The University of Tennessee Federal Credit Union gave my son incorrect information about the procedure to wait and make sure an electronic check cleared. They told him to wait two days and if the money was in his account, this meant the check had cleared. My son, who is on the autistic spectrum, followed the directions to the letter. He waited as he was told and then spent the money. The bank came back five days later and told him the check had bounced and he now owed almost $3000 to the bank. I have spoken to everyone at the bank on my son's behalf. The clerk has admitted that she told him he only needed to wait two days. Yet no one will address that it is the clerk's error that caused this mess. My son, being autistic, knows he needs information in person. That is why he went in the bank specifically that day to get the proper information after being confused by the literature. He is a rule follower to the letter and in no way would be in this mess if the clerk had not erroneously instructed him. I have taken this all the way up to the Board of Directors and everyone skirts around the issue that their employee gave my son incomplete information. In fact, the Manager of the branch herself did not even know the procedure when I called her to find out what happened. She could not explain to me how a check clears, and therefore, it makes sense that her clerk did not know either. My son would undoubtedly have done whatever he was supposed to if he had had the correct information. That is why he went to the bank that day, so it makes no sense to believe he went there, got the correct information, and then chose not to act on it. This is illogical and is basically calling my son a liar. It is completely unethical to charge my son for the inadequate training of the staff of the bank. I am asking them to drop the amount that they claim my son "owes." He did nothing wrong. All he did was trust the clerk he spoke with. He has given me his consent to take this up for him.
