we paid a local contractor, Ordunez Builders 7500 dollars last July, 03, 22 and only hired him because his insurance agency sent an up to date policy. That price came with a 7 year warranty. Heavy rain Jan 2, 2023, we had a lot of leaks. The contractor has nothing to do with us. Called his insurance agency, found out in August when that was sent to me, his policy ended 3 months prior. Recently had the roof repaired, and currently working on the drywall damage, will cost me another 7500 dollars. Poor workmanship, he first said his aunt died, now saying he had coved, now saying he's broke.

      RE:
      (1) Our agreement dated July 30, 2022
      (2) Licensed, bonded and insured.
      Mr O******:
I am writing you regarding the Reference (1) contract for ****** *****, **** ***** ****** ***., *** ******* ** *****. As you are aware this agreement requires Ordunez Builders to fix our roof including sealing all penetrations, skylights, canales, etc. Your work has failed in at least 5 different areas resulting to interior damage to my home that has been documented by my insurance adjuster. The insurance adjuster indicated they won't cover damages and that it solely rests with you. I also had a contractor inspect the situation and agrees with the assessment of the adjuster, both saying it needs to be repaired fast before it rains again. Please note box 8 on the contract indicating 7 year Labor/warranty. Additionally, you represented your firm as indicated on your business card that you are bonded and insured, which of course requires a business license.
Monday January 02, 2023 I called you to inform you of the situation, you said wait a couple days and you will inspect it. Shortly after that I texted you an image of drywall damage from water leaking through from the roof, you texted back, "I got it". On Wednesday January 04, 2023 I called you again asking when you can look at it, again you said wait a couple more days. On Saturday January 07 you stopped picking up your calls, my wife left a message pleading for you to come by our house, the same day I called and left a message saying we had our insurance adjuster inspect the roof and said it needs to be fixed before it rains again. I said we will hire another contractor and you would have to be responsible for the costs. Then Monday January 09, 2023 at 2:18 PM you texted me that your Aunt died and you will come over the end of the week to inspect the situation. Just before your text I had a contractor inspect the roof but I put him on hold as well as another roofing contractor in hopes you would honor your contract agreement. Unfortunately, you failed to contact me and inspect the roof and interior damage. As I indicated to you the interior damage will increase in volume and scope if the roof is not remedied prior to the next rain which is in the forecast for Jan 17.
Accordingly I will contact the 2nd contractor to move forward the roofing repair and interior damage which now includes carpet, molding, etc. It is our intent to hold you entirely responsible for the costs incurred. I have given you ample time to step up and fix your work but you have failed to do so and leave me with no choice and are forcing me to move on without you.
      Sincerely,
      ****** and **** *****
