      On August 13, 2022 I requested from ******* ****, RA Landscaping owner, to return and/or refund my $300.00 deposit check immediately. My bank said the $300.00 check was cashed on August 12, 2001. On August 12, 2022, I had requested specific information be stated in the backyard clean up contract bid from ******* ****, RA Landscaping owner. I have not seen any written contract including the changes I verbally talked to *** **** about on August 12, 2022 and that he agreed to include in a written contract. The request was to include the following information: Brush clearing will be ground level around all backyard borders and fence lines. The brush debris will be removed from property. The start date and end date of the backyard cleanup. Weeds to be pulled from around garage. I had not signed any contract with ******* ****, RA Landscaping owner.

      The work that was completed August 12 I was paid for.  We had a verbal contract to complete the work.  And yes, I deposited the check on the 13th, for the work that was done.  I have a document from my CRM system that I can provide that details the additional work that she requested.  The work done on the 12th was preliminary work that had to be done before the work (scheduled for the 16th) could be done that is on the CRM document.

      I am rejecting this response because:

      *** **** did absolutely nothing in regard to **** **** ***** *** ****** **  ***** backyard clean up.  He did not do anything at all.  Please see the attached photo of the **** **** **** backyard  showing that he did absolutely nothing.  He is just not telling the truth.  He took my $300 with the intent to steal my money.  I never signed a contract with him and I certainly was not making a donation to his business.  He has done others the same way.
      The work was not completed on August 12, 2022.  The written proposal from him stated that the work would start on August 16, 2022.   I did not request anything additional from ******* ****, owner RA Landscaping.  He requested $300 on  August.12,  2022 from me.  He NEVER included his name on any proposal he submitted, even though I asked him to do so. Whatever he comes up with saying these are the additions I requested is just not true.

      We stand by our original response, We cleared a large dry brush pile off the consumers property, I was advised by the BBB representative that took the response to not do any additional work for the consumer so I didn't. The money I was paid covered the work that was done, nothing more nothing less. We will not provide any refunds or additional work.

      Hired him to do fence line clean-up for 3 houses for $1000. In one of the houses, the grass was tall so he agreed to mow it first but main job was to do fence clean-up at 3 houses. Paid him $300 on June 23 2022. He was supposed to start on June 29th and he never did. Texted several times, he will call back giving excuses that his truck broke down. After he did not do the work for 2 weeks, I started asking for refund. No response and now that I told him that I will file a police report, he says that my deposit is for mowing the lawn. $300 for mowing a quarter acre yard. Mowing the yard was not even part of initial request.

      To mow a lawn that was probably the first cut of the season that was in excess of 3 feet high cost $300, which he was informed of. He was already discounted $250 for the 3 houses that we were going to do. But he wanted an even deeper discount. he kept trying to change the price. I believed that he was unable to afford any further services, he kept wanting to get even more of a discount. He got exactly what he paid for, which was the cutting of the excessively high lawn.

      See my text messages where I did not ask for discount. The deal was for fence line clean of 3 houses. I kept asking him for the job to be done and he never mentioned about cutting the grass for $300.

      Everything was to clean the fence line on 3 houses. After waiting for 2 weeks, I asked for refund and then he came up with the story that I mowed your lawn for $300.

      In one of the messages he said he never return deposit? Why? If you don't do the work, you need to refund the deposit.

       

      Attached is the screen shot for the initial bid to get the quote for fence line clean-up for 3 houses. In one of the of house, the grass was tall and I told him that it was tenants responsibility but he said that he will include that for $50.

I did not even wanted to mow the lawn as it is tenant responsibility and did not want to start a precedence by mowing it. But he did that so he could keep the deposit. 

       

      On July 14th, when I told him that I will file a report, he came up with the fraud scheme that the deposit covers the mowing.

      I have been retained by Anne Reiss to represent her in the matter regarding paperwork she received from your business of "Notice of Intent to File Mechanic's Lien Statement" on June 8, 2021. This is a poorly attempted scare tactic to defraud Mrs. ***** of $285. Mrs. ***** retained you to perform lawn care services at her home about three years ago. There isn't a written contract between you and Mrs. *****. The ongoing business relationship was as follows: you would perform a lawn care services for Mrs. ***** and you would cash-app request her for the amount owed. Mrs. ***** would then fulfill your cash-app requests. On May 15, 2021, you cut the yard and cash-app requested Mrs. ***** $45 for the service, Mrs. ***** paid you for those services. On June 1, 2021, after many complaints for missed appointments and poor job performances, Mrs. ***** terminated her business relationship with you . It hasd been two and half weeks since you last cut Mrs. *****'s grass and her yard became overgrown. Either prior or on May 15, 2021, youi and Mrs. ***** discussed you dethatching her yard. THIS SERVIVCE WS NOT PERFORMED. Mrs. ***** never received a cash-app request from you for this work, and it is obvious by looking t Mrs. ***** yard that detatching was not done. Te invoice you served on Mrs. ***** with the "Intent to File Mechanic's Lien" fraudulently states this service was completed on May 21, 2021. By serving this paperwork on Mrs. *****, a number of criminal acts may have been committed including your false affidavit wyhich is a class D felenoy. Even if you did complete the service, it is clear you have not retained legal counsel to assist you with this matter, because you failed to comply with the basic requirements of Chapter 429 RSMo. You have failed to comply with the condition precendent to the creation, existence or validity of any mechanic's lien in favor of an original contractor. A "Notice of Owner" written notice disclosure was never provide as required per 429.012 RSMo. Further, in yoiur paperwork you state you will file a mechanic's lien pursuant to "R.S.Mo.429.100". That stature is for subcontractors, which you are not. It is impossible for you to have valid lien against Mrs. *****'s property. I would like to believe thiws wan an impuslsive decision you made in response to Mrs. ***** terminating her business relationship with you and not an ongoing scheme you use to extort your customers. Contact me immediately to give me written assuraces that you will no longer seek to file a mechanic's lien.

      I talked to the customer after May 22nd.  I asked her if she received the Cash App request for $285 for the lawn dethatching.  She said no.  She said she will pay that by the end of the evening.  I started talking about the areas that had the most thatch in it.  She started talking about her dad being sick or in a home.  I told her I had to go.  It seems she got upset because I had to go.  I ended the conversation after 5 - 10 minutes.  There were 2 missed appointments.  They were on  May 22nd and May 29th for non-payment.  Then after the 29th, I decided I will not continue to take care of her lawn because it was too hard to get payment.  She tried to call me several times after that before June 1st, and I did not answer.  There was not payment like she promised.
