My credit reports show an alleged account with inaccurate information. The **** requires that all data on a consumer's report be 100% ACCURATE, 100% VERIFIABLE, and 100% TIMELY. This means no data can be reported that isn't 100% accurate. I checked my credit reports and found this assumed collection account ************* @ $5,584.00 from this company with different and inaccurate opening dates, balances, first date of delinquency, balance due, and/or last date of activities for their same exact account. I have never had an account with this company, had any record of first notice of debt including rights to dispute from this company, nor informed by a representative that I had a right or timeframe to dispute this debt.I never signed any type of acknowledgement receipt from a mailing service for any mail from this company. Had I signed a receipt of notice for the legal documentation required, I wouldve responded asking for verification of debt or copy of court ordered judgement well within the 30 days allotted, forcing them to cease collection attempts until proof of verification is complete. Not only did they break FDCPA communications protocol, but they also broke FDCPA False or Misleading Representations protocol as well. A debt collector, in collecting a debt, may not use any false, deceptive, or misleading representation. Specifically, a debt collector may not falsely represent the character, amount, or legal status of the debt, or of any services rendered, or compensation he or she may receive for collecting the debt. A debt collector may not communicate, or threaten to communicate, false credit information or information that should be known to be false, including not identifying disputed debts as such. Each of my 3 credit reports show different, inaccurate information. This is considered false and misleading representation by this company. I received a letter dated August 4, 2023 from All Debt Solutions, dba the 1st Class Agency with reference number ***** for a debt from ************ LLC in the amount of ****. This is not a debt I owe as per contract with ************. I have contacted ***************** asking for validation of this debt and in discussion with them directly.A man by the name of ************************* contacted my sister at home, harassing her about this debt and also calling my elderly parents as well. This individual, ************************* has yet to call me. (My sister, a ** attorney is more than happy to attest and provide phone records of this call).I contacted ************************* at the number provided to my sister as well as the *** number he dialed through. I asked for *************************, he promptly hung up on me. I called again, and he hung up again.I am asking for assistance to have ************************* and the All Debt Solutions *** dba The 1st Class Agency cease and desist all contact with anyone other than myself at this time, especially from harassing my elderly parents. Thank you.

      **************,

You state that after receiving our letter, you opted to contact ************ yourself. Had you reached out to us as should have been done, none of the following calls would have been necessary. Please be aware that the telephone number you provided in this complaint was not provided to us by our client. If ************ had or should have had and provided this number, I apologize on their behalf. With respect to the two phone calls. My team may call any and all numbers associated with an individual or business never being sure of exactly who we will reach, whether it is an elderly individual or a sibling who is a member of the bar. The purpose of those calls is to obtain an effective way to reach a debtor, in this case you. You allege that we discussed your debt with your sibling. While your indebtedness is commercial related and not consumer, discussing the debt would certainly have been allowed, it was specifically not, despite the inquiries she made. While we are not prohibited from discussing debt of this nature with a third party we tend to hold off unless necessary as a courtesy. Additionally, you refer to our calls as harassing. Harassment at a bare minimum is repeated unwanted contacts without a reasonable purpose. In this case, there was one call and it had a specific and permissible purpose. Lastly you indicated that you called our office several times and ****** just hung up on you. I see no record of the number you provided or any other number we found associated with you having called our office whatsoever. Furthermore, it makes no sense that one of our reps would hang up on you since the whole purpose was to speak with you.
To address your dispute; Our notes state EARLY ACCOUNT TERMINATION: CURRENT ANNUAL TERM COMMENCED ON 01/28/2022 LEAVING 8 MONTHS REMAINING OF TERM. 8 MONTHS X $99 DC PLUS = $792. In order to have a more productive exchange with you, we have sent documentation from our client to you by mail, so we are all on the same page.
As for your request, if the telephone number you provided is a suitable number to reach you on and we can continue to communicate using it, there would be no need for calls to any other number.

