than words.

       I am rejecting this response because:

      ******************************* is beyond a simple liar but a fabulist.  I agreed to vacate ***** *********************** on December 1, 2022. I paid the rent for the month of November 2022 but was unable to live in the house because of a broken front window that was not repaired until I moved out on December1. Because of the game playing and unprofessional behavior of ******* no one came to repair the window until November 25, fifteen days later.  The repair consisted of a clear plastic garbage placed over the shards of glass.  ******* says I did not give him a police report but my phone records show I texted him on November 12 and sent photos and the police report.  I received an email to call HGB contractors on the 12th which I did and ****** promised he would be out on the 13th to put a temporary covering on the window until a permanent pane of glass could be found on Monday the 14th of November.  On Monday the 14th an employee from HGC Contractors called me to tell me ****** would be out. ******* says I was never available to let ****** into the house. That is a stupid lie because I needed the window fixed for the security and warmth of my family.  In the interim I received a call from ******* saying that the owner believes I broke the window and needs a police report.  The proof is that they were aware of a police report on the 12th because there was an urgency to repair the window.  Game playing on the part of DKD, HGC contractors put my family in danger that I had to pay another rent so my wife could live in comfort. It was a neighbor that smashed the front window.  
      Aside from the broken window DKD sent me a bill of extortion that charged me for removing a dead tree that I repeatedly complained about but which ******* said was alive when I moved in, the photos from three years ago shows a unhealthy tree with dry broken branches and a bad cut that someone had chopped off the top of the tree.  
      I paid rent for three years always before the first and never was treated like a valued customer.  The house on ***** is a disaster and the owner nor DKD spent anything on maintenance.  
      DJD and the owner charged me the security deposit and an additional deposit of $150 for the house being unclean even though the photos show the house being immaculate. ******* simply gave the owner extra money like paying for the removal of the dead tree out of anger that I called the city for the broken window and dead and dying trees.

      DKD Associates, Inc. response to Complaint ID #******** (Consumer Rejection)

      In response to Consumer rejection, I do not appreciate Mr.**** defamation of my character.  I have done nothing but try to be an intermediary with ********** and his wife and the owner of the property. 

      In our response submitted to the BBB, we showed several documents of proof that on October 27, 2022, ********** gave us a thirty- day notice of intent to vacate the property on ***** *********************** and a letter to us about his enjoyable time on the property during his 3 year stay.  On October 27, 2022 ********** also gives us the forwarding address of *******************************************************  This proves that he on that date already had either secured or signed a new lease agreement for that property.  The window he now claims that his neighbor broke, was not the reason he had to move out of the property.

      In regards to the maintenance, we have several pages of texts with the owner of all the times in the three years that he put in a work order and each time the owner responded with an approval.  We will be happy to also supply all those pages if needed.  For ********** to claim now that the house was a disaster is unbelievable.

      To talk about a disaster, the owner was appalled on the way ********** left her property upon move out. Pictures were supplied in our first response.  The abundance of trash and belongings that he left in the shed and surrounding areas was unbelievable.  After his move out on December 1, 2022, the owner herself contacted ********** and gave him ample time to clean the mess out.  He never did, so we had no choice but to hire an independent contractor, Rodos ******************** Services to clear out and haul off everything out of the shed and surrounding yard areas. 

      ********** now brings attention about a dead tree for which he was never charged for.  The lease agreement he signed does stipulate that landscaping is the responsibility of the tenant.  ********** made the decision to turn in the keys and present the house in the condition he left it in and that would determine his security deposit.

      The owner of the property has been shown all the correspondence of this complaint.  She stands strong that his desired settlement will not be granted.  ********** initiated a thirty- day notice to vacate the property at his own discretion.  The lease stipulates that he has to pay the rent through his thirty- day notice. He has been given the cost of the cleanup of the house.  His security deposit did not cover all the charges. He was left with a balance of $149.49. The company is willing to right off that remaining balance of $149.49 to close out this complaint.

      If needed, I am more than happy to sit and discuss this in person.  We will also notify the owner of the property as a witness to the above.

       I am rejecting this response because:

      DKD and *********************** are forgetting the real issue. My wife and I were the victims of a home invasion on November 11, 2022 when a young man smashed our front room window to access our home. I went out the front door to confront the individual, was threatened before the young man ran away with blood dripping from his hands. It was very unsettling for my wife. I called the police and they made a report and I immediately sent the report to *******************************, property manager. On the 12th I was instructed to call ****** from HGC contractors. I spoke with ****** and he told me he would be out either Saturday the 12th or Sunday the 13 to place a temporary covering the damaged window until he could find the proper pane of glass. Also the office of HCL contractors called me on Monday the 14 to verify that ****** would be out to install the window.  HGC did not repair the window until the 1st of December.  
      I received a call from ******************************* later on the week that the owner believes I broke the window.  it was clear to me that DKD and the owner of the property were playing games with me and the safety of my family.  On the 15th of November my wife moved out because the house on *********************** was uninhabitable, making it necessary to rent temporary housing until our new home was ready on the 1st of December.  

      in spite the fact I paid rent for three years always on time I feel deeply offended by the dishonest and disdainful way that my wife and I were treated.  They say I was not available for HGC to install the window that is a lie because I have phone records to prove otherwise.  ****** from HGC didnt show up until November 25, fifteen days later than he promised. His solution was to place a clear garbage bag over the shards of glass. 
      I am still very angry by the lack of professionalism and compassion shown to me and my family.  I had to pay $1,275 dollars for temporary housing.  The problem could very easily have been if the window could have been repaired as promised.  Why wasnt it?
