    I am purchasing land from these people.in Bronson fl **** county I kindly asked for paperwork that would work with the county to get an address they did not comply sent same worthless paperwork that does not help 2nd I tried calling to talk to owner he is never there his name is ***** **** since one one there is willing to help me I either want refunded or to sell this worthless junk back to them cause it’s not doing me any good to be purchasing something and not being able to do a thing with it I live in Tennessee and I’m quite tired of wasting my time and money traveling to get it ready to be homesteaded and no paperwork to get a permit to do anything on this land or get a address and not a soul in this office has tried to help me just another run around if I don’t get some answers soon I will be calling my lawyer and calculating all my waisted time and money and labor coast for the work I have done here before the county keeps insisting that the paperwork I have been given is worthless junk I have uploaded the document they sent me saying it should work to get an address and permit and county says that it’s worthless cause there is no name to match to an I’d to do a thing like it took me 3 years to clean and level this land dig roots up to not even be able to enjoy this property some deal

    this letter serve as our response to the above-referenced complaint submitted to the BBB by **** ******.  This complaint was assigned ID 20344137.

    It
    appears there are two issues here.  First,
    the buyer claims the paperwork we have given them will not allow them pull
    permits to make improvements / changes to the land we sold them. Second, the
    buyer claims this land is therefore worthless and wants a refund.

    By
    way of background, our company and related LLCs are in the business of buying
    and selling raw land.  Land is sold
    either for cash or with seller financing at 0% interest.  In the Contract that Mr. ****** signed (with
    a co-buyer named Krystal ****** – hereinafter “Buyers”), we provided the
    following provision as an added benefit:

                    (A)     
    Provided Buyer is current in making all installment payments…Seller grants
    Buyer a limited license to use and access the Property                    as a licensee. … Buyer may build on the Property during
    this time but shall do so AT ITS OWN RISK…

    So,
    first, we in no way guaranteed that anything in particular could be done with
    the property.  Second, the buyer
    purchased this in March 2020.  They have
    been making payments for approximately 3.5 years! The first day I heard of any
    issue, was the same day they filed this complaint with the BBB. 

    To
    double check their claims, I called the **** County, Florida Building and
    Zoning Department and reached a **** ***** on my first attempt.  She said
    that we just need to provide them a notarized letter from us and our LLC saying
    the Buyers are under contract and making payments and have our permission to
    pull permits.  This is the same letter we
    have used multiple times in FL and other States and we have 3 versions saved in
    our templates for my staff to use for just this occasion. (See document
    attached).  

    One
    of the requirements is that this letter be signed and notarized.  Since, I do not see a past version of this
    saved in the Buyers folder, nor have I ever been given a document to sign and
    notarize, this tells me that the Buyer has never requested this letter from us
    prior to this complaint.

    I
    then called the buyer to tell them what I found and give them Ms. Bonno’s
    contact information and they proceeded to tell me that the real reason they
    don’t want this land anymore is that its “too damn hot down here.”  And that even if I could get them the
    permits, they still don’t want the land. 
    In fact, they have worked out a deal with one of their friends to take
    over the payments (Thus, they are no longer seeking a refund).

    As
    far as the second issue raised, even if they were correct and could not pull
    permits, this land would be far from worthless. 
    First, the Contract provides they can use and access the land during
    their payment plan, which they have been doing this entire time.  Second, as soon as they pay it off, which is
    coming up very soon, they would then be given the Deed as the owners and this
    issue would be over.  (Noteworthy, for a
    variety of issues, our current Installment Contracts no longer allow our Buyers
    to do anything on the land until they have paid it off and we have had no
    problems selling land under these terms.)

    As
    a final reminder, land is real estate, the same as a house. The burden is
    on the buyer to investigate it before purchasing to make sure it’s right
    for them.  In most cases, our Company has only owned the land for a short
    time and we have not visited it in person (as we are located in Ohio) or know
    how every county works.  We have a free
    special report and an entire page in our Contract reminding and requiring customers
    to do their due diligence BEFORE buying. The land itself and the county’s procedures/records
    with regard to zoning, boundaries, ownership, tax status, whether they can pull
    permits, etc. are available to anyone.

    Our
    land is sold as-is per the Contract, and we don’t offer any refunds beyond our
    specific unique guarantees.

    Sold our property to TruDream Properties, signed the deed to them, they have the deed recorded in their name. They emailed the funds were to be sent 3 weeks ago and we have not received those funds. Numerous phone calls and emails not returned. Nobody answers phone calls.

    First,
    let me say we are sorry for the delay in the check being sent.  There have been a series of murphy’s law
    events in this transaction on both sides. 
    Here is brief outline of those events (dates are approximate):

    April 4 – The Deed was sent by TruDream to two different locations for signing by two different Sellers, with *** ***** being one of them.


    April 17 – The Deed was received from Sellers, but the notary for Frome made an error.


    April 18 – The Deed was sent back by TruDream to the notary for fixing the next day.


    April 25 – The final corrected Deed was received by TruDream.


    May 1 – The sellers’ check was submitted to bookkeeping for processing in Bill.com. 


    Week of May 7 – The check must have been missed by bookkeeping as it was not set up in the system for owner approval and payment until the week of May 14.


    Week of May 14 – The owner of TruDream was out of town the week of May 14 so no checks were approved for mailing this week. 


    Week of May 21 – The check was approved for mailing.  This complaint was made to the BBB.

    As
    soon as it was discovered that the check was delayed and *** ***** was unhappy,
    we voided the check in the Bill.com system and overnighted a handwritten check.  This occurred at the end of that week.  Due to the holiday, it appears the check was again
    delayed slightly by UPS and finally received by the designated Seller on
    Tuesday, May 30.

    While
    it’s true the check was delayed beyond our normal payment procedure, the total
    delay from the time Trudream received the final Deed to payment being
    overnighted was 30 days.   By the terms
    of most invoices in business, this would not even have been deemed late. This
    makes it very unfortunate that *** ***** felt the need to file a complaint with
    a third-party rating service (the BBB) instead of reaching out again to someone
    at our office, including me, to get assurances that the check would be there
    soon.

    From
    the day we agreed to buy this parcel, multiple calls, emails, letters and
    possibly sms messages were sent back and forth between TruDream and the Sellers
    in order to consummate this transaction. 
    Therefore, any implication that TruDream engaged in a pattern of not
    returning calls or emails cannot be true.

    RECEIVED VIA EMAIL BY BBB STAFF MEMBER:

    In my response to the company's answer I wanted to add a narrative, but didn't see where I  could do that on the email from BBB. Their dates on their response were correct. My complaint was they emailed on May 1st they would send payment for our property by May 5th. When the payment was not received, I left 6 messages, both with a receptionist and voice mails. I sent 2 emails. Nobody called back and nobody responded to emails until after I filed complaint to BBB. The check was finally received May 31st. Imagine our concern that they had our property legally and wouldn't respond to our request for payment. This would not have been a complaint if only their representative would answer their phone!
