I had a gym membership at this business and I could no longer attend due to Inflation, rising costs of living, and having to work long hours to pay for my necessary expenses such as rent and living expenses. I could not afford to go to the gym anymore and contacted the gym to cancel my membership and they refused. Even though I had not physically stepped foot in the gym for several months they still kept billing me and trying to charge me even though I am not physically there. After awhile of me not going they closed my account out and then sent it to collections for over $1300 even though I was never in the gym or used any of their services during that time. I want to contact the news and contact the attorney generals office to have their business license revoked for predatory practices. I want all of their businesses shut down.Business response

*******************************, on 8/12/2022, signed a 2 year contract with Shape Fitness El ******** stated on his membership, the only terms that would allow you to cancel is if you move 25 miles away from any Shape Fitness location, are permanently disabled or going active in the military. In this case, he was none of those. In November 2022, ******** contacted us to let us know he had lost his job. We allowed him to freeze his membership, meaning we would not draft his account, for 2 months (that is the amount of time he requested). Dec 2022 and *** 2023 we did not draft his account. Feb 2023, drafts resumed and we were able to pull from his account for that month. In March, he returned for Insufficient funds. April we were able to draft his monthly fee. May, he returned for Unauthorized debit. At that point, we had no choice but to send to collections due to the fact that he put a Stop Payment on his monthly drafts. Please find attached the signed membership for ******************************** I have also attached the backside to the membership showing our cancellation policy.
