      ******** told me he would build me a deck. He told me he had worked for builders before and now works for himself. He told me I could pay him cash (whick I did - $13k) and I could buy the materials (over $8K) at Lowes in **********. When my HOA said the deck had to be inspected by the county, the county did an inspection and found 14+ issues with the deck. ******** told me he knew code and that the deck would be up to code when it was finished. As of 10/19/23 the deck still has not been passed by the county and won't be until those 14+ issues are taken care of. ******** is wanting to charge me more money (for labor) and wanting me to buy all the materials. We were set and agreed on the amount to be paid to him and he assured me the deck would be built to code. Below is the list of items that the inspector found wrong with the current deck. Need kick boards on riser for steps. Need hanger or post under the header that joists and stair stringers are attached to. Nothing larger than 4 inch clear space sphere on rails. Need to see what band against house is tying in to (floor system, floor trusses, I joist etc.)Need structural screws on tops and bottoms of posts tying to roof and deck bands.Unsure of how roof has been constructed.Need y or knee bracing on all posts where deck is 48 inches to top of deck. Current y bracing needs correct screws and need two on top and bottom of y brace. Need more nails in all brackets, need to use appropriate nails.Need hanger for girder at corner of house in front, Currently toe nailed, should have hanger and bracket. All girders are over spanned. Need more posts under all girders. Where new deck meets old deck on back side of house, end girder is toe nailed, not supported. Need to support somehow. Back corner of house where pvc turns there is no hanger for that girder.

      OK first of all, I am not charging to finish the project. I ask him to bring me 4 pieces of 6x6  to put up underneath the deck against the house

      I told him that he was not going to be paid more than $300 to buy the miscellaneous to complete the punch list except else which they are hog wire panels to replace them. I told him that I have to charge him $700 to pay. My guys are install these panels because he want me to stall those he went to tractor supply and buy them, and he asked me to go get them which I didnt charge him to go pick them up 

      Now when Im building something and I am providing the material if for some reason, the project dont pass code Ill buy whatever I have to complete job and be able to pass code

       I am rejecting this response because:

      Narsico planly told me through text yesterday (10/19/23) that he was charging me over $1000K to finish the deck. $300 more for material and $700 more for replacement of *******. This weekend cabin is over 2.5 hours from my permenant home. I do not know when I will be back up at the cabin. He asked me if I wanted him to buy the four 6x6's and I said yes. He has been able to go to ***** and pick up anything and everything he has needed and have it charged to my credit card. The only reason he can not do that now is because he maxed out the card.

      I have purchased every piece of material for this product. Both labor and materials original quotes have gone over. No leftover items (boards/screws/nails and other misc items that were purchased on my ***** care and WAS NOT) were left at the site. 

      Labor Quote = $12,100 Turned out to be over $13K & still wants me to pay another $700 (for the handrail replacement). 

      Materials quote was $3500. Turned out he charged more than $6500 (on ***** card) and that wasn't including what I paid for two ceiling fans and the original hogwire (over $700). Meaning I spent OVER $3700 (more than double) in just materials than what he told me it would be. In my opinion, he just under estimated, but instead of letting me know, talking to me about it, he just kept going and buying more materials.

      He told me he knew code and would be doing everything to code even though he is not licensed in the state of NC. I did purchase the hogwire, he did pick it up (he didn't charge me - he wasn't supposed to - he is the contractor with the trucks - he picked up materials from *****). 

      The $13,000 I paid him (in cash) was to build me a finished/code passing deck. He picked up the hogwire knowing it wasn't up to code and installed it. Yes, I did want hogwire and not pickets. They were told that in the very beginning. He told me that he had worked with hogwire before and knew what was acceptable and required by code.

      This has been a diaster from the beginning. He told me it would take a week and a half. It took three weeks! He had employees that wouldn't show up to work, therefore the project would get behind. There would be days only he came because he didn't have any help/workers. He missed atleast one day of work because he told me his truck was broken down. Come to find out he has several other vehicles he could have driven. The project was "finished" three weeks later. Three times the amount of time he said it would take. In the end, he was complaining my cabin/project was too far for him. Obviously, he wasn't forced to take the job on. I contacted him, he gave me quotes and I hired him. 

      ********* statement: Now when Im building something and I am providing the material if for some reason, the project dont pass code Ill buy whatever I have to complete job and be able to pass code.

      ******* TOLD ME, HE KNEW NC CODE and would DO THE PROJECT by code. He had access to all the materials he needed at ***** (using my card). When I had already paid $1000 more in labor and more than $2500 more in materials, I expected to have a deck built to code. His projected labor cost and projected material cost should have included all the materials that ARE STILL NEEDED TO PASS. There were 13 issues with the deck - not including the hogwire railings. 

