They were supposed to stain my deck and make it into a screened in deck. I supplied the material. They were supposed to sand the deck and they didn't. The finish is very rough and you can get splinters. I paid them $1300 for the materials. He charged me for materials that he didn't purchase. $4300 was what he came to collect today. He has put a lien on my property.

We signed a contract with American Painting **** on 4/20/2022 to get our internal of our house painted. The contract stated that the work will be completed in approx 2 weeks. In the initial stages the work started quickly, but since then we have notices several problems with the work. We regularly reported the lack of progress on the work go ******************* (President) and he would come and visit the house and state that certain work will be done right away or the workers will not leave until certain part is finished. However the workers will leave without finishing the work. They would come the next day and still not focus on the work that was supposed to be finished the previous day. The quality of the work done by workers have been very bad and it was even acknowledge by another one of the employee of American Painting **** Since then I have been threatened by American Painting and several times told that my house will be put on a lien. We have made special accommodation several times to help them complete the work and on few occasions **** and the workers did not show up to complete the work.

************* would not allow us to finish the job.  He kept finding "touch-**** for us to do.  He made us do an enormous amount of "touch-**** looking for perfection.  He was playing games.  He made a check out for $11,000 and then stopped payment on the check, fraud.   I gave him a final invoice and he tore it ** in my face and told me the whole house needs to be painted.

No threats were made except that we would file a mechanics lien if he did not pay.  Not a threat, I followed through.

We did 100's of hours of so called "touch-**** including 1 day when I had 7 men working there.

Batra owes American Painting *** more than $20,000. He just doesn't want to pay.  I asked for a FINAL punchup list countless times and he would never give one.  The job will never be good enough for him, he thinks we will continue coming back as if we have nothing else to do.

Again, he just doesn't want to pay.

      Sincerely,

      *****************

I hired American Painting on September 29th, 2020 to paint & repair the outside of my residence. I walked the perimeter with *****************, the owner to inspect the wood to see what needed to be repaired. His crew started work mid Nov. Towards the end of the project I noticed that a repair was needed on the wood near garage door including replacing weather stripping. He charged me an additional $400 which I paid. I sent an email on Nov 23rd with items still needing attention. 3 and 4 on the list were never completed after following up several times. **** committed to repairing the wood on back of house (4) at no charge. He then on March 24th stated he would charge me for the repair when he previously did not state a charge. I called **** on April 8, 2021 to discuss why the items have not been completed. His response to why it has not been finished is I am not a priority while utilizing profanity. I paid AA in full. I have attached some of the correspondence including a picture. Thanks MK

American Painting contracted with *************************** to have her house painted and carpentry work done. American Painting executed the contract and *************************** tendered to us a punch-list. We completed all but two items on her punch-list. One item is painting one piece of the weatherstripping on the garage door frame. The other item is replacing a board on the back of the house that was never contracted for. We gave *************************** free financing and let her make payments to us in the winter in the form of post-dated checks. The board she is asking to have replaced is not in the contract. I told her I would replace the board for her and paint the board and the weatherstripping on the garage door. Our charge for this service would only be for the board, which I told her would only cost approximately $100.00. She did not want to pay for the wood and basically called me a POS. The weatherstripping that we replaced and the corner board are not in the contract. *************************** thinks I am her personal ********* (ie. Please take down my satellite dish while youre working here.). We completed the job in a professional and timely manner and fully executed the contract. At this point, I have decided that I do not want to deal with her any longer. As far as I am concerned, we have fulfilled our obligation. Thank you!

I am rejecting this response because:

I am disappointed by ********* false and grossly inaccurate response to the complaint. I am not surprised due to his lack of integrity and professionalism. He is correct stating that there was a paper contract however I did pay an additional $400.00 to have the garage door board and stripping replaced and painted. Both parties agreed to the additional work through email communication which is considered a contract. ************ agreed to replace a obviously damaged board in the back of the house on multiple occasions which are documented in several electronic communications.

11/23/2020 - Email sent regarding items (photos attached) that needed to be fixed including the board in back. ******* responded and stated "We are sending the guys out there today to fix everything. Thank you for sending the photos."

11/25/2020 - ************ walked the perimeter of my residence. He viewed the stripping that needed to be painted and the board that needed to be replaced. He verbally agreed to complete prior to my upcoming surgery. He requested that I send a picture of wood which needed to be replaced at the back of the house which I did.

2/22/21 - ************ replied to my email regarding the 2 items that needed to be completed. He again agreed that he would replace the board and paint along with the garage stripping when the weather improved.

3/21/2021 - I sent an email to ************ requesting an update regarding the unfinished work that he agreed both verbally and in written communication.

3/26/2021 - ************ responded to my email stating he was now going to charge me for the work. I did not agree with this because he agreed to repair on four different dates. We came to an agreement that I would pay for the board and he would cover the cost for the labor.

3/36/21 - ************ sent an email stating that he would install the board and paint the garage stripping the following week.

4/8/21 - I contacted ************ to discuss why the outstanding items have not been completed. He responded by verbally attacking me utilizing profanity and stated "I am not a priority"

************ agreed several times both verbally and via electronic communication to complete the work which is a contract.

      Sincerely,
