UCFS repeatedly reported me late on payments when I am not late. I have tried to call them and can not get a live person. I have left messages on my account portal and they erase them and do not respond. They have charged late fees several times when the account history clearly says they received the payment on the due date. Recently they said I was late for May 2024. My checking account shows payment on the due date. They credited my account two days after the due date and reported me late to Experian. I disputed it with experian and experian claims UCFS verified the information. I tried disputing with the Federal Trade Commission and they refuse to take it. What options do I have to force UCFS to report my account properly and stop damaging my credit report? I would sue them in court if I could but I can't afford an attorney.

      Dear ******* ****:

United Consumer Financial Services (“UCFS”) received your complaint filed with the Better Business
Bureau. Thank you for the opportunity to respond to your concerns.

UCFS denies your allegations that it has manipulated your payment due date and that it failed to
      properly apply your payments.

UCFS reviewed the information that you provided and completed its investigation of your dispute. UCFS
determined the credit reporting on your account is accurate based on the payment history. UCFS spoke
with you throughout the account history regarding payment arrangements. You were notified of the
delinquency and subsequent negative credit reporting by telephone call and USPS mail service. During
one of the many conversations regarding the delinquency of your account, you acknowledged your
account would remain delinquent because you were short on funds.

In your complaint, you included three (3) attachments to support your payments were made on-time for
the months of April, May, and June of 2024. Please note that your account delinquency was for the
months beginning September 2023 through March 2024. On March 21, 2024, you brought your account
up to date thus making your next monthly installment due April 2, 2024.

This company has been taking money from my account without my knowledge since November of 2022. I have never engaged in business of any sort with them and did not give my authorization for them to take money from my bank account. Phone calls went nowhere as the hold times are extensive and my calls keep getting re-routed but never actually connect me to a person. It's clear from the litany of complaints levied against them that this is one of many such cases. I want, at bare minimum, a full refund of the amount that has been unlawfully taken from me, if not also additional funds for the entirely unnecessary stress and hassle this has created for me. I have never even heard this company's name prior to seeing the transactions on my account; I don't know how, therefore, I could possibly authorized them to take money directly from my bank account.

      Dear **** *****:
United Consumer Financial Services (“UCFS”) received your complaint through the Better Business
Bureau regarding the above named account.

According to our records, you signed a retail installment sales contract (the “Agreement”) for the
purchase of tax relief services on October 25, 2022. The Agreement was between you and the
independent merchant who sold you the tax relief. UCFS purchased the Agreement, thereby, indirectly

UCFS contacted the independent merchant, ******* *** ****** *** (“Ovation”), on your behalf

UCFS maintains that it followed all applicable procedures in the opening and servicing of your account in

Company name: ( Untied Consumer Financial Services ) I have paid to extend my payoff contract further out and it's been now a month and it still haven't been updated because I'm still paying interest when I should be. 2nd problem is two payments were paid on the same month and I been trying to get a refund on the extra payment and it's been almost a month now. I 1st had spoken to a man named Jose and and would not let me speak and kept talking over me. I had asked to speak to a supervisor 3 times and asked to speak to a manager once and he kept ignoring my request later on confirming he heard me when I confronted him why he was ignoring my right to speak to a upper management. He then hung up the phone on me after telling him I shouldn't have to ask multiple times to speak to his boss. Then I called back and spoke to a women named Judy who knew Jose ( her words ) after I tired talking about my horrible experience. I had asked for his employee ID number because it's my right to know who I was speaking to and she laughed at me over the phone and said " why are you going to report us?" I said what I do with it is my business ( personal records). She then continued laughing said bye and hung up the phone. I did not get nothing resolved. There's a refund that's owed to me and there also a contract that has not been updated after already paid for. This is very unprofessional and inappropriate customer treatment. And if this drags out mythe only person who will be affected by this is me while they are the ones who are acting this way. Also I tired calling back and they must had tempered with the phone line because when I called back after being hung up on the auto message said they were close many after many attempts of trying to reach back out to them. When I used a different number it went through just fine.

      Dear ******* ******:

United Consumer Financial Services (“UCFS”) received your complaint through the Better Business
Bureau. Thank you for the opportunity to respond to your concerns.

According to our records, you signed a retail installment sales contract (the “Agreement”) for the
purchase of two puppies on March 4, 2024. UCFS verified the terms of the Agreement with you on
March 4, 2024. The Agreement was between you and the independent merchant who sold you the
puppies. UCFS purchased the Agreement, thereby, indirectly financing this transaction.

