Installed March 2022, Mailed final payment 3/12/22.......Total amount $2200.00 .......Thought I was purchasing clog free gutters as the contract states. Now I have rain pouring over the top of the gutters and that will create problems with my foundation. Talked with the owner and he said that all of that on top of the gutters will rot.... also said that I was the only ever had a problem them.... All I ask for is clog free gutters, the owner that I spoke with was in Milford OH. 5841 Deerfield Rd. ###-###-####Business response

Response pertaining to customer complaint to BBBRepresentative meant with Customer on 12/15/2021 and left a written quote for the Ever Clean Gutter System in the amount of $3,540.00 with discounts applied. The Ever-Clean System comes with a Lifetime Guarantee. This is a System we have been installing for 18 years.
The customer called and needed something less expensive. Customer informed us, couldn't afford the system. Customer was given an option to just have gutters and screens installed for $2,450.00. Customer said has to think about it. On 127/20/21 Customer called asked for discount of $200.00. After Representative confirmed discount through office, He called Customer and told her it was approved. Customer was instructed to write in contract; gutters & screens, cross out the original quoted price for $3,540.00 and write $2,200.00, then sign. Customer was instructed to send 10% deposit (our normal deposit) which she called in with a credit card. Customer will pay the remaining 90% balance when job completed.
Due to weather and backlog we fulfilled that contract, installed customer's job on 3/11/22. Customer called in and said "everything looks good” and mailed a check for the remaining 90% balance, for completion of work on 3/14/22.Months later Customer called stating she had debris on gutter. Customer was informed that only the System comes with Guarantee. The representative did tell customer this. The screens keep the big stuff out but, like a shelf they will collect some debris on top and sometimes get stuck.
Customer is asking us to apply the guarantee that comes with the patented system. Customer was instructed to read the contract's last sentence that pertains to see attached warranty. That card only comes with the Ever-Clean Gutter System. This is only issued and received if System would be installed.
We know customers usually get several estimates from different companies. We also know customers get confused at times with each warranty or guarantee. Causing some confusion. We can only rely on customers taking notes, or at least reading over their contracts before
signingThis customer expects Ever-Clean to refund monies for "work completed". According to the signed contract and customers final payment, contract is fulfilled.
Customer now wants to renegotiate. Customer wants this company to upgrade the gutters to System. At company's expense? This would be unreasonable.
This company has been willing to work with this customer. There doesn't seam to be a fair or just ends. Even with the unjust slander toward Ever-Clean Gutter, through multimedia we are still willing to sit with customer to work something out. Just not at our expense.Customer response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, reasons for rejection are included below.

******* ******** This is in reference to the owners rebuttal.....I did not call and say that I wanted something less expensive. when the sales person was at my house he give the price of $3540. My response was no way, thats when he stated that he had something cheaper, he give me the cheaper price, told him I would get back with him. I did call him and ask if he would do the job for 2,200. cash, he instantly agreed. I did not wait months later to contact them, the system was installed in March and I called the owner in May. When I called in May, he stated that what I purchased was not guaranteed, that is not what the contract stated. he also said that it would eventually rot. I had to pay to have my gutters cleaned with a broom because you couldn't just blow the debris off. So in the meantime what happens with the water going into the foundation. I first called the Ever-Clean out of *********, the owner there (Laura B****) stated they never used the screens and when I sent pictures she said that the sales person should have never sold that to me with the amount of trees I have in my yard. I was definitely misled and given the wrong advice about the product, he just said it was less expensive and worked the same. I would never make a purchase for that amount of money without a warranty. The only way he was willing to work with me is me giving him more money.... All I'm asking for is CLOG free gutters, or my money refunded.
