On or before October 15, 2022 Harry Browns dealership in ********* ********* ran five hard inquiries on my credit report without my authorization, When I talked with **** at the dealership and questioned the transaction, they told me they ran my credit to anticipate a sale ? As stated I did not authorize sign for or even step foot inside the dealership that day. They also admitted to me that they ran my credit without my authorization. *** asked the dealership multiple times to contact credit reporting agency to have Inquiries reversed they said they do not know how . They just told me to get a lawyer. They have not contacted me with a resolution, and how they can fix this, in the ****************** This is classified as an FCRA violation. And it is against the law to check somebodys credit without prior authorization.

      Business response

The October credit submission was not for a sale, as ************ states, but an extension of his July transaction. On July 1, 2022, ************ purchased a new Chevrolet Silverado from **. Sometime after July 1, ************ requested a replacement vehicle from General Motors. ************ and General Motors agreed to replacement terms. We were provided paperwork from General Motors for the replacement vehicle, and had a delivery date scheduled with ************.  In preparation for that replacement vehicle, which required a payoff of the original loan, and an updated loan on the replacement vehicle, we sent Mr. ***** updated information to lenders for an approval. ************ arrived at our dealership at the scheduled time for delivery, and subsequently ************ refused the replacement vehicle he picked out and had approval for from General Motors.

The credit agreement that *********** signed in July states: You agree that we may obtain a consumer credit report periodically from one or more consumer reporting agencies (credit bureaus)in connection with the proposed transaction and any update, renewal, refinancing, modification or extension of that transaction. You also agree that we or any affiliate of ours may obtain one or more consumer credit reports on you at any time during the term of your financing

Harry Browns is not in violation of the *****

It is important to note that we have ceased communication with ************, who voiced vile personal verbal attacks to multiple dealership personnel and owners, made accusations of misconduct, and has made threats of litigation. At this time, if he desires to work with us on a solution, we feel it necessary that ************ address his verbal attacks and accusations of misconduct.

      Customer response

I am rejecting this response because:
As I stated before, I never authorized anybody to run my credit which they also admitted to I told them Id be paying this note off in cash if there was to be any type of re-purchase/replacement vehicle so that it did not affect my credit, I had mentioned this multiple times, Harry Browns did this to protect themselves to make sure that payment would be there during this anticipated, transaction which never happened. I never stepped foot in the dealership due to the horrible condition of the replacement vehicle that they had for me, which I had never even seen in full sunlight until that day It also had multiple warranty issues nobody in their right mind would have accepted the vehicle. After reading their response, it seems to me that they refuse to correct my credit as to their feelings has been hurt. So it is OK for them to run somebodys credit without their permission? Does the fine print give them authorization and not even contact me about the transaction? As I stated before, I did not authorize Harry Browns in Fairbault to run my credit again on October 15, which ended up with five hard inquiries on my credit report.
