      My request is very simple but I can't get the business to take the appropriate action. I had previously used ************************* to represent me in a real estate transaction. **** is now with the business Worth Clark Realty. My experience with **** was not good - I would never use her again and I would never recommend her to anyone. I have made this very clear in previous communications to Worth Clark and to *************************, both through their website contact portal and via a phone call to the Office Manager. With each communication, my only requested action has been to remove me from all Marketing mailing lists so I don't continue to receive marketing materials such as the item attached in today's mail. I think this should be an easy and obvious request, and would save them from mailing to an individual who would never use their services. Can you assist me in making this request to Worth Clark and *************************?Thank you for your assistance.

      Hi Ed,

       

      I'm sorry that you are being contacted when you do not want to be, and I'm sorry you felt like you had to file a complaint with the BBB to be unsubscribed from communications. While I do not know your hisotry with *************************, I did check all of our databases here at the company for your name, email, and phone number. Here is what I found:

      - I checked our phone records and we do not have ANY record of a call to or from our office and your phone number listed in your complaint *************). Therefore, you did not call Worth Clark Realty or speak to our office manager. If you did, our call records would indicate that. Attached is a screenshot of a call search I performed myself within our call records.

      - I checked our transaction records and your name does not pull up. Therefore, if **** ever performed a transaction for you, it would have been when **** was at a different brokerage, before she affiliated with Worth Clark Realty. See attached screenshot of no transaction records associated with your name.

      - I also checked our online records to see if you submitted your information through a contact form on our website. It appears you did submit your contact information through a lead form on our website. The way it works is that we outsource our lead warming to a company called Realtor.com, who then will attempt to contact you because you submitted your information through a contact form. You would need to contact them to op-out of being contacted. For the record, I did go ahead and make sure you were "unsubscribed" from any contact from our company, which you can see in the 3rd attached screenshot. 

      So, I will contact ************************* and ask that she remove you from any contact list she has. She is an independent contractor who maintains their own database of clients and contact information, separate from our company of Worth Clark Realty, therefore she would have to perform this action if she has been personally contacting you. Again, we apologize for your inconvenience and will consider this matter resolved. Thank you for bringing it to our attention.

      Per the note, sending the most recent marketing materials, which they continue to send even after I've requested multiple times that they take me off their list.  Their description of the situation is false and mis-leading, so hopefully the attached shows what they are actually doing.
