      On Oct 21, 2022 Pad Work was performed by ************************** Welding and Backhoe Service, LLC, ***********************************************. ************** Owner: ****************************Details of Work Request: Requested a 20 X 80 Pad be developed on North side of property at ***************************************** for a single wide **** X 76 Mobile Home. **************** noted by laser measurement that the West end of the property was higher than the East end. **************** then phoned and conferred with ******************, whom I did not meet until much later in the day.Conclusion: ten truck loads of dirt were needed for this pad site. Skid steer machine utilized, as well as a Red Beam Laser Level with measuring rod to determine levelness which **************** utilized continuously the levelness of the pad by measuring between the ten loads of dirt hauled in for the pad work. On October 31, 2022, contract work on the mobile home to level it was performed. Photos taken clearly show that the shimming material utilized were higher on the West side compared to the East Side. Photos taken, moreover, confirm the difference. Results: The pad was not level, about 36 inches higher on the West end. This was not the linear dimensions I asked for and the height of the mobile home was over 42 inches from ground level. November 14, 2022. Called *********************, **************, Skid Steer Operator at Gregs Welding and Backhoe, about making the North Pad wider. He came over on November 15 and we briefly discussed the situation. Seemingly, **************** was unable to answer my questions on the problems I pointed out to him. December 1, 2022, Contractor hired to skid steer the pad in Dirt ******************* LLC, **************************************************. **************.

      Please see following statements from *********************** and *********************** in reference to complaint. On October 21,2022 1, ***********************, performed backhoe work at ****************** property. Before I began to build a pad for a trailer house, I shot the area with a laser in multiple spots of the land where ************** indicated he wanted the trailer house to sit. He said he only wanted a pad big enough to sit the trailer house on and that was it. I conferred with *********************** about the number of loads of fill dirt that would be needed for the trailer house pad. It was calculated and determined that it would need approximately ten dump truck loads of fill dirt. We used eleven but only charged the client for ten. While I was building the house pad, ************** and his wife were outside with me the whole time telling me how good it looked and that was what they wanted. Once the dirt was hauled in and pad was completed, I asked the Galers' if the pad was what they wanted and they both said yes. I explained the pad was just big enough for the house trailer to sit on and they would need to bring more dirt in later for the slopes and additional flattening around pad due to so much fall of the grade in land where they chose to sit the trailer house. They both said okay, and stated they were just trying to get the trailer house in there for now as they were on a short time schedule with the people who were moving the trailer house into the property and they wanted to get it in for their son. We were never contacted about any issue of the pad when they trailer house was set up on the site. He had my cell phone, the office phone, *************************** cell phone and email address of the business and no one was contacted until months later; from October 22, 2022, until March of 2023 when he reached out by email. He then stated in email that the house was out of level, and he demanded his money back. *********************** called him within five minutes of receiving the email. Thank You, ************************ ************ l, ***********************, *********************** and ***************************** went to jobsite of *********************** on October 21, 2022. ******* and I hauled eleven loads of fill dirt onto property as *********************** used a backhoe for site preparation of ****************** mobile house that was to be delivered. ***** took elevation readings with a laser used for dirt work and asked me to calculate the fill dirt yardage so an estimate could be given to client. I calculated ten loads in a ten-wheel dump truck, which was delivered. We supplied one additional load at no charge. ***** performed backhoe work leveling and compacting dirt with the dirt that Nicklas and I hauled in. Once job was finished, ***** and I talked with both ******', they both stated they were very pleased with the work and what a good job ***** had done in the pad preparation. ***** told them that additional work would need to be done if they wanted the area bigger around the trailer house with less of an angle then it would need more dirt hauled in and sloping of site. The Galers' said it looked just like they wanted it until the mobile home was set up and then they would contact us later to haul some more fill dirt in and flatten the slopes. ************** contacted ***** after the trailer had been set up to haul in some more dirt to soften the slopes , ***** told him he would have to put him on the work schedule. ***** called him back to tell him we were scheduled to be back at his Gregs Welding& Backhoe Service **** PO Box **** Phone: ************ Fax: ************ - *********, 0K ***** ***********************, President ******************** ***************************, Treasurer *********************** property on that Tuesday, he said that he found someone to do it sooner and ***** said okay. That was the last communication with him until we received the email demanding a full refund. I called ************** and said we had received an email demanding a refund, he said yes, he sent the email. I asked him why he wanted a refund, and he told me that it was more than 2' out of level then he changed it and said it was 3' out of level and what did I plan on doing about it. Even an untrained person would be able to see with the naked eye if a pad was two to three foot out of level. I responded by saying that I would bring the laser out to the property immediately and we would take elevation readings to see what was going on and he stated that was not going to do any good and he wanted a complete refund. I said I will not give a refund until I came to the site and checked the levelness of the pad, and he said no, he did not want me to come out, he wanted his money back. I asked him why he hasn't contacted me or anyone else in the Company for fourfive months, I said you could have called, texted, emailed, came by the office and his response was that he has other things to do besides call or text and he just kept saying he wanted his money back but was unwilling to meet with me. I told him I can be at your property in ten to fifteen minutes on that day to investigate the situation and laser it. Our office is located approximately six miles from his property, and I was willing to meet him immediately. When I said this, he said never mind and hung up on me. I was in the office and there were four other people who heard the conversation between me and **************. I can get statements from them as well, if needed. I have driven down Highway 81 in front of his property and looking from the highway the mobile home skirting does not appear out of level. I would also like to state that the invoice was paid in full on 10/24/2022 by **************. The invoice has the office phone number, address and two email addresses other than the one he sent the email to, he had numerous numbers and ways of reaching out to us. If he was so unhappy about the job, why would he have paid it in full without making a complaint or concern to any of us? We have been in business since **** and have never had an issue such as this, nor has a complaint ever been filed against us before. It has always been our goal to provide the best customer ********************** possible and to resolve any concerns immediately.

