I rented a mini excavator from Holmes rental , on September the 15th they delivered it to my address. The rental agreement was for 494.36 and I used my debit card to pay for it. While the person I was speaking with at the rental store was getting my card processed he told me that If I didn't have a way to refuel the equipment that they would do it and charge my card for the fuel, I didn't have a problem with that but he failed to mention the they would charge me almost double the amount for fuel. I was charged 80.00$ for 10 gallons of fuel. I called and spoke to the manager but he wasn't willing to be reasonable. I told him I would gladly pay what fuel is at the pump and knowing they have bulk fuel hauled in at a discounted price 8$ a gallon is unreasonable in my opinion. The manager offered no solution to my problem. While I had the manager on the phone I asked him to cancel the other piece of equipment I had scheduled to rent on October the 7th. He did so and that was the end of our conversationBusiness response

This is a very standard rate for Fuel in our industry and many companies charging at even higher rates. We are not a “Fueling Station” and our preference is for our equipment to be returned full of fuel but when it is not returned full we have to have storage for fuel & someone available to fuel the equipment so it is much more costly then to go to a Fuel Station. I am sorry it wasn’t better clarified with you what our current rates are for fuel and hope to work with you in the future again and you are welcome to return equipment full of fuel to eliminate any additional fuel charges. When you pay the “Rate” that is at the station that would be helpful and takes your time, but when you want to return equipment without fueling it “Convivence” does come with a price.Initial Complaint

Beginning February 7, 2019 client began speaking with a sales person to purchase a tractor. There was a tractor in stock and client was able to drive and go over tractor. March 18, 2019 client committed to purchasing the tractor. March 30, 2019 tractor was delivered to client’s residence. Client is the first owner of the tractor. When tractor was delivered, there were two accessories (that client had purchased) that were not in stock.
May 2, 2019 client’s tractor was picked up and brought back to the store to install the accessories that were purchased. May 9, 2019 tractor was returned to client. No complaints were recorded about the tractor.
August 28, 2019 an employee was sent to client’s residence to assist with installing an implement on the tractor. No complaints were recorded about the tractor.
September 9, 2019 tractor was returned to store to repair / replace bracket assembly for 3-point connection. Repair was covered by warranty, no charge to client. While tractor was at the store, a complete maintenance was performed on the tractor. Service was not covered by warranty. No additional complaints were recorded about the tractor. Tractor hours recorded as 75.4 hours.
June 15, 2021 tractor was returned to store for a complete service. Client complained that the air conditioner was not blowing cold air. Air conditioner condenser was cleaned, refrigerant was checked and topped off, and temperature of conditioned air was recorded at 38-40 degrees. No additional complaints were recorded about the tractor. Client charged for service, no charge for air conditioner inspection (warranty expired on air conditioner). Tractor hours recorded as 366.1 hours.
August 17, 2021 tractor was returned to store with complaint that the air conditioning was not cold enough for client. Upon inspection of the tractor, it was suggested that an air mixer vent may have been rusty and not shutting allowing air from the compressor to pass through the heater core instead of directly into the cab thus not cooling the cab properly. Tractor hours recorded as 414.7 hours. There was no charge for this inspection.
March 17, 2022 tractor returned to store complaining that air conditioning has not worked properly since purchase. Checked over the air conditioning system and found that the switches tested good, receiver dry is good which led to the removal of the tractor roof to access the coils. Upon removal of the roof, it was found that mice had formed a nest around the coils and into the air ducts as well as chewed through some of the wiring. Nest was cleared out and wiring repaired. After reassembly, system was tested and temperature reading were recorded as 43-44 degrees from vents. Unit is testing within manufacturer’s specifications. Hours recorded at 483.5 hours.
It is determined that the tractor, regardless of the date of manufacture, was in fact new when client purchased it. It is also determined that no air conditioner complaints were recorded prior to June 15, 2021 (3 months after air conditioner warranty expired) and that the only repairs that client paid for were services or client damage, so no refunds will be issued for repairs completed.