      I was trying to work this out where we both took some responsbilty. With me already paying $3000 more two weeks ago, my resolution was for him to provide the materials for the 13 safety issues and complete the labor (at no more charge) and I would purchase the new hogwire (which would be about $1200 - the $500 spent on the "bad" hogwire would just be wasted and thrown away (I was even going to offer it to him....maybe he could sell it to a farmer and get some money from it) and he could swith it out without charging me more. He does have workers, but they don't come a lot of the days they are supposed to work and the removal/replacement of the new hogwire could be done by him. Which would be his part of the responsibity from NOT REALLY knowing code OR EITHER trying to get away with doing all tasks that needed to be done for code. If he knew and went by NC code he wouldn't/shouldn't have installed the first hogwire. It is his error and installing the unexceptable sized hogwire. When you are a homeowner and you hire a contractor, you expect them to be the experts and know the rules/codes/costs. 

       

      These are the 14 items the inspector found wrong with the deck -

      OK like I say again I met the inspector Job site

      I know what needs to done hes been saying that I told him this and that but most of the contractors with ************** license when they build something never  pass code the first time and this is the case

      And hes complaining about that he spend too much already. Hes right about that. I gave him the first time and I guess he didnt have the money at the time and he asked me how much it will be just for the labor and Ill give him a labor price, and he decide to buy the material I messaged him yesterday that I will go back and fix the punch list, but he needs to buy the mature to have everything done except the handrails and I told him to that if he spent over than $300 ill pay the difference but he dont want that and hes been saying that I didnt leave any scrap  there I take everything to the landfill  trash and scrap. the . lumber I take it back to Lowes. He knows that and hes ********** back on that lumber and we have one panel of the hog wire I take back to tractor supply and hes ********** back on that one to Im not taking advantage of nobody is why I have a good reviews on bbb and hes been saying I was complaining about the job was too far away for me last time I talk to him on the phone he tell me the people on Buck Mountain dont want me back over there and is when I say to him. What make you think that I wanna go back over there this job, and that too far away from me I dont wanna go back up there to do any more jobs. I just want him to pay for these items to go to the specialist and get done with it and healthy way.

       I am rejecting this response because:
      Narsico he saying/admitting that I've already paid too much. I have paid $1000's over what he told me it would cost. The labor and the supplies cost have been over what he said it would cost me.

      I messaged him yesterday and told him that he should be responsible for the material/labor that is left. I paid more than what it would have cost to do this project. Whether he projected wrong or it was an honest mistake it was on his part.

      We did agree for him to take the returns to Lowes/Tractor Supply. It was a very small amount monetary wise.

      I'm sorry he misunderstood. None one on the mountain has said they didn't want him back over there. I mentioned to him that there were a lot of people over there there that needed/wanted work done. That is when he told me that it was too far. I said if the job was too far for you, I wished you would have just told me that in the beginning. 

      He asked me on Tuesday if I wanted him to buy the supplies and finish the safety issues OTHER than the handrails and I told him yes.

      Well, hes been saying hello to him that I was going to build a deck to be able to pass inspection. I never told that. And besides that any licensed contractor or a builder build a project tha pass inspection the first time nobody. and hes been complaining that he has spent $1000 over the original quote that I gave him with Material. He weighed month or so. 
      and the prices change every day he didnt let me buy the material I guess he thought it was gonna be cheaper him buying the material but the difference is I dont buy material just from Lowes. I buy from different places to cover the budget on the projects. That way I dont end up spending more money and sometimes I lose money that way contractors and builders is how they lose money sometimes my quotes that are only good for 30 days for the reason material prices changed every day and Im still open to go taking care the punch list if he wants to and hes been saying  that I was complaining about the job its too far away from me I mentioned it to him last time I talk to him on the phone because he told me that the people that i been talking to and the community the one we go back over there doing any job for anybody else is when I tell him that I dont want to go back there to do any more work for nobody else because this job and up to far away from me

      Hi, I want to get done with this and I sent a Tex message to ****** on 12/11/23 asking him when he be able to buy the miscellaneous that Inspector is requiring and they respond back to me on 12/12/23, saying that hes running to some personal issues that he dont have a time for Deck or games right now like I say on the last email I dont have a problem going back to do the punch list, but seems like hes not want to do it I am assuming the heat to have the money to vote the year miscellaneous and I dont wanna let it pass long time because Material goes up every day or week. Hes gonna be paying more and like I said on one of those emails he will be spending around $300 for the miscellaneous. If its over $300, I will pay the difference but looks like it. He doesnt want to do right now if he doesnt want to do right now I wonder how can we close this case?

      I have already contacted **** (through text) letting him know I could pay/send/venmo the $300 and that he could fix the items on the punch list on a Wed or Thurs (whatever worked for him).

       

      I also wanted him to address two issues/mishaps with the deck.

      - hog wired on steps was put on incorrectly. should be up and down like the rest of the wire

      - board piece above steps/on ceiling/near fan is damaged. it looks like he might have gotten a 

         bad/damaged piece from Lowes.
