Signed contract on September 28, 2023 with owner ************************* and gave him half the deposit amount he cashed the check the next day. He assured us that work would begin the following week on Monday, unfortunately due to rain for a couple of weeks there was a delay. The weather got better after that and yet no communication from the owner, the only time we received an update on the job was when we texted or called the owner. ****** later after contacting him a numerous amount of times via text or phone calls myself and my husband decided to request a refund and cancel the job altogether, the owner said that he would be issuing a complete refund and we have now entered a new year and nothing has been given to us. My husband called him a couple of days ago and is now avoiding our calls. I dont understand how this man is still in business after doing so many people wrong. Customer requested to cancel agreement after delays due to the rainy season and all materials had already been located to match their wood siding, so than siding had to be returned for reimbursement to refund back to customer; past week contact was made by phone text with customer and advised customer that refund will be issued within a weeks' time. I am rejecting this response because:Contractor was contacted via text on Monday, January 29, **** and his response was that he would have the refund within the next couple of days. I then contacted him again two days later which was Wednesday, January 31, ***************************************************************************************** As of today February 6, 2023 we have not received any refund from Contractor ****** with All Star.

Placed order to replace sliding doors and windows in March of 2022- total amount of job was $41,400. Gave All Star Siding and Windows $20,700 check which was cashed on 3/28/2022. Fast forward months of communication w owner including backorder excuses and mix *** that resulted in order never being placed, refund was requested on 2/13/2023. Asked owner to provide name of manufacturer order was supposedly placed with and has not provided info. It has been over 2 months since refund was requested and owner still states, waiting on check. Need to be reimbursed $20,700 IMMEDIATELY. This is our first course of action, if not resolved IMMEDIATELY will seek legal action.Business Response

Order was placed for customer. and yes, there was a mix up by manufacture which continued delaying order in getting completed. Customer decides to pull out of contract requesting their monies back, which manufactures do not honor refunds on Custom Orders" Somebody gets stuck with the product; We have been resolving the matter with the manufacture due to their mix-up error; Full Refund will be returned to customer upon resolution. I am rejecting this response because:We backed out almost 1 solid year after order was placed and no communication other than a few more weeks, thank you for your patience. Wed like to make this very clear that we did not back out because we changed our mind. We have yet to see any proof order was ever placed or refund is in process. Have asked several times for name of company with whom order was placed with no response. We do not believe there was ever an order for someone to be stuck with . Refund was requested in Feb- we are going into May. Owner has never been able to produce order receipt or provide a name, company or person for ** to confirm with.

This is my second BBB complaint and last effort to collect remaining funds from the $20,700 that was paid to All Star Siding and Windows. In June of 2023 owner stated the remaining $10,700 from an on order that was never placed in 2022 would be refunded to us in a few days- we are now in December and NOTHING! THIS IS FLAT OUT THEFT and will be seeking criminal charges and moving forward with lawsuit if we are not reimbursed IMMEDIATELY! From other complaints on BBB THIS IS A PATTERN for the owner! On 10/17/22 I entered into a contract with All Star Siding and Windows **** to replace the T1-11 siding and vinyl siding on my home. The contract has a 11-7-22 start date and a completion date no later than 11-23-22. Since then I have had several conversations with the owner **************************************** regarding when can we expect the arrival of materials and when can construction begin. Each conversation always ended the same way with **************** having an excuse for not having the material delivered to my home, not starting construction and always pushing the date back until the following week. At this point I have asked **************** for a refund of my deposit. **************** is no longer returning my phone calls and it appears he does not intend on returning my deposit of $5,500 dollars. All star windows and siding replaced our home windows and has some finishing work that is not completed. We are also awaiting the windstorm Certificate. I was very patient to allow ****** the time to complete the work. However after almost a full year I am certain he does not care and hopes that I will not bother him.
