    I took out a loan in 2018 with ******* and paid it off in 2020. In 2020 during the pandemic *** bought Patriot out anf my acct had wrong amount due balance. At that time I tried to discuss this with *** several times and I would get yelled at was told the debt is mine and need to pay up. I them I couldn't afford it because of losing $30,000 in wages during the pandemic and asked for a hardship help (they don't offer a program). I have wanted this settled from the beginning it has been 5 years ago and they report on my credit 90 days past due constantly which is wrongdoing. I have all the countless calls, vms, emails of harassment logged. I have been sent bills with other people names with my acct # and my address and wrong amount. Everytime I have received a bill or demand letter all of them are different amounts $1000, 1666, 8000, 6000, 4000, 3400. The letters stated charging 26% but actually charging 50% not including late fees etc.Something is wrong here, I already paid off my orginal loan, I shouldn't have to owe this company at all. Since they keep reporting 90 days past due they are keeping my credit drug down and keeping me from purchasing anything my family needs including housing.. I will pay under $300 to settle and get them off my credit report. Please help in this impossible situation.

    I called *** to try to negotiate with them as I couldn't afford my payment. I lost a job and my new job's income was lower. They absolutely refused to work with me. Refused to let me make lower payments or even offer me a deferment until I got some things on track. I had to stop paying them and I knew they would harass me. But when I didn't answer them they decided to physically come to my house. They have begun to tape letters to my door and they don't knock. They sneak up onto my porch and quietly tape letters to my door. They are sneaky enough that even my two big dogs didn't bark. I feel like I got a loan from the mob or some sort of loan shark. I can't pay my bill right now. Report it to my credit but stay away from my house!

    My *********** took out a loan in Feb. 2023 for a new roof. While this company was kind enough to finance this for us. There have been issues from the beginning. Payments are not being processed properly nor was it set up properly. My husband asked on several occasions why additional principal we paid was not being applied. He was told the loan was not set up to allow for that. It would deduct additional amounts from the next payment due instead.I was in banking for 30 years, a loan officer for 10, worked with every loan imaginable. So I called them myself and immediately told that he had been misinformed. Suddenly they changed this to allow extra principal payments. But after 11 months of pymts in 2023 only $2,000 was applied as principal. As of this year alone we have paid $4,444.00 in interest. Accrued interest right now shows $71.62. Similar to past statements. Yet the last payment shows $465.94 applied to Interest, $26.06 towards principal. In all my 30 years in banking I have never seen this. Yet I do know of another bank renowned for doing this same thing & not applying payments on the date received. Several people filed complaints, nothing was done, until they hit on an attorney's loan and that **** is no longer in business. Due to health issues which caused me to become disabled. I was not aware of this until earlier this year. This company seriously needs to be investigated. I know interest accrues daily, But even at $11.94 per day? And a statement showing accrued interest at $71.62, how can they justify applying $465.94 to interest and $26.06 to principal of a $492.00 payment? We kept our agreement, have never been late or missed a payment. But this has got to stop, be recalculated properly & reapplied correctly. I spent two years doing exactly that due to a merger that went horribly wrong & for 5 branches all by myself. So I know for a fact this can and should be fixed. But not until someone like you or an attorney gets involved. Know of one?

    FCC Finance is a joke. My partner who passed away had a loan with them. She would make payments and THEY NEVER EVEN SHOWED ON HER CREDIT REPORT. she had to call every month to correct something with the payments. They would text her which is super shady. They were advised of my partners death and began to call my phone multiple times a day in an attempt to ignore her DC and have me pay until I threatened them. They still will not acknowledge her passing and send mail to the house and are really just unprofessional and you should avoid these people at ALL COSTS

    I am rejecting this response because:   ******** passed tragically and suddenly on March 10, 2024. *** was notified ****. *** was sent the Death certificate for ******** ****** per FCC Finance, LLC request over the phone by *. ****** on March 26, 2024. An email with the Death Certificate was sent again on May 9, 2024, May 16, 2024, June 6, 2024, and July 19, 2024 of which all communications were ignored by FCC Finance. Why has ALL confirmation been ignored since the phone call March 26, 2024 but you guys kept calling me for payment and send mail to mine and ********** residence. Why has no one confirmed on your end in 4 months plus? Emails have been sent multiple times to ********************************** <**********************************> and ****************************** <******************************>. There is no estate.

    We came to an agreement based on me paying this amount for an outstanding loan and for the old payment history to be distinguished. I made good on my end and then when it came down to them upholding their end (all which was on recorded lines) they refused to updated my credit bureaus for almost two months (in which I had to call several times, the supervisor was NEVER available) and in the end was told that I had needed to do a modified loan agreement not a settlement to get old.past late payments removed. Causing me to have to wait two addtl yrs to even qualify for a mortgage now. They lied to get my money and then tried to say I was asking them to do something illegal, when they themselves told me on the recorded lines this was able to happen, agreed to it, took my.money, i did my part of the agreement and they refused to uphold their end. Very bad business.

    This firm is general counsel to FCC Finance, LLC ("'FCC") and on FCC's behalf offers the following response to the above referenced complaint filed by ***************************** (the 'Customer'' or "******************''). As will be explained in more particular detail below, FCC allowed the *** Financing Statement to lapse, so the *** lien is no longer valid against ********************** property.

