I have been moved out of these apts for a month (before move out date) and they are trying to charge me carpet damage when I have no idea what the marks wouldve came from they were not there when I left contacted them and they said it was a pet odor but there was no pet inside or pet recorded because I never owned one. Also I wasnt offered a walk through with the managers even then just advised to leave my keys and when they would do the walk through. These apts are just trying to abuse of money even when I have felt unsafe due to restraining orders I was never allowed to move buildings or exit lease. I lived here for 3 years and it has come to now that they are charging for whatever whenever and even for what wasnt me the door wasnt unlocked, only the days I had left the mail keys when advised which were only a couple of days. I am contacting BBB to find a resolution on what I didnt do, which was the carpet damage I have made payments for what was (blinds, drip pans allocated water bills even though I have been moved out) but this I will not do because I didnt damage any carpet and I would hope for resolution or fee removal.Customer response

This apt complex company has not contacted me nor advised me of anything I talked to corporate the same time this was filed and they told me theyd get back to me in 48 hrs its been well over the estimated time. Im not surprised they havent answered because my reasoning is valid and my statement is true. However, I am upset with their efforts these apts have to resolve this matter.Business response

THE PROPERTY MANAGER SPOKE TO ***************** ON 01/30. SHE LET ***************** KNOW OF THE *** ODOR. SHE FOLLOWED UP ON DAY OF MOVE OUT AT 2:30 BUT MS ****** WAS WORKING UNTIL 6:30 AND REQUESTED TO LEAVE KEYS IN THE APARTMENT. SHE STATED SHE WOULD NOT BE AVAILABLE FOR A WALK THROUGH. ***************** WAS CHARGED $355 FOR CA*** REPLACEMENT DUE TO IRREVERSABLE DAMAGE FROM *** AND HEAVY STAINS. I am rejecting this response because:
The stains that are being stated or blamed on to me are not mine,I never owned a pet, there is no reason or where I wouldve made that which is what I talked to corporate and the apartment managers that had advised me I would be told a response in 48 hrs (its been over a month). I never paid a pet rent fee nor was it ever stated on the walk throughs, pest control, maintenance or any other time I allowed the apartment workers inside. The walk through was supposed to be before the keys were given I was not aware that it would be the day of however thats not my issue with the company the fact that Its taken a whole month to get a response and even then not a reason to why there would be supposed black stains when I didnt leave it black nor had a pet. If the reasoning was maybe there was marker or some sort of reason to it being black sure but the fact that its saying its a pet when I havent owned is suspicious especially when this complex is known to charge for everything, not answer calls and when advised of other issues such as car break ins etc they had brushed it off not even bringing awareness to other neighbors. It appears morally wrong. Besides that I paid all the charges that were given but Im opposed to this one due to not ever having a pet or a reason for black stains which were not there when I left.

Patio Inspection- 2 dog trays for kennel and trash. Left a voicemail for resident to remove items ******************************* Jan 03, 2024 04:06 PM MSTGood afternoon. The file attached shows a unit inspection that showed ****************** had bunnies. We also sent out communication to her on 01/23/2024 to remove dog trays. We believe there may have been pets at some time during ********************** tenancy. The carpet however has run it's life span and therefore we will not pursue any charges for carpet replacement. At minimum we require a carpet shampoo at move out, We will revise he final move out statement to show an $85.00 cleaning fee if ***************** believes this to be equitable. We believe this is fair solution for both parties.

Deser Tree Apartments on **************** are in violation of the warranty of habitability. I put in a work order Aug 7th and on Aug 14th they did not come fix what I asked, they had 7 days which means they breached the warranty. The water heater has a leak, leaking hot fluid onto the actual boiler. This is very dangerous and can lead to big problem. There is water leakage through the ceiling in the room causing mold to grow and a dent in the ceiling. Then there is mold underneath the bathroom sink and the sink gets clogged when you run the water from the faucet. There is also mold all over the bathroom tub, tile, and ceiling. I pretty much received the apartment in this condition with a dirty carpet and the conditions have gotten worse since. I just want to pay my rent without being chastised when they know the apartment is not worth the habitability, health, and legal concerns it brings.Business response

Desert Tree added work orders on 08/07 to our system as requested by ****************. He specifically asked the staff not to address his work orders until 08/14. Our contract makes no provision for a specific time or appointment but we were prepared to address the work order on the business day of the 14th as agreed by both parties. We sent in our flooring contractors to clean his carpet in the morning. Once the carpet was dry enough we attempted to return to begin the work. The file submitted shows the time our staff attempted to service his apartment home but we were met with a locked door from the inside. The numbers coincide with the work orders. The property manager, ********************************* and myself the Regional supervisor spoke to him as seen on the activity log. He refused to allow us to enter. We want to do the work but it is not possible if he won't allow access. We have submitted a copy of the contract showing him our right to enter at his request for service. We understand our obligation to maintain the property and wish to make ******************* stay a good experience. He renewed his contract and we believed everything was fine in the apartment. We wanted to thank him for choosing to stay and renew and were in planning upgrades in his apartment. We did not know about a water heater issue. He had not put in a request but di send pictures on the 14th citing an urgent matter.
Several visits and calls were made to *************** who did not make himself available to us for the repairs.

I am rejecting this response because:
They are lying about a work order not being made for repairs on the mold and water boiler. They have a specific time frame by law to complete their work order due to health violations.Business response

The property has resolved all outstanding work orders in ******************** apartment. He and the property manager agreed on a date and time. The commitment was met. **************** was satisfied the work performed. All work orders were closed as a result of him being satisfied. Thank you for the opportunity to resolve the matter.
