I am writing to file a formal complaint against ATG Credit regarding their deceptive and unlawful practices that have negatively impacted my creditworthiness. I have exhausted all other avenues of communication with ATG Credit without a satisfactory resolution, and I am seeking your assistance in resolving this matter.ATG Credit has alleged that I owe them for four debts, which I have no recollection of entering into any agreement with them. I have serious concerns about the validity of these debts and suspect deceptive practices on the part of ATG Credit. Additionally, I am deeply troubled by how ATG Credit gained access to my personal information without my consent, which constitutes identity theft under 18 USC 1028(a)(7).Furthermore, I have reason to believe that ATG Credit is operating as a credit reporting agency, as defined by 15 USC 1681a(f), and yet they have failed to comply with the obligations outlined in the Fair Credit Reporting Act. I have requested proof of permission for ATG Credit to access and share my personal information, and I have yet to receive a satisfactory response.In light of these concerns, I am invoking my rights under 15 USC 1681b(a)(2) and requesting that ATG Credit delete its tradeline on my consumer report. I have also requested an investigation into my dispute, as required by 15 USC 1681i(a)(1)(a), and have not received any disclosure of the results within the mandated 30-day period.ATG Credit's actions not only violate my rights as a consumer but also have significant implications for my credit score and financial opportunities. I am frustrated with their manipulative debt collection practices and their disregard for the law. It is my intention to report these unlawful actions to the appropriate authorities if ATG Credit fails to comply with my requests and rectify the situation.I kindly request your intervention in this matter and urge you to take appropriate action against ATG Credit. ATG Credit responded to the consumers initial CFPB complaint on 3/11/24 stating the following: "ATG Credit has documented the request to cease and desist communication with the Consumer per this complaint. ATG Credit is compliant with FDCPA and FCRA. The consumer was notified of the debt via mail on 4/14/22 and we have made several attempts to contact the consumer to discuss the debt via phone, but we've been unsuccessful. The consumer has not contacted ATG Credit to dispute the debt prior to this complaint. Attached is the itemization of the 5 accounts outstanding with our office. This is a valid debt. We are happy to discuss payment arrangements via phone at ************ or via LiveChat on our website www.atgcredit.com."
The consumer has been provided with valdiation of the debt owed to the original creditor on 3/11/24 via CFPB response. ATG Credit is responsible to report accurate information to the credit bureaus and is compliant with FCRA as these outstanding accounts have not been resolved and are open. The consumer's dispute was validated on 3/28/2022 when the consumer mailed a dispute letter to ATG Credit. ATG Credit mailed the validation documents to the consumer and has spoken with the consumer multiple times. The consumer hangs up on our representatives and refuses to pay the debt. Attached are the documents that were mailed to the consumer to validate the debt.
