ABC Advertising's contracts, staff, owner and sales representatives are not following Missouri Statues Section 407.937. by refusing refunds to consumers. They tried it on us when they circumvented our marketing director's direction to the sales person Stan Fisher and ABC Adv were notified almost within an hour of the signed contract that the individual who signed the contract was not authorized to make those decisions. Even after this and the individual confessing to them that they had no authority in the company to make that decision and needed a refund, they lied and said we weren't allowed since deposits are non-refundable. It wasn't a deposit. It was a full payment. I told them that Log Masters Restorations did not want to do business with them. After I informed them that their actions are not legal by business law in the state and federal law standards. We met the law's demands to receive a refund within 10 business days. Their sales team, staff, and owners appear to be ignorant of contractual laws. They claim their contracts are legal, but by Missouri standards, I would disagree. I finally got a refund after contacting the Missouri Attorney General's office and filing a claim against them: *****************. After the owner received his copy of the complaint, he called to "give" us a refund but was going to make the tabletop with us on it anyhow due to all the mess. They lie constantly. First, "I can't give you a refund because the tables are done," then later, during what ** ******** considered kindness of a refund, not obligated, "So, since the tables are done, is there anything you want changed?" I have it recorded and thoroughly documented. They are shady and I suggest you reconsider their ratings. Look at the complaints and the many bad reviews. On 8/2/2023 a refund check was cut and mailed on 8/3/2023 to refund this customers Payment in full. I am hoping this action takes care of this customer request.Initial Complaint

We went into a local restaurant in town last October and filled out an advertisement that was on the tables. Once submitted a man called us and told us pricing and where to send the check to. They cashed the check. They have since delivered and setup half of the restaurant tables and put out new advertising on the tables selling spots for the second half of the tables. Now they want another check for the same amount stating we have only paid for half of the tables. So I called every other business listed on the tables. Every business was led to believe the first payment was for every table in the business not half. The advertisement says “every table” in bright yellow print. We feel since that’s what was sold to us by this company that’s what we should get. There is sufficient space on the table for more businesses so we feel the correct course of action would be for the company to put every business on every table as they advertised not just half.Business response

I PAID FOR ADVERTISING AND THEY HAVEN'T PROVIDED ANYTHING. THE ADVERTISING WAS SUPPOSED TO BE ON TABLE TOPS AT ******* RESTAURANT IN DOWNTOWN FWB. I PRE-PAID $2100.00 A YEAR AGO & STILL HAVE NO ADVERTISING AS PROMISED. THE CONTRACT SAYS I GET GET A REFUND, HOWEVER THE LOCAL REP SAYS HE'S STILL WORKING ON IT & COULD NOT GIVE ME ANY DEADLINE.Business response

At this time we are waiting on the last Customer to approve his ad. Then we will need the Sales Rep to approve the total layout. I am hoping that it will go to the production side of the business with in the next two weeks. In February, ABC Advertising (******** ****** specifically) approached several business owners about a remodel at ***** ******** ******* *****. They were putting new tables in the restaurant and were having people purchase ads to be placed on the tables. On February 18, 2022, I purchased an ad in the amount of $1615.00 for 3 years of advertising on the table. As a new real estate agent, I had already paid for a web page and spent a large sum for real estate dues, insurance, etc but I thought that summer peak season would bring in business. The contract stated that ads would be on tables 60 days from the day ad proofs were approved. Mine was approved on 3/9/22. It also stated that if there was a delay it would be at the most 10 days. As of this complaint, the tables have still not been installed. There was, and still is, very little communication from ******** ******. I even called the owner, *****, who refused to give me a refund. On 6/8/22 I reached out to ******** who stated there was a delay in production. On 6/26 ******** sent an email that shipping was to be 7/18 and would be installed a few days later. They have yet to be installed. This is the most unprofessional group I have every had dealings with. I would never recommend them to anyone.Business response

We have not done a project at Smoky Mountain Pancake House but we have done one at *** ***** ******* ***** which was installed on 9/19/2022. Per Line 3 of the Purchase agreement " Purchaser understands that construction of the tables will begin upon the completion of the selling and proofing process. Upon Final ad approval the time for construction through install is 60 days." Unfortunately like many in the manufacturing business we have had issues with getting materials we are sorry for the inconvenience this many have caused.
The Advertising time started on 9/19/22 when the tables were installed. The Purchase Agreement is also clear in two places that " All Transactions final-no refunds" and " Deposits are non-refundable. At this time I have tried to contact Mr. ******* several time and have left voice message for call back about a charge back to his credit card for his $1615.00 for his ad with no response.
We are very sorry for any confusion and inconvenience but are happy to say the tables are in and doing the job Mr. ******* was promised.

I am rejecting this response because: No one has tried to contact me via phone or email! I was just at the *** ***** ******* ***** and NO, the order is not complete. I saw several large tables and smaller ones with old ads on them. When I asked about the tables, I was told that the larger ones and some others had not been delivered and they did not have any idea when they would be delivered. A contract is a contract and I do not want to hear excuses of why it wasn't and ISNT completed. These con artists have been giving us excuse after excuse since February. Call and ASK if the order is complete! I was also told by the people at the pancake house that the quality is far inferior than previous tables. It is simple. We were not given what we agreed to at any point since February. I want a refund! I do not do business this way.

I am Sorry you still feel this way Mr *******. The number of table tops replaced are a contract between ABC and the Restaurant owner. That contract has been completed. I will accept this because I am just over this whole situation. This would have never gotten to this point had it not been for ******** and her unprofessional work ethic.
