      I am a retired military veteran of 22 yrs of honorable service to this great country. On July 8, Mr. **** ****** of Merchants and Farmers bank pulled my credit report without my EXPLICITE written consent and after the fact sent me documents to sign. I was applying for a land loan in ******** LA. I believe Mr. ****** misled me from the beginning of the process. He did not provide me all the information or a plan to proceed in the application process. He rushed through the process. This violated my right as consumer under the **** and truth and lending act. He is the vice president and should have known better. I have attached an email by Mr. ****** stating he pulled my credit and then sent me the papers to sign. I have address the issue with Mr. ****** and he is unwilling to provide a resolution. All I wanted is for Mr ****** to sent back to 3 credit bureaus to remove the unauthorized inquiry.

      Business Response /* (1000, 8, 2021/08/11) */ COMPLAINT ACTIVIITY REPORT Case #XXXXXXXX Consumer states that the bank pulled his credit report on 07/08/2021 before he gave consent - please review the timeline below: At 09:40 am - Central Standard Time (CST) - the Consumer e-signed the credit application, which gave bank consent to pull credit report. At 10:49 am - Central Standard Time (CST) - the bank pulled the credit report. The confusion appears to be that the e-sign application uses Greenwich Mean Time (GMT) and the credit bureau uses Pacific Standard (PST) and the bank is on Central Standard Time (CST). Application time: GMT of 15:40 equates to 07:40am PST or 09:40am CST. Credit bureau time: Pulled at 08:49 PST or 10:49 CST which equates to 16:49 GMT. The bank had his signed permission to pull the credit report and our loan officer followed our normal guidelines and procedures in processing this application. There was no violation of the consumer's rights in processing this loan application. Consumer Response /* (3000, 10, 2021/08/12) */ (The consumer indicated he/she DID NOT accept the response from the business.) the bank and Mr. ****** is not telling the full story. I received and alert from my credit bureau then I sent Mr ****** an email asking why he had pulled my credit without my permission. He sent a reply stating he had pull my credit and then sent me the forms for me to sign. Business Response /* (4000, 20, 2021/08/30) */ Please review the following timeline: 7/8/2021 at 9:40 am Central Standard Time - Credit application e-signed (which gave bank permission to pull credit report) 7/8/2021 at 10:49 am Central Standard Time - Credit report was pulled 7/8/2021 at 11:05 am Central Standard Time - Sent a copy of the Credit report to applicant to sign and initial. 7/8/2021 at 2:17 pm Central Standard Time - This email explains that the credit report was pulled and documents were emailed to applicant to sign. Sent: Thursday, July 8, 2021 2:17 PM Subject: RE: EXTERNAL Re: EXTERNAL Re: 2020 & 2019 tax returns. This is for my military pay pension. The VA Disability is not taxable. I pulled your credit and then emailed the docs to you to sign. After you signed them I had to type up a loan summary to calculate the debt to income. The credit report has to be signed before I can review the loan. I tried everything I could to do your loan, I didn't deny your loan purposely. We have guidelines we have to follow. Please see explanation for email on: 7/8/2021 at 2:17pm When the officer stated in the email above: "I pulled your credit and then emailed the docs to you to sign" and "The credit report has to be signed before I can review the loan" both of these statements are referring to the credit report not the credit application. After the credit application is e-signed it is the normal procedure for the officer to pull the credit report and forward a copy to the applicant for his signature and initials. The credit application was e-signed at 9:40 am CST on 7/8/2021 which gave the officer permission to pull the credit report. There were no violations of the consumer's rights. Applicant may be misunderstanding (credit report and credit application). Consumer Response /* (4200, 22, 2021/08/31) */ (The consumer indicated he/she DID NOT accept the response from the business.) I reject the excuse of merchants and farmers bank.
