      Date of contract: 10/27/2022 The business required a deposit of $13,022.45 Building Technology agreed to the following: To repair my basement from MSD sewer back-up that came into my basement July 2022. Building Technology agreed that he would Remove mold contaminated drywall (300sf), encapsulate framing with sealer, treat wall with antimicrobial spray, replace drywall (300sf) , prime (300sf) & paint (1,336sf) (2 coats) walls, remove & reinstall base trim, paint base trim (1 coat), remove & replace ceramic floor tile on two pier stage, remove and replace plywood subfloor on stage, treat for mold as needed, replace under layment on stage, rebuilt stage, remove & replace vinyl floor tile, and remove carpet under TV and repair damage.Prior to contract being signed we (***********************, Owner) spoke in length regarding him not sub-contracting this job he agreed he may from time to time have one worker help but that he would always be present with the worker. *********************** have sent several different contractors to do drywalling, two different contractors to do the floor and theatre platform because **** and contractor couldnt agree on price. My floor and theatre was suppose to have the same tile. I have one tile on my floor, a section of the closet has the tile on the platform, and the bottom half of the platform contains another tile. The tile on the theatre floor is not level with the tile edge trim piece. The tile in front of the closet slopes towards the closet. He sealed up the theatre platform without removing the debris he left under it, after I showed him the large amount of debris I removed. Sections of drywall not professionally complete. No plastic was used to cover doors, furnace, etc. and my basement and furnace, hot water tank saturated with dirt and dust, my air duct and HVAC system must be cleaned out. **** allowed teen age kids he classified as interns to help him work. Several blotches of missed paint in the closet. I have stopped the work.

      This letter is in response to a complaint, filed by ************************************* for a Projects contracted to perform at her residence located at 4160 **************., ********** ** 63108. Building technology LLC entered into a contract with ************************************ on October 27, 2022. The contract was for mold, remediation, remove and replace drywall, prime, paint, and remove and replace ceramic tiles. My company has been in business since ****. I am a general contractor and employee certified subcontractor to handle some areas of specialty. There was never a conversation stating that I would not employ subcontractors to work on her project or that I would be present during the time they are working on her project. **************** on several projects at the same time, and there is no way I can physically be present  at each side at all times.

      Work was originally scheduled to begin on December 1, 2022, but had to be rescheduled, because **************** had some personal items in her basement and the ** were still mounted on the wall. I had previously inform us dentist at the ** have to be removed from the wall, and all personal belongings removed from the basement before we could begin her project. **************** stated that she was informed by someone that removing her ** from the wall would result in damage to the set, and this is why her worksite was not ready for my guys to begin work. Because her worksite was not ready on the schedule start date, I assign my guys to begin working on another project. My guys was on site at 7 AM ready to begin her project, and any delays or work stoppage caused by the customer results and lots of revenue if they are not working. I have a very busy business and because of the delay caused by ***************** I had to move onto another project and reschedule her project to begin on December 21, 2022.

      When we returned, **************** had still not removed the ** from the wall, but instead, she covered it up. Because the ** was still mounted on the wall. I stated that she would have to sign a waiver, releasing my company from any damages as a result of her refusal to take the ** down. **************** became very argumentative and combative, and refused to sign a waiver. **************** finally took the ** down, but this whole process of refusal to sign a waiver and ** resulted in another delay of three hours before my workers could begin working. Everything seemed fine for the next couple days on the project.

      We perform the task of drywall removal around the perimeters of her basement, which resulted in a lot of does circulating. The basement was confined space without a lot of ventilation, so the smoke detector was triggered because of the dust. **************** indicated that the fire department was dispatched, I did not win is anyone showing up from the fire department, so Im not sure where she obtain that information.

      The next day or subcontractor, showed up on site to install the drywall for the project. Early and installation process he incurred a family emergency and had to leave for three days. He informed me a sentence, other circumstances, and I followed up with her to ensure she was OK with waiting on his return to complete the installation. I sent it to her that I could complete the installation in his absent so that it wouldnt cause any delays in her project. **************** stated she was OK with waiting on him to return to complete the drywall installation. He return in three days and completed the drywall installation within two days.

      The day after the drywall installation, the painter showed up at Ms. ******* is home to begin the painting portion of the project. The painter worked almost all day before **************** informed him that she had another engagement, and she would have to leave. There was only approximately 30 minutes of work remaining in the painting project, but the painter shut down the side and return the next morning at 7:30 AM to complete the project. Customer pointed out a couple touch up spots on the wall, and we corrected those areas as instructed by the customer.

      The day, following the completion of the painting, a subcontractor arrived on site to begin the installation of ceramic tiles. The original subcontractor completed 80% of the project within two days before he informed me that he was unable to complete the job. Another subcontractor was assigned to the product the following morning for completion of the tile work. He also completed the custom tile work for the platform. The only work that was remaining to be completed was grouting the tiles on the platform. At this time is ****** send a text message terminating the project.