      Complaint: ********

I am rejecting this response because:

This business continues to state they may contact us despite having zero relationship with them.  We have never been provided any assignment of debt by ************ or any evidence whatsoever this debt is actually valid.

This business not only fails to address me by my proper title but also fails to provide who is writing the response.  The ghost writer in the response asserts my statements are false.  ************************* did in fact represent your organization in an unprofessional and poor manner.  He is your employee to handle. As a business and human, he or anyone from your organization who conducts themselves in a manner as deceitful and improper as him, shall be dealt with by us. I did in fact make the calls I stated.

You assert you (whomever you are) kept quiet as a courtesy.  Please note that any public attempt on your part that results in any harm whatsoever shall be considered either libel or slander (depending on your methods) and will result in a lawsuit against you.  It was not so much a courtesy but it appears you know this as well.

The manner to which this business has conducted themselves appears to be a scam that anyone can attempt.  I will await validation of debt and proceed through the ************ channels from there.

I am also available to meet in person to close out this matter you have created.

Again, my proposed resolution is to close your file and move onto an individual or organization that actually owes a debt.

      Sincerely,

      *****************

This company calls the wrong individual with the same name of person they are looking for and calling family members also. I know they must just go through internet looking for names...but this is not the way to look for someone that owes you money by calling the wrong individuals.

We searched for this person and inadvertently contacted the wrong ****************** and prior to that attempted to acquire proper contact information through his daughter.  We apologized and informed him that we would not contact him or his daughter again and remove their telephone numbers from our data base.  I'm not sure what more we could have done for this gentleman but we have closed it on our end.

Last year an architect David H***** worked with a contractor who was going to add 2 additional rooms to my residence. David H***** came, did not take measurements, and walked around for 5 minutes after I paid his original fee. He sent blueprints that were only enlarging existing rooms here and dent another invoice. I contacted him and the contractor stating the blueprints were wrong and I wanted them fixed. The contractor never was heard from again. David H***** has an incorrect name and address on the blueprints. I stated this plus there was no contract with my signature agreeing to anything. He sent this to collections. I advised the collections agency of the incorrect address and incorrect name along with the situation in an effort to work this put. The was added to my credit report. I want it removed with no further contact from the business.

In short, please see more information in the attached file (AllDebtSolutionsComplaint), I had a foreign exchange student from Germany living with my family last fall. He was on the high school football team, contracted COVID, and needed a COVID release form to resume play. I took him to a urgent care called Edicine (also explained in the attached and named in a separate complaint) that, long and short, sent us to All Debt Solutions without sending us prior bills, except for one that we received well after we returned from a vacation. Otherwise, we had no other forewarning AND Edicine has never sent us evidence of these bills despite numbers of attempts/requests, also in that I have a legal right to a full file. In addition, this student gave full authorization to Edicine to charge his credit card, with all credit card information included in the attached. They never charged, never attempted to charge according to him, etc. They just turned me, as the host mother, over to All Debt Solutions to collect a now largely inflated fee. No explanations of these fees have been explained in writing or otherwise, by either party. They simply just want their money and I have had zero chance to resolve this, although the file is MUCH more complicated than this. Again, please see the attached file for more information. All Debt Solutions, however, has been just awful, all around. The first phone call I received, ever, was left in a manner accusing me of not responding to any of their prior attempts to resolve this matter. This phone call also came through a rerouted number. The number left in the voicemail has multiple concerns posted online about the company's legitimacy. I still called back and was antagonized, bullied, attacked on personal grounds for dodging my debt, etc. Absolutely nothing was offered in terms of solutions, beyond paying them the now $500 plus for a student's debt who had at the time been back in Germany 10+ months then. See more in attached please. Thanks!