      I am rejecting this response because:

      I never expected to see so many inconsistencies in two individual replies from a small town ********, ******** business like Gregs Welding and Backhoe Service.

       

      It is apparent that from these two narratives that owner, ***************************, has no intentions to guarantee his work. 

       

      Instead  the facts are distorted for whatever reasons.  The principles of business dictate that businesses grow by adhering to them thru-out the life of the business. 

       

      Obviously, my specifications for this job was not accomplished by ****************. The facts speak for themselves, i.e. individuals who witnessed the not so level pad and the photos taken.The November 14, 2022 meeting with **************** did nothing to change the situation at all.

      ************** has not been willing to allow us to come to the property to inspect site, nor have we ever seen the pictures he speaks of, he simply demands his money back and hangs up the phone.  He is not being realistic in thinking that he can simply demand money back without a complete inspection of the property.  That's like going to a store and saying the item he purchased was defective, but he left the item at home, but he wants his money back.  He is the one who is not willing to rectify the situation by not allowing us to come to the property to see if there is a legitimate issue with the pad. We have no idea if he or someone else altered the pad after we left the premises. If the trailer house pad itself were three foot out of level, as he states, then one end of his skirting would be approximately three foot and the other end would be six foot high.  The only job we were contracted to do was to build a trailer house pad and it was clear that the existing area around the trailer house pad would need additional dirt hauled into the site and final grading at an additional expense at a later date.  His only concern was to build a pad to set the trailer house on due to time constraints on the delivery of trailer house.

      I am rejecting this response because:

      Various obvious details about a mobile home that are indicative of incorrect padwork:  
      • My mobile homes height measurement from the ground to the bottom of either entry door is 42 inches, stepping up is not ok.  

       

      • An 18" clearance between the ground and the belly of the mobile home is the norm to facilitate any repairs that *** need to be done. Therefore, one that is higher than that height, (30 inches, for example like mine) is extreme. 

       

      • Steps are 7 inches, generally, industry wide as are my porch steps; My porch has six steps at 7 inches in height.  

       

      • These three indicators show the pad work was not performed correctly.
