I hired Kneeland Construction to perform structural work on the main part of our house and to build two additions. Most of the work was eventually completed (though not yet inspected by the city); however, there are outstanding items that have not been completed and I am also owed a refund for overpayment. Kneeland has been unresponsive to requests to complete the work and issue a refund for overpayment: Laminated veneer lumber used in the garage addition needs to be fastened with lag screws in accordance with manufacturers specifications; Parging of concrete block specified in the contract has not been performed; The garage concrete slab was not protected from rain after the pour and suffered damage. I offered to repair the damage with my labor if Kneeland provides the correct repair product (according to manufacturer's tech data). Kneeland provided a product that is inappropriate for the damage (cannot be used for shallow repairs); I overpaid Kneeland $1615.00 & have asked for a refund on many occasions; Kneeland destroyed two lengths of city-owned sidewalks in front of our property by driving full concrete trucks, multiple times, over the sidewalks. Winchester Public Works expects Kneeland to repair the sidewalks, but they are refusing. I do not know what discussions, if any, have taken place between Winchester Public Works and Kneeland. There is a clause in the contract between Kneeland and me, stating they are not responsible for accidental damage to sidewalks. In this instance, the sidewalks are not mine, and the damage was not accidental (the subcontractor continued to roll the concrete trucks over the sidewalks after initially causing damage and after I asked them to keep the trucks on the street). The city is not holding me liable for the sidewalks at this time -- this is primarily for awareness; A city inspection for Kneeland's work should happen in the next few weeks, and additional problems could ariseCustomer response
