I have a renter property located on*** ******* ** ** Clarksville TN. I hired ****** company to replace two HVACs in apartments3 and4 on September 27,2019 with two years warranty. The HVAC in unit 4 was leaking and caused severe damages to the first floor because there was no safety pan placed underneath the AC and also ****** never applied for a city permit for installation of the new ACs. So the city inspector never came to check if the HVACs were installed acco**ing to the city laws and the city laws requires that safety pans underneath the AC unit in the living area. ****** company refused to pay for the damages and also refuses to apply for the city permit so the building and codes can send an inspector to check on the HVAC. From my understanding ****** never applied for any permits for installation of the HVAC for other customers.

      Business response

      10/06/2021

Business Response /* (1000, 5, 2021/09/16) */ There was never a refusal to pull permit and we pull permits for jobs on a weekly basis. As of 09/15/2021 permits were pulled and inspections have passed ** both apartments. Consumer Response /* (3000, 7, 2021/09/16) */ (The consumer indicated he/she DID NOT accept the response from the business.) ****** has pulled the permits for the HVACs after I filled the complaints with the city building and codes and after the inspector from city building and codes has contacted them. According to the city laws: The HVACs that are located inside the living area are required installation of the safety pans for in case if the coils may sweat and the water may drip down to the floor. ****** didn't install the safety pan underneath the HVACs units at the time of installation which caused severe damages to the first floor in unit4. The damages required to replace to whole floor in unit4 . ****** put the tenants life in danger because the floor got rotted due to the leaking AC no safety pans to catch the leaking water. The tenant could simply fell into the crawling space and break the neck. In addition to the fact that the foundation of the whole building was put into jeopardy. ****** must pay for the replacement of the floor. I have contacted them numerous times but they keep referring me to their lawyer. The HVACs were installed illegally without the safety pans and without the city permits at the time to the installation. The damages are already have been done and ****** is responsible for the cost of damages. Pulling the city permits does not make a big difference at this time since ****** keep ignoring the fact that originally there's no safety pans installed underneath the HVACs . The pans are required by the city law. If ****** had installed the safety pans , the damages would never happened because the safety pans could catch the dripping water from the coils. ****** must pay for the damages and putting my tenants life in danger and also jeopardizing the foundation of the whole building. ****** keep ignoring the fact of the damages from the dripping water. They must pay for the damages. Business Response /* (4000, 13, 2021/10/05) */ Unit was installed back the same way the existing unit was installed. The floor on the home was already in process of repair at time of original install. We stand behind that the HVAC unit did not cause the floor damage that has been stated by owner.
