I was asked to find a contractor to complete work for a new build in September 2022 and was quoted roughly 50,000. ****** ****** came out wasted time, did not complete the job and ran off with money after he was fired for attempting to add fees not discussed in the contract. Neighbors complained of loud music when no one was on site with him. He also would not give an estimated finish date and held up the project. Some days wouldn’t show up when he said he’d be there.

[BBB transcription via email, see attachments]

First I'll start by saying that this client was is a home owner trying to be their own general contractor with exactly 0 knowledge of building.  She hired me to do specific jobs per contracts which were met, but this client expected me to do anything and everything extra for free. She continuously acted like i was a general contractor for her entire project above and beyond what was in contract.  When I first showed up on the job site i was quick to find out that the elevations on the blue print were off. the print had the front of the homes footer floating 3ft in the air.  After notifying the city and surveyor we were able to get the elevation issue fixed after meeting 2 times and working out numbers for the elevations.  when home owner was told that she would need extra fill  she said " well whos gonna pay for that, I'm not". I responded you are it's your house and that I was only responsible for 4 inches of stone. the print called for " 4 inches of compacted stone base". which figured out to be 21 ton of 57 limestone. I had to have 93 extra ton hauled in to get me to that 4 inches per print and contract.  Prior the home owner gave me a check for $10,200.00 which was responsible for half of the main water line, half of the sewer tie in and half of the homes concrete floor.  This amount was exhausted between all materials, labor, and machinery. Out of said amount 100ft of water line was was installed, inspected, and backfilled; excavation for interior plumbing tie in was done twice because plumber didn't want to work in the mud. the EXTRA 93 ton of stone was excavated twice due to plumber, the contracted 21 ton of limestone was installed and compacted, the external Sewer Main sleeve was installed twice because the plumber didn't want to dig in the mud, plus an additional 40ft of pipe and 20 ton of limestone was left on site after this said client decided she no longer wanted my services. As far as loud music goes.. I personally only have a cell phone that i bring to any site, so obviously this comment is just another ** outreach. As far as a finish date .... that's impossible due to weather conditions and last years material supply issues. Said client thought that she would be in the home before her birthday which i believe is Nov. 14th and I had just started in October, which shows her ignorance on home building time lines and any construction. Bottom line is she paid for footers, and got them. She payed for masonry foundation and got it. Every thing she payed for she received, but she didn't want to pay for any extras that were not included on the print or contract and that included the $3k for the extra stone. So after adding that $3k into the equation she exhausted well over the partial payment of $10,200.00.     pictures will be sent in a separate email.

I am rejecting this response because:
I am a homeowner, who is and was my own contractor. In which I knew a lot more than you. You’ve been in business for 30 years, so why didn’t you have your certifications? For this being my first time building I knew enough to know what was needed. Mr ****** didn’t have any of the certifications needed to start any of the work he performed, I made sure he obtained them which should have been an indication he wasn’t able to perform the job correctly nor in a timely manner. He had no trenching, nor liability certificates. He started digging on my property a month before pulling an OUPS ticket, he had no knowledge of the work he supposedly had been doing his whole life. As far as the elevations goes I paid a surveyor to do the job and mistakes happen but it wasn’t a lack of knowledge on my part. The plumber also didn’t mind doing his job but you didn’t finish what you were supposed to which is why we made you come back out and put the rock down. As far as the limestone, Mr ****** gave me a quote on what was needed to start and finish the project and that was what I went by. Every time Mr ****** came on my property he was telling me he need to charge me for something else that he as an experienced contractor didn’t put into my quote. The check for 10,200 was for the water main which he didn’t do, the house slab, which he didn’t do, the garage slab which he didn’t do, and sewer which again he didn’t do. My contract for the company as well as pictures are attached. As for my ignorance with how long it takes for a home to be built had you not used the smallest bobcat available to man as well as had a crew to help you instead of being greedy the project definitely would have been completed. The house was up within 3 weeks of you being fired. Everyone was lined up, you were the one slowing the WHOLE project down. When Mr ****** was working on my property he made a joke saying he needed some **** to give him a little push to finish the job and now I don’t see it to be to far fetched seeing he thinks it’s okay to walk away with thousands of dollars he didn’t work for. I understand after covid the ability to get projects may not be the same but for you to steal from me is unfair. Not only did you steal my money but I had to pay another company to do the work I already paid you for.
