Hello, I reached out to Charter Fitness last year regarding cancelling my account and was told the cancellation would be effective and my account would stop being charged. I'm out of town so the manager asked that I send an email to her stating that 'I, ***************************, would like to cancel my account' in June of 2022. Since then, my account has continued to be charged. I then changed my debit card number maybe around January and given that they were not able to charge to my debit card that I cancelled, they continued charging my account and because the charges have still not stopped months later, my account has been sent to collections. I have emailed the manager (***** *****************************) multiple times; she's sent me a cancellation confirmation form; but my account is still in collections with ****** and Associates Legal Firm and I haven't received a refund for the amount that has been charged since I cancelled.

Sometime in April/May I signed up to be a member of Charter Fitness in Mundelein, IL. Mid-May I had a medical issue that prevented me from going to the gym so I made the decision to cancel. I had called to cancel and the employee told me to come in person to cancel. I came in everyday for about a week straight, everytime the workers said come back tomorrow. Finally at some point a male worker gave me a half sheet of paper to sign. I asked if that was it he said yes and i left. I was then charged for **** and July so I called my bank. They advised me to cancel my card so I would stop being charged as this fitness center is known to charge customers even after canceling. After no phone call notice and no mailed letter I received a notice from ****** and Associates stating that Charter Fitness has sent me to collections. Ive spoke to the fitness center multiple times now and theyre being difficult, accusing me of never signing anything, twisting my words and basically calling me a liar. Is there anyway you can help with this? I dont think I should feel responsible for this especially since I havent even stepped foot into that gym and what I signed was not documented or noted in my file. Theyre refusing to dismiss the charges saying that I owe them 146$. I dont want this to affect my credit and I dont think I should owe this money especially since multiple reviews on their site have had this issue and I had to cancel my card and they never gave me a verbal or written notice. I dont care that I was charged for **** and July, i dont need that money back. I just dont think its right that their accusing me of being a liar and asking for money even after Ive canceled. Unfortunately I was never given anything to take home after signing the cancellation form and never signed anything in person when signing up, i signed up through my phone and they never followed up. My ****** is learned to make sure I have a copy of signed documents. Is there anyway you can help

      Customer response

      Complaint: 18536878

I am rejecting this response because:

I had originally been told that the money "owed" was $146 now they're saying it's more than that. Please also find attached a photo of the letter I've been sent. She claims the information I gave to the complaint is "odd and different to what she was told." I had called Charter Fitness to cancel my membership and was told I needed to come in person, after coming for a few consecutive days of employees stating that the person who cancels memberships was not there a male gave me a half sheet of paper to sign. He did not have me take a copy of it home. I didn't think to take a picture or anything as I had never had an issue cancelling my membership elsewhere. Whether that is their protocol to cancel memberships or not, I was still given a half sheet of paper to sign stating that I canceled. I was not even able to do physical activity and am only allowed to do it as tolerated. Please find attached my doctor's note stating this information. It is not my fault that the company left it around loosely, threw it away, lied, etc. I don't know the situation, I wasn't even aware I had to "virtually" sign a letter of cancellation on their computer. This was just what I was told. When signing up for the membership I had never gone in person to sign physical copies or "virtual copies". I signed up through my phone on their website and was never followed up with either. After a month or two of still being billed I contacted my bank asking what to do. They advised me to cancel my card as I never signed up with my routing and account number. So I did that and never had an issue until now. Throughout the time of cancellation and now I never received a written letter in the mail stating that I "owed" money. I also never received a phone call from it either. If I would have known the moment I canceled on paper that it was not the correct form of cancellation. I would have gone back and done it the right way but I was not aware until now. Moving forward, if you find attached another photo it states that my membership is currently inactive. Implying that I am no longer a member and my membership is canceled. Lastly, I'd like to add that I am not the only one that has been in this position. Multiple reviews on ****** and one review of the company on BBB state that they have been in my position and that the company had continued charging them and state they still owe money. I do not want to be in position. This isn't fun to deal with and I feel that I'm trying to be taken advantage of as I am a young adult and have been given incorrect information. I am a full time college student, living with my parents and I have never been put in this position before. I am not willing to pay the "overdue balance" as it was not my fault as I was under the impression that I had already been cancelled for months. Please find attached a review from others who have been in my position.

      Sincerely,

      ***********************
