    Through extreme distortion of facts and flat out fraud they convinced ** to sign the contract. When we tried to cancel they denied ** turning our honeymoon into a nightmare.False and deceptive sales practices as follows:False Claim of Buyback Options: the sales representative repeatedly assured us that Divi Vacations would buy back the timeshare if we were dissatisfied any time during our ownership of the timeshare.This was a pivotal factor in our decision to proceed with the purchase, as it mitigated perceived risks. However, we later discovered this claim to be a bold-faced lie, as confirmed by a customer service representative who stated that divi Vacations does not and has never conducted buyback. Had we been aware of this deception, we would not have entered into the contract.Misrepresentation of Maintenance Fees: Divi Vacations stated that all maintenance fees would be waived the first year, the sales representative said " you wouldn't pay any fees in ****", a crucial detail in our decision-making process. On the contrary to this assurance, on day one we received a maintenance bill due on January 1st, **** for the maintenance fees of the following year ****. A few days later we were denied access to our account due to non-payment of fees we were told would be waived. The deceptive presentation of this information requiring payment through **** for access to the account in ****.was misleading and contrary to what we were led to believe during the sales pitch.Incorrect Rescission Period Information: we were informed by the sales team that we had a one month window from when the account became active online to rescind the contract. However, upon contacting Divi Vacations, we were told that we owed fees that should have been waived, and we were denied the option to cancel within the period we were explicitly told. The discrepancy between what was represented and the actual rescission policy is clear evidence of deceptive practices.

    On 3/31/23 while vacationing in *****, I fell victim to a hard sale and signed a contract for a **** ************* membership. After realizing my mistake and reconsidering my decision I decided to make an application to the company to cancel the contract. I wasn't scheduled to leave ***** until April 3, 2023 and realized I only had until April 5, 2023 to do so. Upon my return home I sent a letter requesting rescission of the contract to Divi Hotels Marketing **************** by **** Next Day Express mail so that it would arrive on April 5, 2023 per the contract. Eventually I received a signed return receipt but after 2 weeks I still had not received any other correspondence. On April 16, 2023 I sent a follow up letter by certified mail renewing my rescission request as well as stating the urgency of doing so, as per the contract, I was to begin making additional monthly payments of $440.20 on May 1, 2023 toward the membership. As of this date I still have not received any correspondence regarding my rescission request. As a loyal customer of ********************** for the past ******************************************************************************************************************************************* a timely fashion in an effort to cancel same, I am asking that my request to cancel the contract be granted and that I am refunded my down payment of $3390 as well as any future debt that I incur as a result of the delay in doing so.