Business Response /* (1000, 5, 2022/02/02) */ We have done everything we possibly can to accommodate this consumer. We have provided her with all of the documentation supporting this debt. Each time we've had an opportunity to speak with her on the phone about the situation she over speaks us, refuses to hear us out, and attempts to dominate all conversation. We continue to welcome a discussion with her but she does not behave professionally. I'm not sure what more we can do to help in this scenario. The debt itself in our opinion is what is driving her frustration, this we can not help. If w can help in any manor please advise. Consumer Response /* (3000, 7, 2022/02/04) */ (The consumer indicated he/she DID NOT accept the response from the business.) (1) We have done everything we possibly can to accommodate this consumer. False - I have repeatedly, during two phone calls, asked for a full file, to which I have a legal right and which they were to have accessed before sending me their letter and their version of my full file. Again, missing from this file are the bills that Edicine allegedly sent me, up until we received the final notice (we had the same address the entire time) that this student's file was being turned over to a collection agency in my name. Edicine says that only All Debt Solutions has the right or authority to solicit that information and All Debt Solutions says the opposite, that I can do that myself, essentially. I know, again, that it is my right to a full file so that I can pay or contest as charged. With All Debt Solutions, though, they apparently believe I am to just pay. Makes collections easier, I suppose. (2) We have provided her with all of the documentation supporting this debt. False - see my response immediately above. I literally have zero bills in my file, to which you also can attest given I attached a complete copy of everything I have in this matter as part of my official complaint. (3) Each time we've had an opportunity to speak with her on the phone about the situation she over speaks us, refuses to hear us out, and attempts to dominate all conversation. False. If anything, the opposite is true. See also All Debt Solution's Google reviews in which the majority of complaints also point exactly to this: All Debt Solution's unprofessional, rude, condescending, etc. behaviors (defined by review authors in multiple ways), as noted in general and specifically naming Robert D***. Unfortunately for All Debt Solutions, there is a patter that directly speaks to their professionalism, again, in general and specifically as pertinent to Robert D***, in such problematic behaviors. Another case in point that I did not note in my official complaint was that the last phone call I had with Robert D*** (the second of two phone calls), he incessantly insisted that I, no doubt, had received "monthly statements" from Edicine. Each time I tried to explain, or rather remind Robert D*** that Edicine is an urgent care, not an electric, gas, or other company that makes "monthly bills" a habit he, again, incessantly insisted I was wrong and I simply missed my "monthly bills." It was more than ridiculous and absurd, so much so that I did have to laugh, partly out of shock, after the phone call ended. (4) We continue to welcome a discussion with her but she does not behave professionally. False - They have not reached out to me but once; although, this I understand given this could be perceived as harassment by a collections agency. I have not reached out to them again given two of two phone calls were the two worst phone calls in my life, ever, with any "professionals" or "professional" organization. On that note, I take pride in the extent to which I behave professionally. It is what I do on a day to day in highly professional and high-stakes settings, as well as legal settings when I am called to court (I am often called as an expert witness on matters of professional behaviors, evaluations, and decisions). Not that you need my resume, or references for that matter, but I can certainly attest to the fact that my professionalism is certainly not the issue here. Again, please see All Debt Solution's Google reviews. While these are anecdotal and likely not representative of all customers who have ever interacted with All Debt Solutions, there is certainly a pattern with the majority of reviewers saying essentially the same exact things, all of which could be categorized as critiques of All Debt Solution's and All Debt Solution employees' professionalism, or a lack thereof. (6) I'm not sure what more we can do to help in this scenario. False - this was the main reason I called the second time. Solutions already offered. First, they can drop the charges given all of the above but mainly on the fact that I have been denied my right to my full file, that I would have contested with Edicine before it was turned over to All Debt Solutions had I received it. Again, all