Golden Spread Roofing was hired by me and directed through the construction manager I hired for my project to build a new flat TPO roof for my residence. Subsequently the owner Mike communicated directly with me and the construction manager for the project (see email correspondence). Golden Spread billed for work in November and December 2021 in addition to a skylight install. As soon as July 2022 we began to find leaks throughout the house. Golden Spread remediate termination bar leaks around September 2022 but we found more leaks in the ceiling. Aside from the remediation work, Golden Spread did not complete any materially significant work following these major invoice draws attached in Nov/Dec 2021 and the skylight work. The construction manager on the project was let go in October 2022. Golden Spread was never contacted by me to cease work, nor did they ever communicate about remaining work to complete. I contacted Golden Spread multiple times in June 2023 regarding the additional leaks. Golden Spread did not send anyone to the job site to review. On June 16 I contacted the owner Mike ***** via Roofing Contractors Association of Texas web site and he responded: "******, The work Golden Spread Roofing has done at this address was for ****** Management. Yes it is an incomplete roof on account ****** is no longer the contractor therefore GSR is no longer the roofing contractor. Regards, Mike" 1) Golden Spread has not provided an inventory of remaining work. 2) Golden Spread worked on this address for me and was paid directly by me. 3) Golden Spread was never removed from this project and has provided no written evidence that they were asked not to work on the project. As far as I am concerned - Golden Spread walked from the job, left the project defective and incomplete, and now refuses to warranty or correct their defective work. I am seeking Golden Spread to compensate for cost to remediate the defects.Business response

****** states that we communicated directly and that wasn't the case. The construction manager was who initiated all conversation to GSR about the project. Also the ****** changed almost everything on the project from the the time we estimated to the time construction condensed. Also the price of material and availability was an issue as well. The roofing portion GSR was commissioned to do was left unfinished on account the construction manager was let go therefore I assumed GSR was as well. That was in Oct. of 2022 and GSR did not here anything from ****** until June of 2023. The roof being unfinished on account the plumbing contractor and hvac contractors had not completed necessary penetrations, as well as the veneer contractor had not started (still unfinished to this day, 2200 s. ong) leaving areas susceptible to leaking. We did address second story wall leaks and were resolved. I am also aware of other roofing companies that have worked on the project. GSR installed a skylight as a change order item in which it took four months to get paid leaving GSR leery of future any future involvement. I am unclear on what ****** is stating or asking of us. I do not accept the response made by the business. Contractor's response does not address defects in workmanship: Contractor installed TPO with leaky corners/seams and flat areas that pool water. This is 100% unrelated to the building veneer. The structure has an independent water-resistive barrier (WRB). See attached PDF for photos of the defective areas.
These Contractor claims are correct:
- Circumstances changed from the time discussions started through when we agreed to start the project. This is a normal part of projects.
- Construction manager initiated some but not all discussions on my behalf - see prior attachments for examples.
- Price of material and availability was an issue in 2021.These Contractor claims are incorrect:
- Contractor states: “GSR did not here anything from ****** until June of 2023”. I contacted GSR on May 16, 2023 10:26 AM (phone and text, 1 minute 22 seconds). They were again contacted June 8 8:59 AM (2 minutes 41 seconds), June 13 10:12 AM (1 minute 41 seconds) , and later at 12:12 PM (6 minutes 9 seconds). Contractor was previously notified about leaks through the construction manager on July 2 2022, August 29, 2022, September 2, 2022.
- Contractor invoiced #**** for $10,945.00 on 11/04/2021, Invoice was received on 11/09/2021, check written on 11/19/2021, and cashed on 01/04/2022. Contractor invoiced #**** for $22,619.50 on 12/06/2021, Invoice was received on 12/08/2021, check written on 12/20/2021, and also cashed on 01/04/2022. I always pay invoices expediently. I paid $33,564.50 of $34,394.50 within 2 weeks of payment from GSR. From the time I wrote the first check, it took Contractor 6 weeks to cash it - maybe because they were on vacation over the holiday. Contractor’s claim about remaining $830 is disingenuous.I am left only to conclude that the contractor has no interest to operate in good faith to resolve the defects.
