My vehicle was towed for parking in an apartment complex on Monday 07/18/22. It was parked there from 11:00AM as the person who was borrowing the vehicle was visiting a friend. It was towed the same day at 3:00PM. I was not notified of the vehicle being towed, I was contacted my HPD officer ******** on 07/19/2022 that the vehicle had been towed by Kens towing and I could contact the to schedule pickup. On Tuesday 07/19/2022 I went down to Kens towing to pick it up, was sent to ***************************** to pay the tow fee & was charged higher than allowed by law ($347.91 which I paid not knowing the fee shouldve been much less). ***** at BIHF took the payment and contacted ******* at Kens to release the vehicle. When I got to the location where my vehicle was said to be I was told it had been drained and crushed. Nothing was wrong with my truck, it was driven the same day it was towed and I was told it was crushed. Kens failed to notify the registered owner that they even had the vehicle and give required notice and time required to retrieve my vehicle. I however contacted all disposal sites on the island personally and was notified by each that my vehicle was never there.Kens towing service is refusing to give me any further information, they have referred me to contact a woman named ********************* who is the property manager at the apartment complex that had the vehicle towed stating ***** said the can dispose of the vehicle. Although I wasnt able to get ahold of her, I did speak to the housing itself and was told that they only ordered a tow, nothing else. My vehicle was not disposed of as far as I know, but they wont give it back. Owner of Kens stated in a conversation with my father in law that the woman said they could have the truck. How can someone give you something that isnt even theirs. Kens failed to follow state laws and I want my vehicle back. It is very rare to find a truck like that in the condition it was in here in ******.

The attached invoice is a copy of the service that was performed at the request of the property manager ***** at ******************* after the vehicle was illegally parked at that apartment complex. The service performed was on private property at the request of the property manager who has the discretion to either have it towed away for the owner to come and claim it or disposed of immediately. There is no law that dictates whether or not a private property owner can or cannot have an unwanted vehicle disposed of at the property owners expense. This was not an HPD ordered tow although HPD was on the scene at the time of pickup. The next day a woman (who is not the registered owner of the vehicle) called to inquire the whereabouts of this vehicle. she was directed to call the property manager regarding why the vehicle was towed. The same day the registered owner of this vehicle went to our **** storage yard to look for his vehicle and was told that it was already disposed of per the request of the property manager. He claimed to have paid a fee to the property manager and was told to come pickup the vehicle by another associate at the property. My office contacted ***** at the property to request that she speak to the registered owner who believes that he is paying to retrieve  his vehicle from our company when the request was for a disposal and not a tow. Later that day the registered owner came in person to our administrative office in ***** and was told that it was already crushed and it was not in a safe area he could walk up to view. This is an unfortunate situation where our company is in the middle of a dispute between the property management company and  the registered owner. My only suggestion is the interested party making this claim request for the registered owner to pursue further action on their behalf.
