      I paid $3500 for premium treated wood and a cheap low grade wood was used with 80% to 95% splits in wood. They didnt use wood screws in most of the wood but nails that sticking out in places. The protective ********* to basement was not secured and freely moved and is very dangerous! There is structural damage due how the bolts were screwed in the wood is severely cracked and split. My husband and I are in our seventies and fear for our safety. ****** refused to inspect the work before and after our complaints. We have no assurance that he will make and repairs, he cursed me using the ** word. He never called me back, I had to keep calling and he flat out told me he wasnt going to replace the porch regardless of the structural damage. We took a long time to save that money to buy a new back porch. He committed from by using 3rd grade wood and unskilled workers. Pleas help us.

      Customer wants to replace entire ********************. I told her we cannot do that . She then requested to replace the post. The post is srructural and would need ro disassemble entire porch. I told her we can use a wood filler and she refused that. We do admit that the wood ***  Have not been the best but with the pandemic there was a shortage on material.

       We do have a stipulation on our contracts that we are not responsible for wood that *** split or warp Due to natural behaviof the wood.

       I will gladly have my guys go over there and fill the wood.

      I am rejecting this response because:

      He lied, I want the beam that his workers severely damaged replaced, its under the porch. They saw that it was damaged and continued to build the porch anyway!! The quality of the wood is substandard and not the premium treated wood that I contracted for. He admits that he committed fraud by giving me low graded wood and he didnt tell me anything!  I want the beam replaced, the ********* to the basement properly anchored, the touch of your hand moves it! I want the bottom post at the stairs replaced and I want the protective coat applied to the wood as contracted. I have no guarantee that he will return my call as he didnt before.  Please help we are scared the porch will cave in and we will be critical injured.  Please help we are in our 70 and we SAVED a long time to pay the $3500.00 dollars

      I am rejecting this response because:

      They havent done anything yet, they are saying that they are ONLY going to smear wood filler and NOT replace the two bottom post at the bottom of the stairs as ****** promised still refuse to do anything about the beam they messed up under the porch or repair the ******** to the basement that was not anchored and moved freely and is a major hazard to anything who touches it for support.  They will fall into the basement.  Please help **!

      My previous complaint was filed and closed. However, the company did not repair/replace anything. The *************** inspected the porch constructed by the company and found it to be in violation as it pertains to the construction. I never was given a permit as evidence by the attached city inspection building code violation document. I want my porches corrected according to the city codes for porches.

      WE notified by email ***************** that repairs will be done even though it was 7 years later.

      Its like purchasing a car in 2014 and complaining now 2021 that there is something wrong with it.

      We emailed her on the last compliant went out to visit the site and was met by her Husband who i never met who berated and belittled us.

      I emailed her her July 9th to agree we would do all repairs they requested, WE received no answer.

      At this time we believe we did everything in our power to make this right even though it is 7 years later.

      At this time we we believe it is not our issue or responsibility to maintain the  property maintenance is the owners responsibility.

       

      Yes the BBB is here to protect the consumer and i appreciate that but i did everything i could to satisfy this client.

      I am rejecting this response because:  Prior to the unsigned for certified mail and numerous phone calls prior to the 7 years asserted by the business response, I made numerous attempts.  It was not until the 1st BBB complaint that the business contacted me.

      To the extent the business attempts to compare the car example as justification misses the point.  The 2014 car was not sold based on fraud and misrepresentations.

      No one ...berated or belittled us... is not forthright.  The construction and failure to obtain permits, plans and failing to meet city code was brought to the business attention after learning that the business built porches in and around ******* with the type of construction failure the city inspector discovered.  Moreover, with plans or a permit.

      I did receive an email, again, only after the BBB involvement.  The repairs offered was not going to resolving the issues discovered upon inspection of the porches that a company constructing porches should have known or knew was not up to code.

      The company should not and must not attempt to resolve the issues based on a ..belief.. when the city codes are specific.

      Furthermore, the issues discovered by the city inspector was not one of maintenance, but of construction without a permit and contrary to code.

      The consumer will be satisfied after the company clear the issues within the city inspectors report.

      The time frame as grounds to overcome resolving the issues rest on fraud from the beginning.

      Due diligence on behalf of the consumer was made to resolve the issue to no avail.

      It has been over 7 years there was nothing more I can do. Yes I responded when I got the BBB notice but that was the only time I thought I was ever notified my phone number has been public for the past ******************************************************************************************************** Now that they got the city involved I don't want nothing to do with it. Again it's been 7 years if they would have got a hold of me by phone or by email this problem would not be happening right now but I'm trying to do the best I can they are the ones making a mountain out of a molehill.

      I am rejecting this response because:  The business repeats it has been 7 years.  However, there is no limitations resting on fraud and misrepresentation.  I exercised due diligence by certified mail sent and returned to me.  There was not any failure on my part to contact the business. It is true that the business wanted to make repairs contrary to the code requirements found by the *************** Inspector.  The repairs would have been another fraud perpetrated by the business because the repairs would still have not met code.  The violations pertaining to the porches constructed by the business stems for it construction in the first instance, not over time or failure to maintain it.  The business attempted to make repairs after the first BBB complaint that would not bring the porches up to code required by the ***************. Accordingly, "...Now that they got the city involved I don't want nothing to do with it....", this position is a tacit acquiescence to the business failure to have constructed the porch without a permit or plans.  Having been exposed by the inspector, the company is upset with the  consumer contacting the city inspector who substantiates the claim by the consumer. The business cannot now say had the consumer got in contact with it by phone or email the problem would have been taking care of.  The consumer is not a ********* or porch builder that could have told the business that defects were discovered in the construction of the porches.  It was the business responsibility to construct the porch and the *************** to inspect it making sure it was up to code if the business pulled the permit, plans and a final inspection by the city inspector.  This problem  would not exist today.   The consumer only noticed that nails and various other parts were coming apart.  *********** maintains its unjust enrichment for work that was not performed accordingly despite having charged an orbiting amount that would have covered the cost for plans and permits.  The consumer only desire is to have what was paid for corrected and up to code.  It is not the consumer's desire to point out the law of contracts did not exist here and/or violations of the state and federal law, FTC, Consumer Protection and EEOC as she is a black female discriminated against and taking for a ride by this business.  There has not been any attempt to have the Attorney General involved.  The consumer wants the business to correct the violations found by the ***************.

      I had a new front and back porch done , I try to contact them on the phone with no luck so I sent a certified letter ,that I still have and never open to complaints about the condition of the porch,the nails are coming up,some of the wood is crack,I would just like for them to do the repairs
