Constituent purchased “as is” car on 7th of August and paid $5500.00 in cash and traded in her car for $1000.00. They would not accept a check so she paid cash and has the receipt for $5500.00, but on the title they put $290.00. Twenty minutes after she took it the car broke down and the engine light is on. The dealer said they won't fix it for free.

      To Whom it may Concern,

First, we are sorry that ****** is having an issue with the vehicle she purchased but it was never a sale agreement between *** ********** and Ms. *****. The sale was a private sale agreement between our General Manager, **** ********, and Ms. *****. They completed the sale at the shop because it was more convenient for **** but that is the extent of involvement between *** and Ms. ***** on this sale. I can say that **** tried to get her to bring the vehicle in on August 25th so it could be diagnosed to determine if he would be able to help her with the repair, but she did not show up for the appointment. *** is willing to diagnose it for free to help mediate the situation if she can get the car to the shop. I just need to stress that this was not a purchase agreement between *** ********** and Ms. ****** *****.

If we can be of any further assistance, please let us know.

I am not satisfied with the business response.  I feel the car should be fixed free of charge. I did not bring the car in for them to check it out because I was afraid they would charge me. I am on a very limited income and cannot afford to have it fixed.

      To whom it may concern,
On August 3, 2023 I purchased a 2011 Buick Regal. I assumed I was purchasing the car from *** **********. The reason for this was the 2011 was on the premises of their business in a locked fenced in lot. A person from *** ********** went with me on a test drive. ( no license plate on the car) After the test drive, we went back to *** ********** and went inside. I told **** ******** that I would have to talk to my son. **** was the person I dealt with and went on test drive with me.
My son called and talked to **** ******** the next day. He personally asked **** ******** if he would put his Mother in this car and he said yes. My son was out of town all week so he couldn't look at the car.
I felt comfortable with this car as it was a Buick. I have had several Buicks.
I went a few days later and purchased the car. NOTHING was written or said that the sale was "as is". I thought I was buying the car from *** **********. I didn't realize it was a third party sale until I saw the title. I was misled. I never met or talked to the seller ever.
Also on the title the sale price was incorrect. I was getting ready to write a check and **** ******** said he had to have cash. So I went to the bank and got the cash. I went back to *** ********** and went inside the business and gave **** ******** the cash.
I then got into the 2011 Buick and went to the DMV. Had the tags switched from my previous car to the 2011. I then went approximately 3 miles and pulled into a parking lot. I turned the car off and all my radiator fluid was leaking out from underneath my car. It was red so I knew it was radiator fluid. I immediately called **** ******** at *** ********** and he sent a tow truck to come get my car. (2011) The driver of the tow truck took the 2011 back to *** **********. I got a call from **** ******** the next day and he said something just needed tightening. It was fixed at no charge to me. I went to *** ********** and picked up my car. (2011)
The receipt I got was handwritten and I never received a bill of sale. In regards to gas tank it only had a half tank of gas.    My son called the Attorney General's office and it was transferred to the BBB.

      THANK YOU,     ****** *****

      To Whom it may Concern,

On behalf of *** **********, I do apologize if Ms. ***** felt misled in thinking she was purchasing this vehicle from the business. We gave **** ********, our GM, permission to keep the vehicle on site and to attempt to sell it from here so that he did not have to keep leaving work to meet potential buyers. *** ********** did not participate in any form of monetary exchange and have zero idea as to the specifics of the purchase/sale of the said vehicle. We do still offer to check out the vehicle free of charge and give a formal estimate for the repairs at which point Ms. ***** and Mr. ******** can discuss the details of how to proceed. We do not have an issue being a mediator, but I cannot stress enough that this was a private sale between Ms. ***** and Mr. ********. Thank you for your time in resolving this issue.

      ****** *****
