      August 06, 2020 Foley Roofing gave me an estimate to replace my roof for 17, 850. August 25, 2020 I agreed to the proposal and submitted ****. deposit as instructed to begin the job.October 05, 2020 I was billed 10, 730dollars for the completion of the roof job. I was charged an extra 380. to address "Chimney siding replacement" and an extra ****. to cover an increase in material costs. Bringing my total for the new roof to 19, 730. which I paid for in full.December 25, 2021 we noticed a wet stain spot on the ceiling above our pellet stove. We surmised that we had a leak somewhere that involved our new roof.Jan. 03, 2022 we emailed pics. to Foley roofing to show the leak. "*****" from Foley roofing came out and caulked around the chimney box April 04, 2022 Del came out and looked at the wet spot on the ceiling.April 11th, 2022 the wet spot grew and began to peal. Again we called Foley roofing to complain that the caulk job was ineffective.April 13th? **** came out and looked at the roof again.April 28, 2022 "****" from Umpqua sheet metal came out to look at the roof cap.May 06, 2022 *** and ***** of ****** Home and Hearth came out to look at the leak. No one can seem to agree on the cause of the leak.July 06th, 2022 Del states that the cause of the leak is not his problem, and he believes the wet spot was in fact a stain that bled through as a result of a poor interior paint job. *** wanted, *****************, a ******* to come out to look at the stain and provide a quote to paint over the spot. We insisted that this would merely hide the leak damage, and further the painter should be involved only after the leak is repaired. I sent Foley roofing pics of the ceiling before the house was painted to show no stain existed. To date Foley roofing has yet to identify and or correct the problem. We want the leak taken care of with possibly a new chimney box that is properly flashed and sealed. Then some interior paint and patch work to repair the ceiling.

      In response to ******* and *************************** complaint:

      After receiving pictures of the stain and drywall flaking from ***** & **** on Jan 3, 2022, we sent our ******* out to inspect the roof for a leak around the stove pipe.  We had replaced the roof along with reflashing and residing around the chimney chase a few years ago.  The work on the chimney chase was an additional amount, which the client did pay in full. 
      We sent our ******* out on a rainy day, who went in the attic and did not find any dampness or dripping.  When on the roof, he pulled shingles up from around the chimney chase and could not find any trace of water getting through.  At this point, he went above the chimney chase that we did re-side and re-flash back in 2020, and he did **** around the storm collar of the stove pipe on the chimney chase cap metal.  This area we had nothing to do with when we originally roofed the house and resided the chimney, and this is not an area that would be in a standard roof tear off and replacement proposal.  Any sheet metal work would be bid out to a sheet metal company.  

      In April, *** came out to inspect the roof again because ***** had let us know the staining had grown and dry wall was chipping away.  This was another rainy day, and the sheet rock was dry, no dripping in the attic.  Del did call **** from ****************** to see if the chimney chase cap metal needed replaced.  **** came out to check and assessed that it was fine, no water was entering through the chimney chase.  After that, Del sent ****** Home & Hearth to see if water has come through the stove venting. They concluded there wasnt any moisture inside.  At this point we firmly believe our roof is not leaking, or the chimney box that we had re-sided and installed. And along with these 2 other professionals checking the chimney and chimney caps no one has seen where a leak is coming from while it has been raining and snowing when we are out there.  The homeowners have also been there to observe there is no moisture.  During this winter/spring of 2021 and 2022 we have had excessive rain and snow so we wouldnt be surprised if roof failure would show itself, but it is clearly not during this wet weather.

      We have asked a drywall contractor to go assess the damage and repair and he advised that our customers told him they do not want the drywall repaired until the leak is fixed.   That we understand, however we do not see an area our roof or chimney siding and flashing is letting water in.  As of right now, we see no leak to fix.  With the heavy snowfall and rain, we can speculate two effects it may have had on this damage:
      There could have been enough weight due to wet snow to compromise the sheet metal cap over the chimney chase.
      The snow couldve piled high enough on the roof (approximately 6-8 inches) to then get over the top of the storm collar and run down the outside of the stove pipe, which then wouldve let it land on the sheet rock.
      These are the only possibilities I can consider since we did have even more snow after this point, and horrible rain in the following months.   And yet,nobody weve sent has seen any moisture in the attic or sheet rock.
      This has been explained to the customers numerous times.  Unfortunately,we believe this issue has nothing to do with the roof or chimney box siding or flashing,and Foley Roofing has gone above and beyond to correct the issue even reaching out to trades having nothing to do with our work on the roof. We are more than happy to help resolve any discrepancy with our work, providing there is one to address.

      I am rejecting this response because:  Less than 2 years ago (not "a few years") we paid for a complete tear off and roof replacement.  Any issues observed should have been dealt with then.  **** doesn't get any points for having numerous people come out to show him where his leaky roof failed.  **** never stress tested the area when he came out.  I have had 3 roofers come out to inspect Foley's work.  All agree that there is an issue with the flashings around the chimney.  2 said it was incorrect 1 reasoned it might be okay but he wouldn't have done it that way.  I have submitted 3 photos.  Dec. 23, 2021 was following the first snow and April 26, 2022 is after the year's second snow fall.  Note the increase in severity.  The photo from August 17, 2020 is what the ceiling looked like before the interior paint job and just before Foley's roofing put on the new roof.  Note there isn't any damage to the ceiling in the stove pipe area.  I have had several estimates of how to proceed ranging from gluing down the shingles Foley's Inspector's pried up, and re-sealing the s**** holes.  to removing the exiting structures to visual what lies beneath, then replace any affected OSB boards, shingles and screws then reseal it all. All I know is we have spent over 19, 000. for a roof that *** leak worse than when we started.  Del Foley's only solution is to deny any responsibility but to agree to cover up the interior damage.  Not acceptable.  The other roofers spoke of a minimum of a 2 year warranty offered by most roofers.  It is my belief Del Foley is stalling to get beyond that window.
