      The apartment I am renting was advertised as a non smoking apartment building. There is constant smoking of THC concentrate by my neighbors that is intoxicating even in my apartment. I have had to buy a respirator to wear inside my own apartment to not become intoxicated from the fumes. This has been a complaint that seems to get resolved for a month or so at a time but the same residents still live there. The tenants following the lease should not suffer at the hands of those who do not. There is a specific unit that constantly smells of it.

      There appears to be something extremely wrong with this tenant. We just received an emergency call tonight after hours from them in regards to this smoking complaint. They are complaining about someone smoking in a basement area. This tenant making the complaint lives on the third floor yet is somehow impacted by THC from 3 floors below them. They have made previous unwarranted complaints and ridiculous demands. We have never detected smoking in their hallway or have we had any other complaints from tenants.  The idea that we can evict a non existent offender instantly shows their lack of understanding of how anything works. They aren't receiving any rent back. In no way have we ever guaranteed this building to be smoke free. This tenant should review their smoke free addendum. We have conducted inspections repeatedly but have come to the conclusion that the tenant making this complaint is not a stable individual. They should move at the expiration of their lease and find a landlord that guarantees they can somehow stop imaginary or real people from smoking. We have already responded to a BBB complaint from them letting them know our response.

      I am rejecting this response because: It did not address the issue and harassed the person filing the complaint. There have been multiple emails stating that the property does not allow smoking on it and that it is on the lease.

      We have never held the position that tenants are allowed to smoke on the property. Tenants do sign a smoke free addendum. This complaint itself states that management has sent out notices that smoking is not allowed on the property. That is what we are supposed to do if someone smokes in the building per the smoke free addendum tenants sign. We have never provided any warranty that there would be no smoking or made any representation that we can control what other tenants do. The evidence provided to us has been insufficient to take any further action than what we have done already. The complainant's claim that they are being impacted by THC from an apartment 3 stories below them is ludicrous. The complainant's request that we immediately evict this tenant disregards that this is not an action we can take under existing law. They have been told this already. The complainant's remedy request is neither reasonable nor legal. Therefore we will not take any further action at this point, but will continue to monitor the situation.

      Marijuana vapor strong enough to intoxicate my wife and I has been coming into our apartment almost every night for a week now. This is a health issue that they refuse to address. They sent out an email to residents stating their lease condition of not smoking in the apartment and have made no attempt to actually resolve the issue.

      This complaint is a gross exaggeration of this situation and we find it highly unlikely this tenant is being intoxicated by mirajuana fumes that are passing through the floor/floors and walls. After receiving a complaint from this tenant, we took the necessary step of notifying the building that someone had been smelling mirajuana smoke. This took place last Wednseday (Only 2 business days have passed since our initial email). This tenant has been unable to identify the source of the smoking. No other tenant responded to the complaint so the issue seems to be isolated to one unit if it is occurring at all. A representative from our company was sent out to see if they could smell any mirajauna smoke and they were unable to identify any smoke on Thursday. None of the tenants in this stack just moved in, so if the issue is occurring, it does not appear to be a regular occurring issue. In no ways does this have anything to do with advertising. We do have all tenants sign a smoke free addendum, but in the smoke free addendum we make it clear we make no guarantee that there will be no smoking and we can only enforce to the best of our abilities, which we have done. The tenant is wildly misguided in thinking that we could evict someone in this situation. Firstly, the tenant that is smoking hasn't been properly identified. Secondly, there has been no proof provided of the incident. Smoking mirajuana is legal in the state of ******** so it is incredbly difficult to gather sufficient evidence and we are unable to use the police to help. If the impossible task of identifying the tenant and proving they are smoking mirajuana was accomplished, the eviction process would take a minimum of a year and would be very unlikely to be successful. If we do identify the tenant that is smoking, we will handle accordingly and not offer a renewal and continue to conduct inspections and communicate with the offender. This complaint is absolutley ridiculous and lacks any understanding of how the legal system works or what the duty of a landlord is. It is quite possible we aren't working with a mentally stable tenant in this situation based on the current and past behavior of this particular tenant. We believe we have acted in good faith.
