      Contracted to paint exterior of our house exclusive of window trim and soffits. Included porch, foundation and any trim that is not vinyl. The contract was for $3165. We paid $3392.92 because he said tax had to be charged because we paid by credit card but this was not disclosed on contract. We paid deposit on 6/18/21. 1st pymt of $1537.46 on 8/3/21, the day he started and second pymt of $1537.46 on 8/13/21, the last day he was here. It was raining very hard and I couldn’t inspect house but expressed some concerns. He said he would be back in a week to go over my concerns and pick up his sign. I inspected the house when I was able and since he never called or showed up for his sign, I contacted him after 15 days. He called me as requested and I told him my concerns. He said he had other jobs and couldn’t return until November but likely the Spring. I contacted him in Feb, May, Juneand July 2022. He continued to put me off until I said, we could consider a refund but he, without details I requested, offered $1095 which I rejected and said, we prefer he fix the job since having it redone due to the poor job he did would cost us about $5000 and then he offered another for about $1700 but this time he said, his legal people advised he could do no further business with us so he has to decline repainting our house and fixing the areas he got paint on due to poor or no taping on his part. We also had to scrub paint spattering from every window ourselves. At that point, I told him we would need a full refund to put toward having it redone. When we were seeking bids in 2021, they were from $4500-$5900. With inflation and the need to paint the areas he spattered paint on, we expect even higher costs. I am uploading some photos and documentation for clarification. I made notes on the contract and included the signed contract. Please let us know if you need anything else or have questions.       Response taken by phone:  I have made several offers to the customer to remedy the situation however she has declined.  I have sought the advice of my attorney and they have advised me not to do business with her as she has declined these offers.

      BBB spoke to the business and the following was relayed: In good faith, I am willing to refund the customer $2,000 if this will resolve the situation.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  My original request was 75% of what I paid Zachary to settle. That is $2544. This amount will only cover the cost to have the soffits painted as well as some other trim he left paint on per the pictures I sent. This doesn’t include the cost to repaint the body of the house. That is about $4500 as pricing stands today. I will agree to settle for $2272 (his offer and 1/2 of the $544 over that).
