      I signed a contract with ****** **** to have my fence replaced on 5-26-2021 and gave him a deposit of $3700.00 to cover supplies. He said the work would begin in July, depending on the weather. The weather was wet so I was not surprised when he didn't get to it in July. However, he kept sending me texts with excuses why he couldn't start. Finally he sent a text that he would start December 15th. Never showed, never returned my deposit like I asked, didn't give me the supplies he said he purchased. Haven't heard from him since despite sending him numerous texts and calls.

      I had signed a contract with B+R Fencing on May 12th of 2021. ****** **** the owner of the company at that time told me it would be July before my fence would be installed due to him being very busy. I accepted that and gave him a down payment of $3800 dollars as a deposit for materials. Early in July I messaged ****** to see when he was going to start. He had excuse after excuse from that point on as to why he was not able to do the job. Two to three weeks would pass and no word from him. I would message him and get more excuses or reasons that he could not do the job. In September he said he was going to start the fence but that was not the case. Nothing done. He changed his cell phone number in late September or early October and still no results. I had at this point heard enough and just wanted my money back. I told him just to refund my deposit. This past Tuesday October 26th I stated to refund my deposit. He said he was on his way. He did a small amount of work for around an hour and left and said he was coming the following morning. Instead he messaged me and could not make it with another excuse. I have not heard a word from him since. At this point I just want my money back and I want to be done with him. He is a very dishonest person and not a person that should be allowed to take advantage of people the way that he does. I have all messages between us as well as contract signed.

      ****** **** and his "company" was hired to install a fence in July 2021, he wrote a contract for the job which was signed, by ****** **** and me and he was given a check for material. ****** promised that the fence would be started around Aug 20,2021, as we expressed the need for the fence due to having a dog and a pool. Time passed and we did not hear from ******. I started texting him and we were given a multitude of excuses, from a death in the family, having the kids for the weekend, weather I live in the same city, the best truck broke down with pics on my text conversation. We told ****** that we understood, but he cashed our check for $3500 in July and I need a date and time he is going to start the fence . We expressed interest in receiving our deposit back, many times obvious he didn't have time for us. On Sept 10th when I told him if he didn't show up I would find someone else. He did come and put in a few poles. I have a pool and the job will be done soon not by ******.

Below by date is my whole conversation with ****** **** since I filed the complaint with the BBB. As you can see ****** **** never follows up or even tells the truth. He told you we were still working on an agreement, when we both agreed ****** **** would take $1050 on 10/26/21 and pay us what he owes us $2450.00. I am not happy with that .... but I just want this over with and it is half way for both of us. Can you tell me my next step and when I can proceed to the Attorney General? As you can see below, this should be done but ****** **** is not reliable to do anything he says he is going to do. 10/08/21 ****** ****-Well this is ****** I was hospitalized I was found ****** *** under my truck I have a Caesar that was caused by the tumor The doctor wants me to take a few days off and then I can go back my phone got broken I just now got a new phone my oldest is staying with me for a few days to make sure I'm okay I'm just now able to get a hold of people to let them know what happened 10/09/21 ****** ****-This is ****** from b&r fence .. i. Message you tell you that I was hospitalized and I have no response ****** ********-Bring my money and we will work it all out. 10/18/21 ****** ****- But you know I do got labor and it's $170 a post and you have my tools also ****** ********-Your labor was not well done a few of the poles were lose in the ground the new guy had to put a new post right next to yours. The new guy put one post in which he had one an a half bag to two bags of cement and I know your didn't because you left your mess for us to clean up. At this point I think you have nerve to ask anything for labor. I am willing to give you $500.00 for the material and what is left over is for the little bit of time you were here, which was one day 9/11/21 for a few hours. You have had my money since 07/20/21. $170.00 a post is not going to happen, that is Ridiculous!!! ****** ****-You got your side I got my side and this is what I say this is what I came up with thank you and $150 a piece. And I can also have a delivery fee for that also That's the lowest it's going to be and that's it so have a good night thank you 10/19/21 ****** ********-You brought 16 post at $10.00 a piece and worked a half a day, and broke our contract. So really how much do you think we owe you? ****** ****-Like I might have been running behind and stuff but you told me not to come so you broke the contract to whatever And the price to do a hoe the cement put the post in ground it's $150 for everyone ****** ********-Look ******, I gave you money $3500.00 to do a job in July, you know I have a pool in my backyard and a dog. When I didn't hear from you for over a week when you didn't show up on 09/30/21, I got someone else to install the fence. Like I have told you many times your problems are not mine. You can't expect me to wait forever for you, to do a job. You are like the boy who cried wolf, with excuse after excuse. So you broke the contract and it is quite obvious you have Scammed many others also! ****** ****-Okay well I still got a bill for you so I'll drop it off or send it to you ****** ********-How can you bill me when you have $3500.00z ****** ****-And it's $150 to post a piece ****** ********-I don't really intend to pay that, if we cannot take care of this issue between us (which it is obvious we can not) and the BBB, can't help us, we will go to the next step. 10/20/21 ****** ****- Well you have to meet me somewhere in there I'm not taking that $500 10/21/21 ****** ********-I understand what you want. You know what I think you are worth... where is the middle to you? I would like to take care of this but not willing to come close to $1600.00.       On 5/4/21, I signed a contract and provided a $1600 deposit for materials to *********** of B&R Fence and More. To date, I have not seen ****** again, nor has he begun work on my project. He does not answer or return phone calls and only responds to text messages. I began reaching out on May 24th inquiring about an installation date but anytime we get near a start time provided by ******, he has excuses as to why it must be pushed out again and again. I have stated I would like a refund numerous times at which point ****** provides a time frame for install that never comes to fruition. I wish to terminate my contract for breach on ******'s part and requested a refund of my deposit so I can seek another contractor but ****** states he cannot provide the refund as he will have to return the materials he allegedly purchased with my deposit but does not have the time to do so.

      ****** ****(owner) took my down payment to install a fence in the backyard and never showed up again. I have tried to call him and he only responds in texts that he is looking into it. This guy seems to be going around giving quotes with the intention of never coming back to start the job. I would like our $3500 down payment returned since it has been 12 weeks and no expected start date! I have kept all text conversations, initial signed contract, and copy of cashed down payment with nothing to show for it.
