I own 2 timeshares with the ******* **** ********* ****** ************ **** The 2 timeshares have been paid in full so no payment for the timeshares itself is required. On March 21, 2022 around 12:03pm, I called my timeshare company, ******* **** ********* ****** ************ ****, to pay my maintenance fee. ******* **** ********* ****** ************ **** service person named ********* told me that *** (a collection agency) had my account and to call ###-###-#### to pay the maintenance fee. I called this number March 21, 2022 around 12:15pm and received a number of recorded messages which were not clear and hard to understand. After listening several times, the instructions seem to say go to [email protected] (may it sound like a website) but was unclear about what to do. After a number of calls, it was determined that the *** company was actually ****** **** *********. I went to the website and clicked on the "CONTACT" tab. I made several attempts to contact *** ********* ********** through phone calls, emails and text entry into their website. I sent several emails to [email protected] as the instruction sounded like "go to" which sounded like an email address and not a website which I was led to believe. I entered my name, phone number and email address and text stating the following at ***** website ***************************** and to email address **********************************: This is ****** ****** trying to pay my **** ********* ****** ************ Inc. maintenance fee. This is my ## attempt to contact *** and I still have not been contacted to resolve this issue. I was told that you have the collection process. I was not aware that this had been turned over to ***. I was trying to pay my maintenance fee but was unable to do so. I also called the number ###-###-#### and received a message for me to go to ti******************************** but was unsuccessful, so I'm sending an email. Mnt fee is 1,782.39.

      Business response

      08/03/2021

Manley Deas Kochalski LLC (“MDK”) received the complaint made by Ms. ****** to the Better Business Bureau.  MDK is a law firm who provides foreclosure and other related legal services to its clients. MDK does not report or provide information to the credit bureaus and, as a result, is unable to provide the desired settlement requested by Ms. ****** to correct a credit report.

Ms. ****** alleges that she no longer owns timeshare properties that were referred to MDK by our client for an in rem, non-judicial foreclosure action.  MDK confirmed Ms. ****** is the record owner of two (2) timeshare ownership interests. Ms. ****** spoke with our Florida Managing Attorney, ******* ** ********* *****, and indicated that at one time Ms. ****** owned eight (8) different timeshare ownership interests; however, she had voluntarily returned those timeshare interests to MDK’s client. MDK has confirmed with our client that it does not have a record of deeds returning the two timeshare ownership interest at issue. MDK has received permission to proceed with obtaining deeds from Ms. ****** transferring the property to MDK’s client to resolve this matter, and MDK and our client are currently in contact with Ms. ****** to complete this process.
