** installed a sprinkler system in my new construction home. The yard was left with rolling waves and is not level or even. I contact the builder who told me that he contacted ** and they would try and roll the yard in the spring. I contacted ** who told me I had to contact the builder. The builder has not returned my call and ** has told me twice to contact the builder. This is the perfect storm and scam.Business response

We were hired and paid by the builder. We are a sub-contractor to the builder. We where never hired by this homeowner. We worked for the builder, not the homeowner. The excavator, not us as the landscaper, does the final grading, which I assume that is what is meant by "Rolling waves". Because there was a lot of digging for the foundation and utilities and sidewalks and other things, the ground does settle and move sometimes and it is nothing anyone can control. The complaint also mentioned warranty or guarantee, but settling in specifically excluded because it is beyond anyone's control and the builder that hired us is well aware of that.Customer response

I am rejecting this response because: ** did a terrible job and messed up the grading. The mess they made looks like they planted corn in rows. I don't care who paid the bills the job they did was awful. Why don't they come out and look at the mess?

The excavator is responsible to make sure the the soil is compacted correctly. We only do the top couple of inches. It was good the day of install. But it changed because of what is lower than what we touched. I cannot control what is under the ground, no landscaper does, that is the excavator. You need to take this up with the builder if you want anything solved. I did look with *** earlier this spring and he agreed it is not our issue.

I am rejecting this response because: This issue is from 2 weeks after you installed the grass. I talked to the builder in late September and he told me not to lose any sleep over the installation, it would be fixed. I've talked to *** several times and he told me you haven't been out to look yet. Why not come and talk to me. When you did the installation I was the owner of the property so the contract you have with the builder was transferred to me upon closing. So you are actually dealing with me. Stop by, *** gave you my number.

On May 31, 2022 I paid ************** $340 to remove two bushes at my moms house. The payment had to be made at time of appointment for them to come out. I sent a picture of the two bushes to be taken out. However, they not only removed the two bushes, they removed two additional mature bushes that were in a totally different area. I called immediately and talked with a *******, she told me she would have to talk to the owner. After a week I called, she said that the owner told her these things happen and they weren't going to do anything about it. Since then I have called multiple, multiple times to talk with the owner to make some kind of adjustment. No one has called me back so I left a message on their website. Still nothing back! I have left messages asking that they at least return some of my money so I could purchase two new bushes which would not be mature like the ones they removed. I am upset that they won't even respond to my phone calls or messages. I feel it is only fair for them to return a portion of my money so I can buy my mom new bushes. Because I paid by phone I do not have a purchase order but do have the proof of payment from my bank statement. Your help would be much appreciated.Business response

Hello, we were asked to pull out 4 bushes and we pulled out 4 bushes and cleaned it up nice. We did what we where asked to do.

They were asked to only pull out 2 bushes, they pulled 4. There were in two totally different areas! Pictures were sent of the 2 that I wanted removed. The other picture were the 2 that was not requested to be pulled. Not Acceptable.

I am rejecting this response because:After calling to complain about the extra bushes taken out, the receptionist ******* admitted to me that because the bushes were so big, she told them there was four. The bushes that were removed when they were not supposed to where in a whole different part of the yard. I sent a picture of the bushes to be removed. So, we requested two bushes to be removed, showed a picture and four bushes were removed not by our request. C & T is responsible to replace or refund money to buy two new bushes that will not be mature as the bushes they removed. Again, it was the receptionist that said four bushes! Not me!

This is the picture that was sent to them for a quote, they wanted full payment before removing the bushes. Everything was done over the phone so receipt was not sent to me. The additional bushes that were taken out without permission were on the other side of the porch. Again, ******* their receptionist admitted she told them 4 because they were large. This is on C&T, I expect a refund enough to buy my mom new bushes that will not be as muture as the bushes they removed without permission.Business response

I am rejecting this response because:To whom it may concern,
I would like to re-open my complaint against ***************** with an ID#********. The company sent a response on the 19th, I rejected that response with my reason. However, I was told your system had gone down and you didn't receive it so therefore the case was closed. I am emailing you to tell you I want it re-opened. This company is a rip off, I did not change my mind as he states! A picture of the 2 bushes and their location was sent to him. They removed 2 additional bushes that were in a totally different area! He needs to refund some money back so I can buy 2 new bushes (which will not be mature as the bushes he removed). This was a gift for my mom at her house. There is no receipt due to all being done thru the phone. I would like this case resolved.

I am rejecting this response because: I do not understand how this business can take out two extra bushes not requested and think that is okay! He should as a responsible business owner own up to his companies failures and repair the damage that they created. Taking advantage of a senior citizen that struggles and lives in a trailer park should be looked frowned upon. I will instruct my mother to spread the news to all her senior social and church events. I assume this is the end of it seeing that big businesses always win!
