In January of 2022 I ordered replacement parts for a Lumex recliner. This is handicap seating. I was guardian of *****************************, who was in a coma at the time. His chair needed to be fixed and it was supposed to be in by April of 2022. That time came and it was not here and they emailed us to inform us that there was a backorder on the parts it would be in in June 2022. This time came and no further communications were made. ****** passed away in September of 2022, so the parts were no longer needed and quite frankly I did not even think about it. I had not been charged so it was not on my radar. In January of 2023 the family received the replacement parts for a chair that is no longer needed. My credit card was charged, as I had to give them a pay source when I ordered it. When it was to come in ******* account would have paid for it. Since ****** passed away in September his accounts have all been settled so there are no more funds to distribute. I called Alco Sales who are telling me that I have to pay for shipping them back and be charged a 10% restocking fee. This will amount to over $150.00 and I have no way to reclaim these funds. My issue is that they sent these items without ever checking to see if they were still needed. If they had I would have addressed, it with them. I do not feel I should have to pay for the return shipping or the restocking fee as it was their misstep in the first place.Initial Complaint

1. I ordered two Stryker stretcher pads Model #************ from Alco ************************************************** I paid $758 + $69.90 S&H = $827.90 (12/5/2021).3. What I received (12/10/2021) were two vastly inferior stretcher pads made by ********.4. My complaints: this was an unauthorized substitution of a vastly inferior item;the substituted item had defects in materials, construction, and sizing.5. The first response from Alco *********************************************** to my complaint (12/12/2021) was to tell me the items were never intended for the use I had in mind.6. I complained again (12/17 & 12/22/2021), noting that the items were sub-standard even by their own criteria for its intended use. At that point, they told me to return the items at my own expense, in their original packaging, after which the manufacturer would make a decision on any refund.7. I never dealt with the maker of this product, so I will not await any decision made by them.8. The items were an unauthorized substitution, so I will not pay for return shipping.9. Even had I agreed to return the items, it would be impossible, as the compression ratio of the stretcher pad is approximately 4-to-1. It is not possible for an individual to compress these items down to 25% of their current size without commercial equipment.My first preference for a resolution is for Alco *********************************************** to send me the two (2) Stryker stretcher pads, Model ##************, that I ordered. If they agree to do this, I will ship the pads I received back to them, or to the manufacturer, at my expense, but in their current un-compressed state.If Alco *********************************************** refuse to do this, then I want a refund down to the maximum of what I believe the items I received are worth: $100 each. This would be a refund of $279 each, for a total of $558.
