Had a lease for an office copier that was ending (11/2021). I signed a new lease with Copier Fax in November in which they were are unable to fulfill the obligation of the signed contract by shipping a new copier. ****** ****** (leasing company)has a clause in their contract that I had to send a letter of intent to cancel the contract prior to the end of the lease unless I was renewing by leasing a new copier to which I attempted. I waited 3 months for delivery of the new copier that was under contract and not fulfilled therefore I attempted to cancel the existing lease, return the old copier and move on with another copier/leasing firm. ****** ****** has decided to hold me to the existing contract because of the auto renewal clause even though the copier company can not fulfill the new lease contract for a new copier. ****** ****** states I had to send a letter of intent not to continue forward with the lease within 90 days of end of lease. If I had sent that letter I would be out of a copier for my business do to the fact that Copier Fax could not fulfill the new copier lease contract.Business response

Business relayed to BBB:This obviously was a COVID issue. There were supply chain issues. We made sure to work with the client and get a new machine. It was taking a very long time. She decided to go out and sign with another vendor. She contacted us to pick up the machine. She has a 12 month third party lease with our vendor ***. We tried to contact her but she did not respond back. She did not give us an opportunity to help her.Customer response

Copier Fax response pretty much speaks for itself: "Supply Chain issues" in 3 months they were unable to fulfill their obligation in the contract of supplying a "new machine" instead they wanted to send my office a 5 year old refurbished machine as replacement. I was forced to buy out the existing machine that was under automatic renewal of the contract in order to abolish the contract. I did not go with another vendor until my buyout of the machine was completed and the existing lease exhausted. I never once contacted Copier Fax to pick up the existing machine, if that was in fact true then why didn't they pick up the machine and make every attempt to void the contract. I have never been contacted by anyone other than sales person Kristyn F******, no manager, supervisor etc. I have numerous emails with Kristyn regarding numerous attempts to correct the situation and I believe that in a 3 month period of time she or someone of authority could have resolved their "supply chain issue" with a new machine as contracted for or voided the existing lease with the 12 month automatic renewal. Consumers, beware of Copier Fax automatic renewal within their contract and their "vendor ******* ****** (***) or you too will be faced with the same scenario - excuses, excuses, excuses at your expense.Business response
