      Hi, i am the owner of nail shop Magic nails in *********. I am Vietnamese, this agent, his name *******************, phone number *****************, he is Vietnamese too. My nails shop was using another merchant machine, and ******************* called me to introduce his merchant company has the good rates, and no limit time for the contract. I still kept his record to talk about that. He told me sign the contract. I signed the paper he sent to my email without mention about the time of contract. That's mean i still thought i can cancel anytime i want. And after that, his merchant machine charged my nails shop so much, not cheap like he said, and magic nails wants to cancel the account but can not. Magic nails called *** many times but he did not answer the phone. When called to company, the customer ******************** said i had to pay about $4000 to terminate the contract. It looked like this is the scam from the agent to the company. Because i can not see the email signed with the agent anymore. This is a real scam. The liar person *******************.

      To whom it may concern,

      This correspondence is in response to the BBB complaint review. Upon receipt, a review of the merchant account was performed. This merchant account was opened January 25, 2024 and processed credit card transactions until April 5, 2024.

      The terms and conditions of the parties commercial relationship are contained in the Merchant Agreement entered into between the parties. In order to obtain a merchant account from ******************** (MBN), ***************** indicated acceptance of the terms and conditions of the Merchant Processing Agreement (***) by signing our agreement and processing credit card transactions. All applicable rates & fees are disclosed in the *** in which we receive. The agreement was signed via Docusign by *****************. MBN will only set up the merchant account as per the rates and fees on the ***. We do not change rates on any applications before or after approval without notice to the merchant.The Early Termination Fee (ETF) and Contractual Fees are indicated on the application and the Program Guide which details the Terms and Conditions including the Contractual Fees.


      As a courtesy to the merchant, we have waived the contractual fees and ETF. E-mail correspondence has been sent to the merchant with instructions on how to close the merchant account, and return the equipment provided.

      In reference to the complaint statements from the merchant regarding the Sales Representative, they are an Independent Sales Representative (reseller) for MBN. We were not involved in the conversations between the merchant and the sales representative and therefore cannot determine what happened in those communications.

      In summary, MBN has acted, and continues to act, pursuant to the commercial agreement entered into between the parties. Should you have any additional questions and/or comments, please feel free to direct them to our offices at **************.

      When we opened up this merchant account, we were approached by a ****************** (******, ************) representing MBN bancard services. He said he was working in a company in CA. He was on the phone, and he said he would only charge 1% flat for the credit card processing, but this was a complete lie. We called for them to change it to honor their word, and discovered that was completely not true, and they were charging us over 2.5%. Unacceptable, we asked the sales rep many times if there was no contract, and if the 1% was true, he stated over and over again it would be, and if we didn't like it, we could cancel anytime. They charged us $4000 for a machine that normally costs only $1800. But they said that the cheaper rate is why they charge money higher for the machine. They started charging us so many expensive fees everywhere, ****** was no where to be found, and now we are finding there is a 3 year contract. We bought the machine for so expensive, this is unacceptable, and complete robbery. They need to make this right in order to be a A+ on the bbb.

In order to obtain a merchant account from Merchants Bancard Network (MBN), ***************** indicated acceptance of the terms and conditions of the Merchant Processing Agreement (***) by signing our agreement and processing credit card transactions. All applicable rates & fees are disclosed in the *** in which we receive. The agreement was signed via Docusign by *****************.  MBN will only set up the merchant account as per the rates and fees on the ***. We do not change rates on any applications before or after approval without notice to the merchant. The Early Termination Fee (ETF) and Contractual Fees are indicated on the application and the Program Guide which details the Terms and Conditions including the Contractual Fees.


      As a courtesy to the merchant, we have waived the contractual fees and ETF. We are closing the merchant account so you will not incur fees for March 2023.   

      In reference to the complaint statements from the merchant regarding the Sales Representative, they are an Independent Sales Representative (reseller) for MBN.  We were not privy to the conversations between the merchant and the sales representative and therefore cannot determine what happened with regards to the purchase of their equipment.  All equipment purchased, as the merchant indicated, reflect were paid directly to Payment Lynx (agent office where ****** works).  Any equipment refund inquiries must be resolved with Payment Lynx directly as we did not sell the equipment to the merchant.

      I'm using their merchant card service for our small business. They told us the rate will be 1.4% for credit charge but there are so many hidden fees and every month we have to pay more than 3%. They also told us we can cancel anytime with no fee but now they force us to pay almost $800 to cancel their service.

      This correspondence is in response to the BBB Complaint. Upon receipt, a review of the merchant account was performed. This merchant account was approved on May 19, 2022 and processed credit card transactions until July 24, 2022.

      The terms and conditions of the parties' commercial relationship are contained in the Merchant Agreement entered into between the parties. In order to obtain a merchant account from Merchants Bancard Network (MBN), ************** indicated acceptance of the terms and conditions of the Merchant Processing Agreement (***) by signing our agreement and his continuance to process credit card transactions. All applicable ************ are disclosed in the *** in which we receive. The agreement was signed by **************. MBN will only set up the merchant account as per the rates and fees on the ***. We do not change rates on any applications after approval without notice to the merchant. Per the ***. the merchant account was set up for 1.4% with passing through card association interchange costs which is disclosed on page 2 of the ***.

      With regards to the *** and contractual fees for the 3 year contract, this is disclosed on the *** which was signed by **************. However as a courtesy, we have waived the 3 year contractual fees and charged minimal fees to close. We received a check for $769 which includes covering your monthly processing fees for July which was rejected back to us by your bank for account closed. The account will be closed with no additional fees.

      In summary, MBN has acted, and continues to act, pursuant to the commercial agreement entered into between the parties.       The agent number **** who talked with me on the phone told me the rate will be 1.4% and never mentioned any different rate. He also told me that I can cancel anytime and will be no fee. I didn't pay attention to the paperwork that I signed because I believed in the agent. They are using fake 5* reviews to cover up those 1* reviews which everyone was telling the same story about how they got scammed by the *** agents. I paid the termination fee but I want everyone to know about this company so they can avoid my mistake. Check those 1* reviews if you don't believe me.
