State of Ohio v. Automark Automotive Corp. and Mark A. Reese
The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On Dec. 28, 2023, an agreed consent judgment entry and order was filed in Fairfield County Common Pleas Court settling a civil lawsuit filed by the Ohio Attorney General on Jan. 24, 2023, against defendants Automark Automotive Corp. and Mark A. Reese. Reese owned and operated the AutoMark car dealership from locations at 420 Lancaster Pike, Circleville, Ohio 43113 and at 1779 Victor Road, Lancaster, Ohio 43130, during which time he sold motor vehicles to consumers that did not have certificates of title issued in the name of the dealership at the time of the sale, and during which time he failed to obtain certificates of title in the name of the consumer purchasers on or before the 40th day after the sale of motor vehicles, according to court records. Under the agreement, defendant Reese represented that the AutoMark dealership is no longer in business, he paid the Ohio Attorney General $4,000 that was owed to the Title Defect Recision Fund, and defendant Reese was permanently prohibited from applying for or obtaining any Ohio Motor Vehicle dealer license and from having an ownership interest in a motor vehicle dealership in the state of Ohio, and defendant Reese was ordered to pay a $1,000.00 civil penalty.
