I signed a contract for ordering & installation of an out door lift at my lake home in Kimberling City, MO on 3-20-21. I paid 50% ($17,000) down but later was told the lift could not be installed. Unknown to me the contract had a cancellation clause that penalized me 30% of the project cost ($10,200). After protesting I received a $12,000 refund, leaving me $5,000 short of my down payment.Business response

Please see attached Signed Contract executed by Mr *******. Note that in the Box Acceptance of Proposal he accepted the Cancellation charges that are clearly typed above his signature. He signed Two Proposal just like this. The First concept was designed and engineered for him, he was unwilling to move forward with due to cost of other work. This second Proposal was abandoned by him for the same reason; the construction was too much expense. Our Company, Our Manufacturer and a Builder were engaged to design and propose a solution. CHE went above and beyond normal design and numerous trips and meeting with our design team to develops a solution. Over 10 hours of Concept drawings were created to show him exactly how the systems would look. We even refunded Far More than the Cancellation policy he signed for. His attempt to cause harm to my company is bordering on defamation. I instructed my Accounting department to send a Full refund to him. If he has not received it yet, I will confirm and be certain he gets his refund in full.Customer response