requests for proof of all bills that Edicine alleges they sent still have yet to be turned over to me or All Debt Solutions (although All Debt Solutions has apparently not asked in that they believe that is Edicine's reponsibility, too). Second and related, they can contact Edicine for my file, should they want to continue their pursuit of now over $500, but if that is done I still have a right to a full accounting regarding how the once $120 bill, turned into an over $170 bill, that has now turned into an over $500 bill. Not having this information not only lacks transparency, but also implies people like me are to just trust All Debt Solutions that this is just simply what they owe and how to pay. Perhaps it is easier for All Debt Solutions to collect money this way. No explanation whatsoever, but I would say bullying tactics for sure (which is also unlawful of any collections agency). Third is that when I called Robert D*** the second time, I told him that this foreign exchange student's mother, who lives in Germany, was willing to pay $200 to get me out of this mess. Robert D*** was explicitly insulted by the offer, saying something to the effect that he "would never entertain or take such an offer back to his client." What more can they do to help? I was the only one who actually offered a reasonable "solution." (7) The debt itself in our opinion is what is driving her frustration, this we can not help. False, and a bit funny I must say. Before I first wrote my Google review (that was their 35th review but that has since disappeared - I will come back to this momentarily), I was actually surprised to see how many others had experiences with All Debt Solutions just like I had. Now that they are down to 34 reviews, important to note is that authors of these 18 of these now 34 reviews (53%) have written essentially the same things, about All Debt Solutions in general and Robert D*** (and a few other employees) specifically. Prior to writing my review, though, I also noted that a small handful of reviewers questioned the legitimacy of the company and some of its employees, but one or two also suggested that All Debt Solutions was likely self-generating their positive reviews, for a few reasons including the inordinate amount of negative reviews. With this allegation, and without any proof whatsoever, I would tend to allege the same thing. So, in my own review, I noted how All Debt Solutions only responded to their positive reviews and not once responded to any of their negative reviews. I also wrote something to the effect (I would copy/paste if if still there) that All Debt Solutions probably does not respond to negative reviews given the probably (conveniently) assume that those who are writing such reviews are also, as they are now alleging against me, "frustrated" with my debt. As you can see for yourself, the folks writing many of these negative reviews actually went back to settle their debts with the original organizations to which they agreed monies were due. Put differently, they owned their debt and paid it, they just (essentially) refused to work with All Debt Solutions to resolve anything, because resolution with All Debt Solutions was, as they also alleged, was absurd if not impossible. All Debt Solutions responded to my allegations, but that is gone now too. On that note, the first time I posted my post they responded to me, and only me (given this was the first time they ever responded to a negative reviewer), after which the post disappeared. I revisited Google's policies and procedures on posting reviews about businesses to make sure I had not violated any Google rules. When I deemed I had not, I re-posted my review (that I can now not find in my files) to come to find out, as I am writing this response, that it is down again. I do not know if All Debt Solutions has the power to get a review removed from Google, but something seems to be going on here...about which I do not care much anyway in that I am now onto you all with the BBB. Finally, I should add that I have an excellent credit rating. I pay all of my bills, unless unjust which is the case here. Related, I'm not at all frustrated with an unpaid, now $500 bill (that I will never pay). Indeed, what I am frustrated with is all of the reasons stated within my official complaint and herein, against All Debt Solutions, on principle alone. I do not need a loan for a new house, or car, or anything like that for the next seven-plus years. Hence, it is ONLY on principle, and on behalf of others who might come into contact with All Debt Solutions in the future, that I am taking this complaint as far as I have. (8) If w can help in any manor please advise. Business Response /* (4000, 9, 2022/02/07) */ We have closed the account in our office as of today and returned it to the original creditor. Consumer Response /* (2000, 11, 2022/02/11) */ (The consumer indicated he/she ACCEPTED the response from the business.)

