On May 17, 2023, as part of an industry-wide review of CBD businesses in our service area, Better Business Bureau contacted Medhemporium concerning the following advertising claims found on their website, https://medhemporium.com/contact-us/:
- Unsubstantiated Health claims were found in the blog page: https://medhemporium.com/uncategorized/cbd-cbg-and-terpenes-potential-medical-benefits/.
Product descriptions include unsubstantiated health claims. Included but not limited to:
- "It’s the ideal recipe for those suffering from insomnia and persistent bouts of sleeplessness."
- "Anti-anxiety and antidepressant, anti-inflammatory, antibiotic, sedative and antimutagenic."
- "Anti-anxiety, anti-depressant, anti-inflammatory, Analgesic and Alcohol craving reduction, Anti-Cancer."
- "Anti-anxiety and antidepressant"
- "Elevated mood, Stress relief, Antifungal properties, Antibacterial, May help relieve heartburn and gastric reflux."
- "anti-bacterial, anti-cancer, anti-fungal, anti-inflammatory"
- "anti-bacterial, anti-cancer, anti-fungal, anti-inflammatory, antifungal, antimicrobial anti-parasitic and inhibits growth of leishmaniasis."
BBB requested that the business review its advertising and provide substantiation based on reliable, recent, competent testing for each of the health claims made and to discontinue any advertising that is in violation of FDA and FTC mandates for this industry.
Despite written requests, as of May 31, 2023, Medhemporium has not responded to BBB’s request for revisions and clarification in its advertising.
Advertisements should be truthful, sincere offers to sell. Advertisers have a responsibility to have substantiation for all claims made and should be able to provide that substantiation upon request. All advertising that may mislead or deceive consumers should be avoided.
Claims relating to performance and results should be backed up by reliable evidence.
Advertisers should ensure that testimonials and endorsement are not misleading and represent the current opinion of the endorser. A consumer endorser’s experience should reflect what users generally achieve unless there is a clear and conspicuous disclosure of what the expected results will be. Advertisers should not include claims in testimonials that they themselves cannot make and support.
