I purchased a sectional couch from Turk Furniture and paid for half up front then paid the remaining balance off through chapter 13 bankruptcy and payments to ***************************** However, they are trying to charge me $3,443.56 for fees and past due interest. These assessments are ridiculously high and should be illegal.In addition, I purchased a ******* table and chairs as well as insurance warranty plan. I was supposed to be reimbursed the cost of the protection plan if no claims were filed by me. I did not file any claims and have never been reimbursed. I am asking BBB to look into this matter and have the money due to me paid. Thank you.Business response

To Whom It May *************************** was delivered in 2015. Her sectional purchase, per our records, was paid in full via check so we would not have charged any kind of fees or past due interest. The only purchase under the name ***************** in our system is on a sectional, we do not have any record of a ******* dining set being purchased and delivered by our company. If this was purchased under a different name and address that will need to be provided. The "insurance warranty plan" ************ is referencing was an extended protection plan and is refunded in the amount of a gift certificate which would have been explained to her at the time of purchase. These protection plans are usually 5 or 7 years long and the consumer is responsible for contacting us at the end of the plan to receive the gift certificate.

Hello,In our original response we said this customer paid in full with a check but upon further investigation we learned that the check the customer paid with was returned for insufficient funds after we had already delivered her merchandise. We did contact the customer and gave her a payment plan option through our store which she agreed to and even came signed off on this agreement. We never received any of the payments for the payment plan. We did try contacting the customer numerous times with no response so we had no choice but to turn over the matter to a collection agency. Any interest or fees that she was charged was done so by the collection agency. Attached you will find the return check, payment plan details, and collection agency info.Ms. *********;would not be eligible for the gift certificate reimbursement due to this situation.Thank You,CrissyTurk FurnitureCustomer response

I am rejecting this response because:
This sectional was included in Chapter 11 Bankruptcy for 2 years and payments were made during this time and I have paid $1,700 to the collection agency. These payments have paid off the remaining balance in full. The ******* table and chairs were purchased in **** with the extended insurance plan. No claims were made and a refund of $750 should have been made and was not. The purchase was in my and my ex husbands name, ************************The collection agency charging $3,000 in fees and interest is exorbitant and should be illegal. Please investigate and resolve this issue.

Please view the attached documents. ************ failed to pay the balance of $2,382.56 for the merchandise she was in possession of. We did try to work with the customer directly by providing her with a payment plan option which she agreed to, but payment was never received directly from the customer. It was explained to ************ that failure to pay the balance would result in her account being turned over to a collection agency. You will find in the attached document that Turk Furniture was requesting $2,382.56 from the customer so any amount over that would need to be discussed with the collection agency.
We were able to locate the receipt for the ******* dining set mentioned which was delivered in 2006. The warranty we offer is refunded in the form of a gift certificate at the end of 7 years if no claims are made on the furniture. A form would have been given to the customer at the time of purchase which clearly states that a refund would be given via a gift certificate. The form also states it is to be filled out and returned to the store within 90 days of the warranty expiring in order to receive the gift certificate.Customer response

I am rejecting this response because:The sectional in question has been paid in full and interest and fees, $3,200, should be dropped.
I directly paid Chapter 13 for 2 years and the attorneys made payments to Turk Furniture during that time. Since then I have paid $1,700 to the collection agency and the $750 reimbursement for the extended warranty on ******* table should have been applied to this sectional purchase. Thats over $2,450 that has been paid plus Chapter 13 payments. Nothing more is owed to the collection agency or Turk Furniture.
The BBB and Turk Furniture need to let collection agency know this matter has been resolved and nothing more is due to them or anyone else by me. These $3,200 in interest and fees need to be dismissed immediately.
