Summary: I paid $5,000 to enroll in a Fishback trade recommendation service which guaranteed a full refund if the program was not profitable. The program was not profitable during the one-year enrollment period, but Fishback refused to honor the guarantee. The details: On July 16, 2021, I paid an enrollment fee of $5,000 for a one-year subscription to the Easy Options Profits trade recommendation service from Fishback Management and Research, Inc. A promotional webinar promised that the program was suitable for small accounts ($10,000 to $20,000) and that the program had a money-back guarantee. I actively participated in the program for one year following Fishback's trade recommendations. At the end of the year, I had lost several thousand dollars in following the trade recommendations. On July 24, 2022, I wrote to Fishback requesting a refund. I included copies of brokerage account statements. Fishback refused to honor their money-back guarantee. In correspondence with Fishback, they claimed that I had not followed all of the trade recommendations. However, I had only skipped the trade recommendations that would have required a larger account size, in accordance with their instructions. I filed an arbitration claim, in accordance with their written agreement for the program. Fishback chose to end the arbitration by choosing to answer the claim in small claims court. In small claims court, I presented my case for why the refund request should be honored. In particular, I showed that their claim that all recommended trades must be taken to qualify for a refund violated their own written instructions for the program. In response, Fishback now claimed that my trades did not follow their capital allocation requirements. Due to the limited amount of time allowed in small claims court, I was not able to adequately respond to Fishback's latest objection to honoring their guarantee. I feel that Fishback has not acted appropriately to honor their guarantee.
