In the purchase of my modular home from *****'s Home Place (FHP) there was no disclosure by the salesperson, by the represented model home, or the sales brochure regarding the incomplete paint process. The manufacturer of my home (*********) disclosed after the home was delivered that I have just primer on my walls, not a finished coat of paint. In order to move in, the quote is $4,200 - $5,300 by a professional painter. FHP has been stalling on repairs that are necessary to prep the home for paint for the last 90 days. For the completion of our "turn-key" deal, an allowance was taken by FHP for septic, water lines, and underground electric service. For FHP to knowingly take no allowance for a finishing coat of paint yet offering the house as "move-in-ready", is and was deceptive (fraudulent). Perhaps ********* (the manufacturer) has made an adjustment with the dealership to complete the painting process.Business response

I've attached a copy of the signed confirmation order and ************************** Arbitration Agreement signed by ************************************ In this order that ********************* signed it states that the Sheetrock is primed vanilla bean base coat including closets.
When the walk thru was done and punch list was made for repairs that was needed because of the time frame for the manufacturer to schedule service for repairs to be done, *****'s Home Place had a contractor to go take care of the repairs that were needed. **************************************** & *************************** were not satisfied with the repairs that were done so FHP submitted a service request to ********* Custom Builder's requesting that service be scheduled for the repairs needed at the home. This home is covered by a one year's manufacturer's warranty and a **** Home Buyers Warranty at the end of the one year's manufacturer's warranty.
The Certificate of Compliance was issued by the Warren ***************** of **** Enforcement on December 7, 2022. I'm attaching a copy of the ** herewith. Once a ** is issued the home can be occupied.

I am rejecting this response because:FHP forwarded you documents which I signed, but failed to forward you a document that clearly states that as turn-key move-in ready home, I would paint my own home and they would not be responsible for doing so. This is where they have failed to disclose. Now here's the catch, FHP possesses a ** from code enforcement and upon the walk-thru with the owners wife, she compiled 3 sheets of discrepancies with just several items on the exterior of the home. To this day, those items for the interior have failed to be corrected or prepped for a finished coat of paint. Mind you, the electricity was requested through the code department for temporary service by FHP and I am billed electric and water bills monthly. Professional painters have given estimates for painting from $4200- **** but will not take responsibility for FHP making the corrections that they are solely responsible for, through them or the manufacturer. We cannot move in until the listed items are corrected and the home is painted.

This response is being sent for ********************* on behalf of *****'s Home Place.To address FHP everyday turn key pricing (flyer attached), it clearly states everything that's included and it does not include anything about a finish coat of paint. ********* sent me a text message on Friday, January 13th, stating that it's *****'s understanding that bathrooms and kitchen areas are semi-gloss necessary. This information is not correct. ********* and ***** were not misled in any way about their home having a finish coat of paint. One of the paint contractor's that gave ********* and *********************** for painting their home, told them that other than adjusting the interior doors, she could take care of all the prep work needed to be done to be able to paint their home but ********* and ***** wanted everything that was on the punch list done prior to their paint contractor starting. The paint contractor even told them that she could go ahead prep the walls and paint. Then once the interior doors were adjusted she would come back and touch up the doors if needed at no extra charge. Again, ********* and ***** didn't agree to this either. They want all items on the punch list done prior to painting.When we finish a house, we do a walk through with the customer and write up a punch list. Then the punch list items are assigned to the appropriate contractor or it is sent to the manufacturer for service. In most cases because of the time frame that it takes for the manufacturer to schedule service, *****'s Home Place usually has a contractor take care of the issues. In this case, we had a contractor go take care of the punch list items. The contractor actually replaced 3 interior doors, adjusted interior doors, installed 2 girders between the floor joists and adjusted the interior electrical breaker box. The contractor didn't repair the scrap on the wall because he didn't have any paint to touch up. The work that was done wasn't satisfactory to ********* and ***** so *****'s Home Place turned it over to the manufacturer. The manufacturer sent a service contractor to work on their home and the list wasn't completed and some of the repairs still weren't satisfactory to the customers.*************************************, the service manager with Champion Homes (Crestline/***** is now owned by Champion) spoke with ********* on April 17th and discussed the remaining issues that needed to be repaired. ****************** notified ********* that a contractor would be loading the materials for their repairs last Friday (April 21st) and will be in touch with them early this week to schedule a time to come take care of the repairs.Customer response

I am rejecting this response because:*****'s Home Place has stated that all the items on the punch list have NOT been completed by them, its contractors or Crestline as of today. FHP presented a modular home as "turn-key" which means Turnkey means no painting, no construction, no renovating, says *************************;of Coldwell Banker in *******, **. Just walk in and start living. If FHP has a document signed by me that I would paint a finished coat of paint, they need to present it, indicating that a primer coat is complete, releasing FHP of any obligation. FHP just stated that all prep work, even now, is incomplete. Stating now that a painting contractor should do the work that we paid FHP to do (and has been on their punch list to do). The structural problem was noted during the walk through. The work done there does not meet a housing inspector's clearance. Replacing the broken floor joist was not done. A girder holds things together, not repairs it. Crestline/ ****************************** Place are misleading me and the public. This is unacceptable when I should be in my home. FHP has had full payment of my home supposedly in their escrow and previously stated to you that I owe them money. For almost 2.5 years he has been collecting interest on our money. He has a certificate of occupancy by requesting temporary electrical service for the house when a generation should have been used to check the electricity, knowing the service would be turned on in the customer's (my) name. Therefore making it appear the home is move-in-ready.