They contacted my former employer on April 14 instead of contacting me directly. My cell phone is immediately found when you google my name, and they had this information from the medical provider. They had to go search for my employer's contact information, CONTACTED HER FIRST, and let her know that a debt collector was looking for me. This was done as a scare tactic, and a way to try to shame me into paying a debt that I dispute the validity of. They failed to provide any documentation to provide proof of the validity of the debt as requested.

Business Response /* (1000, 5, 2021/11/29) */ To Whom it May Concern, In response to MS. C******'s complaint we have reviewed all of the activity on the account and will present it in this forum. Ms. C****** accuses us of contacting her for the first time at her place of employment. This is simply not true. We sent her a Validation notice in December of 2020 which was not returned to us, it went unanswered. We called her cell phone 3 times in January 2021 and left messages, she never returned the calls. We called and left messages 2 more times on her cell phone in February 2021 and still no return call. A third call was made to Ms. C****** on February 26, 2021 where Ms. C****** finally answered our call. She said she never authorized what the bill was for and hung up on our collector trying to discuss it with her. We called her cell phone 2 more times in March 2021 and left messages, and again no return call. So we have now called her 8 times on her cell phone between Jamuary 2021 and March of 2021 and no return calls. Ms. C****** is creating an untrue scenario that we didn't try her on her cell phone before her place of employment (not that it is a requirement). We then obtained a number on April 14, 2021 to reach her at her place of employment which we called. We asked for Ms. C****** and her supervisor told us that she was not available and that she would leave her a message. We did not ask her to do so, she did it on her own. Ms. C****** then returned our call a few minutes later and said she didn't want to resolve the bill and hung up on us. We waited a few weeks and called her cell phone on May 10, 2021, she answered the phone and when we mentioned our creditor client Ms. C****** hung up on us immediately. Ms. C******'s recollection of the fact pattern is completely wrong and she has no right to besmirch our company. We operate a very fair and ethical company and follow the regulations. Why Ms. C****** would file a complaint and make up information to try and make us look like we did anything wrong whatsoever is beyond me. We ask this complaint be removed from our record as it is utterly false. Thank you, John T****** President Consumer Response /* (3000, 7, 2021/12/03) */ (The consumer indicated he/she DID NOT accept the response from the business.) In reviewing my phone records, I have absolutely zero phone calls from them, nor do I have any voicemails. I do not delete any of my voicemails, and have screenshot all available voicemails during the January time period. Additionally, in reviewing my phone records for January there are zero calls from the 3 numbers I have for them. There has been only one call with a voicemail and that initial call was done after they called my employer. The three numbers that I am aware of belonging to this organization are : The phone number they called from on April 22 ***-***-****, the number they had for callback ***-***-**** and ***-***-****. None of those numbers are on my phone records or have left a VM. Business Response /* (4000, 9, 2021/12/07) */ In response to the consumers reply, we went back and pulled all phone logs and every call we stated made, was indeed made. This included voice mails and also the call where we " actually spoke to the consumer directly" and she refused to resolve the situation. We have logs and recordings of these calls, therefore our records are correct and we can't understand this consumers continued position when we have actual recorded proof. Thank you Consumer Response /* (3000, 11, 2021/12/08) */ (The consumer indicated he/she DID NOT accept the response from the business.) I provided them with the three numbers I have for them, but have not been told what numbers they were calling me on if they were different than the three numbers I provided. Additionally, when I had disputed this debt, I still have not received any documentation of this debt. Business Response /* (4000, 14, 2021/12/15) */ Full documentation has been supplied to the consumer, including all signed agreements.

Sabrina B****** contacted my mother first and lied regarding what this debt was for, causing her stress. She then lied to me regarding when the debt would be reported to the credit bureaus and her ability to negotiate the debt amount. Her tone was harsh, she interrupted and talked over me several times. I'd like to resolve this debt in a reasonable manner, but I do not believe that is possible while working with Sabrina. I would rather fight through the process at this point and work with the original debtor than work with Sabrina. I'd like to be contacted by an alternate employee, she did not indicate that was possible.

Business Response /* (1000, 5, 2021/08/30) */ To Whom it May Concern: The consumer in this complaint states that we contacted her mother instead of her directly. We were attempting to confirm location information by contacting her mother only. We never gave any detail to the mother whatsoever, no mention of any debt at all, let alone "owned property". The consumer accuses the collector of "lying" in that she didn't know when the account would be reported to the bureau's, this is indeed true. Our collectors do not know when the accounts are reported definitively. We spent about 45 minutes trying to assist this consumer and she just wanted to argue with us. We have requested supporting documentation from our client to supply to the consumer. Sincerely, John T****** President