Your Agreement contains the required Truth-in-Lending disclosures. These Disclosures clearly explain
the amount you agreed to pay for the purchase, the finance charges you will incur for the purchase (as
stated as an Annual Percentage Rate), and the total of your payments under the Agreement. The
number and amount of your payments is clearly explained in your Agreement.

Your Agreement contains a 90 Days Same as Cash (“SAC”). During verification, you confirmed that you
had a completed copy of your Agreement and read and understood your obligations to UCFS under the
Agreement. Our verification included confirming your 90 Days SAC option. You did not mention a
problem with the SAC option or with the terms of your Agreement. If you had, UCFS would not have
continued with the verification process and would not have financed the transaction.

On or about June 2, 2024, the independent merchant who sold you your puppies, contacted UCFS with a
request to extend your SAC payoff date. As a courtesy, UCFS agreed to extend your SAC payoff date
from 90 Days to 180 Days from the date of the Agreement. This did not change the original terms of
your Agreement or rewrite the terms of your Agreement. Because the original contract was not
rewritten with a 180 Day SAC option, you will need to contact UCFS prior the 180 Days SAC expiration
date to have your account manually closed for the amount financed payoff due at that time. Please
retain a copy of this letter to support this action. A note has also been placed on your account referring
to the courtesy extension of your SAC payoff date.

UCFS apologizes for the customer service experience you had with our company and we thank you for
bringing that to our attention. In reference to the payment refund issue, our records show that a payment
reversal was completed on July 9, 2024 to credit you for the card payment dated June 13, 2024.

RECEIVED VIA EMAIL BY BBB STAFF MEMBER:

      Hello,

The agreement was extended from 90 day's to 180. And I had paid Separately to have that extended. The reason for this was I had more time to pay off in full without interest rates being applied. But when I called over the phone I was told it would take time to update and it never did. The agreement started at 90 days but was updated to 180. I am still paying interest rates when I shouldn't be. Please give me a call Monday after 4 so we can discuss. I have a few witnesses that can conform that.

      Dear ******* ******:

United Consumer Financial Services (“UCFS”) received your follow-up complaint through the Better
Business Bureau regarding your account with UCFS ending in ****.

In your complaint you state that UCFS is charging you interest on an Agreement with a 180 day Same-as-
Cash (“SAC”) option. Please note that you signed a financing contract that computes interest on a

precomputed basis. Your account balance is expressed as a sum containing the principal and the
amount of the finance charges computed in advance. We collect finance charges with each of your
monthly payments as we earn finance charges each month during your contract. If you prepay your
account ahead of the end of the contract terms, we will send you a refund check for those unearned
finance charges paid by you; the unearned finance charges not paid by you are removed (or rebated)
from your account, and your account is closed with a zero balance.

As stated in our previous response, as a courtesy, UCFS agrees to close your account for the amount
financed of $5,500.00 if this amount is paid on or before August 31, 2024. If you choose to pay the
amount financed on or before August 31, 2024, UCFS will remove (or rebate) the finance charges from
your account and close your account with a zero balance as explained above. As of the date of this
letter, your SAC payoff is $4,406.90.

      Dear ******** ****:

United Consumer Financial Services (“UCFS”) received your complaint through the Better Business

UCFS previously addressed your complaint regarding the tax resolution services you purchased from Tax
Relief Advocates (“TRA”) several months ago. Please see the enclosed copy of the letter sent to you
which explains that UCFS contracts with independent third-party merchants to purchase consumer
contracts from merchants that sell products or services. TRA like other merchants that UCFS works with,

      services.

As previously stated, UCFS contacted TRA regarding your claim that you cancelled the Service
Agreement between you and TRA. According to TRA, you were not eligible to cancel your Service
Agreement with TRA and TRA had been in contact with you to discuss the matter. TRA also provided
UCFS with details of the work performed on your tax resolution case along with communications they
had with you regarding your tax case.

As indicated in the enclosed letter, UCFS offered to re-evaluate should additional information be
provided for further review. To date, no additional information has been provided to support TRA
cancelled their Service Agreement with you and/or had not provided the agreed upon services.