    Some background by way of the relevant timeline will be helpful in supplying this response. On November 22, 2017, ****************** entered into a Security Agreement and Home Improvement Contract (the "Contract") with ***************************************** **** for the installation of an in ground pool at her residence located at **********************************************************************************. The amount financed was $35,000.00 at a yearly interest rate of *****% with monthly payments of $459.41 with the exception of the first payment in the amount of $457.21. *********************** Pools **** assigned the Contract to AmeriFirst Home Improvement Finance Company, LLC ("AmeriFirsf'). See attached Exhibit 1. Amerifirst then subsequently assigned the account to WF HIL,which was then transferred to FCC began servicing the account on behalf of WF HIL.

    On January 23, 20 I 9, AmeriFirst Home Improvement Finance *** filed in the Superior Court of **********, County of Los Angeles a Summons and Complaint for damages in the amount of $34,428.25, plus
    interest for damages incurred for not making the monthly payments. On February 16, 202 l, the Court entered an Order and Judgment against ****************** in the amount of $44,327.05. See attached Exhibit 2. On May
    13, 2021. Amerifirst's counsel filed with the Court an Abstract of Judgment. As expected, Amerifirst sent to the customer correspondence advising of the transfer of the servicing to FCC Finance LLC beginning on
    August 1, 2022. FCC sent correspondence to Ms. ****** on more than one occasion offering to settle the account for less than the balanced owed in the amount of $25,016.94. On or about November 8, 2022, FCC
    reached an agreement to settle the account for $22,000. On November 30, 2022, FCC received a wire payment in the amount of $22,000 that settled the account for less than the full balance owed on the account. On
    January 11, 2023, FCC sent to ****************** correspondence acknowledging receipt of final payment and advised the account was closed. See attached Exhibit 3.

    Upon review of the ********** Secretary of State, the *** lien was not renewed. As such, on March 22, 2023, the ********** Secretary of State system reflects the *** has lapsed. Due to the servicing transfer
    and prior correspondence with attorney FCC was under the impression a release was filed with the court. FCC is in the process of working to have a Satisfaction filed with the cou1i regarding the judgment lien. As a
    result, I trust that Ms. ********* complaint will be dismissed as requiring no further action or involvement from your office. To that end, the undersigned would appreciate confirmation of receipt as well as case
    closure.

    This company has claimed that I took out a loan from them. The account is greater than 8 years old, supposedly opened in 2015, and they are continually reporting to my credit report as missing payments. At the supposed time the loan was taken out, I was on active duty stationed in ******* (from 2012 to 2017). My discharge date (and date I left *******) was February 1st, 2017. From *******, I was deployed to *********** in early 2015. They are fraudulently reporting to my credit report as an "unsecured loan", and have been doing so for 8 years now. I have reached out to them and haven't gotten any meaningful replies, other than letters stating loan amounts and payment options. Nothing stating what the loan was for, and zero effort in trying to help me figure out how this account was opened while I was out of ***************** for 5 years. Also, what "loan" office leaves an account open for that period of time without sending it to collections? They only started reporting "missed payments" in 2020, yet the account was supposedly open in 2015? I don't understand how people don't see that as suspicious behavior on their behalf. Also, I didn't start getting letters in the mail until I started disputing the account on my ********************** report.Further, I looked up what types of loans they offer, and they are all home improvement loans. I was deployed in *********** from ******* living in tents. Once again, absolutely zero need to have such a loan taken out. I did not open this account, and I have told them this repeatedly. There has been NO help in trying to find a resolution to the issue, and they just send me loan documents every month. This does not belong on my credit report. I do not deserve to be targeted by this company. I need help resolving this from someone higher than them, because they just shrug their shoulders and claim it's not their issue. I wish for this company to close the account, remove it from my credit report, then to never contact me again.

    Hi, me again. It's now 9 years and 4 days since this "loan" was taken out while I was deployed overseas. This is also the second complaint I've made to the BBB about this company, of which you can read above. The statute of limitations on debt in ***** (which is where this company is based) is 4 years. No action has been taken to recover this "debt" outside of sending me random letters every couple of months or so. It's absolutely appalling how they have been able to hijack my credit for 9 straight years with no resolution in sight. At 7 years, if it was reported properly as a collections debt, this would have dropped off by now. But it wasn't, and it hasn't. They've stuck on my report as a "loan", and stopped reporting any activity years and years ago. This is wrong, immoral, and a horrible business practice. The statute of limitations has long passed (no matter which state you're in). You have not made any attempts to recover this debt through collections within the time the statute outlines. Drop this debt from my report, and stop harassing me. I will return every month from here on out and make a complaint to the BBB until it is resolved.

    I accept the resolution proposed, but I want to clarify a few things;

    The document you sent to me in 2019 was sent to an overseas address, as noted in the address line. I had been in the states for over 2 years at that point, as I peft the mulitary Jan 2017. I received no such documents of a handoff due to this.

    Secondly, I understand that you bought this debt from another company. I get that. But what you weren't aware of was the fact that the original company the loan was fraudulently opened with refused to work with me when I gave them everything they needed to prove that not only was ********** during the time it was opened, but we knew who it was that did it. That particular individual had left the military while I was deployed, and was long gone and out of reach back in the ***. The original company refused to drop the debt, even after proof, and ceased to contact me after months of trying to work with them. My command and JAG even got involved.

    That is the type of company you acquired this debt from. One that refused to work with someone who was the victim of identity theft, and passed on the debt to someone else to deal with because that was the easy thing to do. And here we are, 10 years later, with your write-off being added to my credit for another 7 years. I will have been dealing with this for almost 20 years when it is all said and done. 

    I accept your resolution, as it is a means to an end. But if you want to point the finger, go after the original company for your answers.