      The remaining work was not able to get completed under the contract was for resetting the base trim, installation of vinyl floor, tiles, and grouting the ceramic tiles. The customer refused entry of my workers to enter the home, and refused to honor the balance on her contract. The original contract was in the amount of $26,044.90, of which She made a deposit in the amount of $13,022.45. I have given her credit for the work that was not completed as a result of her terminating the job parentheses removal and reset base trim $1033.40,  paint base trim $238.59, remove vinyl floor tiles $208.21, and replace vinyl floor tiles $877.97). There was also a supplement/change of order to add ceramic titles to stair riser for the amount of $250 which was added to the cost. Missing his remaining balance is $10,914.28 in which she is refusing to pay.
      **************** allowed the product to proceed to 98% completion before she decided to terminate the job. She terminated of the project over a text message, and never allowed us to come over and address any of the concerns she had with the project. She began taking pictures on the first day of the project of the work to begin building her case on terminating my company before the end of the project. She didnt allow us to complete the grout of the tiles so they could appear unfinished, but she allowed the installation of the tiles to be completed. She still owes my company a $10,914.28 for the work performed at her home. Reactions appear to be very calculated getting work completed that are previous handyman could not perform, and then, when the project is almost completed, terminating the job and was holding the remaining balance. This action allows her to get mine, are remaining items done by her handyman, and pocketing the rest of the contracted money.

      I used professional subcontractors on her job. I also participate in mentoring seniors from the high schools, which I used on her job to assist with cleanup and debris removal. The tiles on the floor flush and I have pictures showing the final work. I have also a receipt of the tiles purchase showing that I use the same tile on her complete project. These are the same tiles (same lot and box). They were not a breeder just left under the platform has suggested by ****************. She took pictures of the platform during construction, which showed an active work area, and use those pictures as presentation of the finished product. She wanted me to take the platform up after completion to show her that there was nothing left under there. There was an electrical whole opening which allow me to take pictures from all for directions, and shared with ***************** to show that the area was clean under there. ****************' reply was OK if you say theres nothing under there. The floor on the platform was cutting installed in the same direction as the supporting walls. ****************' concerns, wear a dress properly, and in a professional manner. It appears that **************** his plan was to get someone professionally to complete the majority of her Project, terminate them, and then hire her existing handyman to complete the project at a fraction of the cost.

      I am willing to work with her to get all issues resolved. She prohibited entry in her home, which means that we were unable to complete the final touches or cleanup of the worksite. A letter has been sent to **************** stating that we are willing to work with her to get her issues resolved, since she has decided only to deal with us through written correspondence.

      I am rejecting this response because:

      ****************** has fabricated most of his story however I will rebuttals his statements and correct same.  The initial day he was to start on my home was December 6, 2022 and I called him he did not call me.  When I phoned him to ask if he was started he said he needed two more days to complete a project however he finished the project the next day and wanted to start then.  He is correct when he stated I phoned him and told him I needed to remove more items from my basement and that I lived alone and had to wait on my nephew to assist me I asked if he could give me another week and if he had to move onto another project I understood.  On that following Sunday I texted him and told him I had cleaned the basement.  The first day ****************** did arrive He is correct I had not dismounted my TV when he phoned me that it needed to be removed it was not 3 hours later and he did not come back a week later after the first day he arrived I came home immediately and my neighbor and a co-worker helped me to remove the ***  ****************** was not even there he had left to go pick up the rental machine to tear up the tile on my floor and theatre platform.  

      ****************** is also not correct when he states we never spoke of sub-contracting I specifically asked him and he stated he would be doing most of the work and may have to acquire help with some things.  Im certainly not sure why he said he brought students to help him clean up because the basement was never cleaned from one job to the next items were moved around.  The female he brought the day that I showed him the debris and he placed the plywood on the platform was not cleaning up she was nailing the play wood to the platform along with him.  If I used old pictures to show him debris that I removed from under the platform then he should not have had a problem removing the plywood the two times I asked him to clean under the platform.  

      On several occasions just as my letter spoke of I tried to show ****************** and speak with him about areas that I was not satisfied with and every time he had something sarcastic to say and blew it ******************* department did respond to my home the day the smoke detector went off I can certainly verify that through the fire department for documentation if he was in the basement he would not have known my sister meet them at the door and explained why it went off.  The first contractor did not say he could not complete the tile on the platform ****************** knows that he and the contractor could not come to an agreement on measurements and he would not pay the contractor the additional money he wanted to charge so the contractor told him he wasnt gaining to tile the platform.  I sent pictures of the three different tiles that are on my platform, my floor and the bottom portion of the platform, no other contractor has been to my home to work on anything in my basement.  

       

      I did indicate to ****************** that I was not meeting with him at my home without a mediator or someone other than us because he has done nothing but fabricate the truth.  I have no intentions nor do I desire to try to pocket any insurance money nor do I need to do so.  Any one the better BBB can send to my home along with ****************** is welcome, nothing has been touched other than me trying to clean to rid my home and HVAC system of the dust.  If ****************** is so correct in everything he has indicated and is honest as he states then I will pay to have the tile on the platform as well as the plywood removed where I can guarantee that is still quit a bit of debris that he never cleaned up prior to sealing the platform and tiling same.  I stopped the work because none of my concerns was being addressed and he just wanted to keep working.  I believe in paying people what I owe them and I dont try to get over on people.  Just because hes been in business doesnt mean he honest or does everything he says.  Im disputed to pay the balance because the tile on the platform is not the same tile nor is it tile properly.  He is correct in saying yes there is still work to be completed he didint charge me for what he didnt complete, however what about the work I would have to have done over to be completed properly.  he also removed all my doors and frames as well as closets. He also owes me for a vanity he removed.  Im willing to meet but i will not meet with ****************** or enter negations with him without a negotiator or mediator because he doesnt tell the truth.  Again I can produce anything that I have said in this or my first response.