I am reporting on United Consumer Financial Services (UCFS) regarding their reporting practices on my credit report. Account Opened: October 2018 Purpose: Funding for a Kirby Cleaning System Account Paid Off: January 2020 I have been in good faith communication with UCFS, requesting that they cease reporting negative items on my credit report and ideally remove the account altogether. My efforts to resolve this issue with UCFS have been ongoing and have included multiple attempts to explain the circumstances and seek a fair resolution. Circumstances of Missed Payments: As a **** veteran, I was deployed shortly after acquiring the cleaning system. During my deployment, my credit card information was compromised, leading to unauthorized transactions and subsequent missed payments on my UCFS account. I promptly communicated these issues to UCFS, seeking their assistance in rectifying the missed payments due to the compromised credit card. Despite my efforts to communicate the situation and resolve the issue, UCFS was uncooperative in addressing the compromised credit card situation and did not provide assistance to correct the missed payments. Now that the account has been fully paid off and closed, the negative reporting continues to impact my credit score adversely, affecting my ability to purchase a new home. Given the account is closed and the balance has been paid in full since January 2020, I respectfully request UCFS to remove the account from my credit report. This negative reporting continues to harm my credit standing, and I believe it is unjust considering the circumstances surrounding the missed payments. As a veteran and responsible consumer, I believe that a fair resolution to this issue is warranted. I request that the Better Business Bureau assist in facilitating a resolution that involves the removal of this account from my credit report, helping to restore my credit standing and allowing me to proceed with my plans to purchase a new home.

      Dear ******* *****:

United Consumer Financial Services (“UCFS”) received your complaint through the Better Business
Bureau. Thank you for the opportunity to respond to your concerns.

UCFS reviewed the credit reporting performed on your account and determined the credit reporting as
accurate based on the payment history. You were notified of the delinquency and subsequent negative
credit reporting by telephone call and USPS mail service.

UCFS maintains that it followed all applicable procedures in the opening and servicing of your account in
accordance with applicable laws and regulations. As a courtesy, however, UCFS has notified the credit
reporting agencies to delete the above named account ending in 3638 from your credit report. Please be
aware that this modification may take 30 to 90 days to reflect on your credit report file. Please retain this
letter for your records as confirmation of this action.

Please review the attachment provided and it will be pretty self-explanatory as to what transpired into becoming a problem. In a nutshell, Timeshare Legal Assistant (a company which supposedly helps people break timeshare contracts) did not provide the services they promised, we advised them their services would not be used and would therefore not receive additional funds, they sold the "debtor's note" to United Financial Consumer Services, and now UFCS wants money for services not rendered and has caused a hardship on my credit scores due to late/no payment notices submitted. I want them to retract those notices and collect from Timeshare Legal Assistant if they want any money. Thank you very much for your assistance! ****** ******

      Dear ****** *******

United Consumer Financial Services (“UCFS”) received your complaint through the Better Business
Bureau. Thank you for the opportunity to respond to your concerns.

UCFS contracts with independent third-party merchants to purchase consumer contracts from merchants
that sell products or services. UCFS then holds the consumer’s retail installment contract and services the
debt used to purchase the product or service. Timeshare Legal is one independent merchant with which
UCFS has a contractual relationship. Timeshare Legal like other merchants that UCFS works with, is not
an agent, legal representative, or corporate affiliate of UCFS.

UCFS reached out to the independent merchant regarding your dissatisfaction with the service you
purchased from Timeshare Legal. Timeshare Legal advised UCFS that they had met their obligations under
the Service Agreement between them and you. According to Timeshare Legal, your timeshare relief case
is in the final phase of the process which is assigning your case to a law firm.

Based on the information provided and the conclusion of our investigation, UCFS considers your payments
due according to the terms of the financing Agreement. UCFS will re-evaluate should additional
information be provided for further review.

UCFS encourages you to reach out to Timeshare Legal regarding any questions or concerns with your
      timeshare relief case at:

Goes to their pockets. Awful customer service and you are left with no recourse.. This bank was part of a scam that got me for $40,000 then trashed my credit by reporting missed payments…. Completely scam. Read the comments they will get you… They were supposed to be investigating a fraudulent situation for me. Did nothing about it because they knew they have scammed many others like me. Just negatively impacted my credit score. They all need to go to jail for their scams. Worse than ****** *******.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]

You guys already sent me a letter two days after I contacted you saying you do business with T** ***** ****** and they are a merchant of yours... How am I going to get an impartial answer from someone that generates tens of hundreds of thousands of dollars for you. Its not going to happen. You and T** ***** ****** have been plastered all over BBB and Reviews saying the same thing I am saying. This get rich scheme costs honest hard-working thousands or millions of dollars. You are just as guilty in this because you know about it and welcome the money, they bring you. I already reported this to your fraud team, then I called to ask the statis of your investigation. Then two days later you send a letter saying I am delinquent on my loans (which I was not) saying you trust them and not me.. You know why and I know why. Its because your scamming people for money and you are just as guilty as them if not worse because you know about it and have been reported to the BBB by many people and you still do nothing.....

      Regards,
